Dove Road, Southlake, Texas on approximately 25 acres. Current Zoning: "NRPUD" Non-Residential Planned Unit Development. SPIN Neighborhood #1. DETAILS: Kathy Zibilich of Griffin Harris PLLC, on behalf of Cellco Partnership dba Verizon Wireless, a Delaware General Partnership, is requesting approval of a Specific Use Permit for electric vehicle charging spaces consisting of two (2) electric vehicle charging stations to be installed to serve 4 parking spaces, including 1 handicap space, in the Verizon southeast parking lot adjacent to the main building. The handicap space will be utilized by a designated handicap space or a designated handicap electric vehicle. The electric vehicle charging spaces are allowed with an approved Specific Use Permit and limited to a maximum utilization of 10% of the total required parking spaces. There are 710 parking spaces on the site and the proposed 4 dedicated electric vehicle charge spaces will not exceed the 10%of the total parking spaces. These charging stations will be private electric vehicle charging spaces to be utilized by the Verizon staff and guests only.The applicant has provided additional information for the electric vehicle charging station specific use permit regulations in the Narrative. At the September 8, 2016 Planning and Zoning Commission meeting,the applicant addressed concerns from the August 23, 2016 SPIN meeting. The concerns were the line of sight from W. Dove Road and W. Kirkwood Blvd, the charging station noise, a request to provide landscaping to screen the charging stations,and a time limit for the specific use permit expiration date. The applicant provided line of sight photographs from both entrances (shown in the Plans attachment), stated that the charging stations do not produce noise, offered a landscape option for consideration along the W. Dove Road entrance (297-foot distance)to screen the changing stations from the street(530-foot distance from W. Kirkwood Blvd.), and stated that a specific use permit term limit would prohibit the financial investment for installing the charging stations. The applicant would prefer not to install the landscape, but has offered the option for City Council consideration. SOUTHLAKE 2030: This proposal aligns with Southlake 2030 Mobility Master Plan and Sustainability Plan recommendations by making provisions for alternative fuel vehicles. TREE PRESERVATION: The proposed electric vehicle charging spaces will be located adjacent to an existing parking lot; no trees will be affected by the request. PLANNING AND ZONING COMMISSION: September 8, 2016; Approved (5-0) as presented; subject to the Staff Report dated September 2, 2016; also subject to the Specific Use Permit Review Summary No. 2 dated September 2, 2016; also subject to the applicant's willingness to display an alternative landscape plan at City Council that provides additional landscape screening along the W. Dove Road entrance to the property relative to the electric vehicle charging stations; also subject to the applicant's willingness to paint the parking bollards from a bright yellow color to some type of neutral, grey or white - blended color; also allowing the applicant the option to sign and allocate the four electric vehicle charging spaces as needed relative to total handicap space designations. STAFF COMMENTS: Note: A specific use permit shall automatically expire if a building permit is not issued and construction begun within six(6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months. 45.20 SPECIFIC REGULATIONS FOR ELECTRIC VEHICLE CHARGING SPACES 1) Electric vehicle charging equipment may only be installed when accessory to the primary permitted use. 2) No more than 10% of the total number of required parking spaces may be designated as electric vehicle charging spaces. Days and hours of operations shall be included if time limits or tow away provisions are to be enforced by the owner. Information identifying voltage and amperage levels or safety information must be posted. 4) Design should be appropriate to the location and use. Facilities should be able to be readily identified by electric vehicle drivers but blend into the surrounding landscape/architecture for compatibility with the character and use of the site. 5) Equipment shall be located so as not to impede pedestrian travel, create trip hazards on sidewalks, or interfere with accessibility requirements. 6) Regulations for the electric vehicle charging equipment and spaces shall be established in the specific use permit. These regulations may include but are not limited to location; size of equipment; signage, including directional signage (if any); and lighting (if any). 45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors: a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage. d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood. e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties. f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood. g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces;and protection of the public health by all weather surfacing on all parking areas to control dust. h. Such other measures as will secure and protect the public health, safety, morals and general welfare. i.City Council may grant variances to specific regulations associated with a specific use set forth in Sections 45.To receive a variance, the applicant must demonstrate one of the following (As amended by Ordinance No. 480-MMMM): (a) A variance will reduce the impact of the project on surrounding residential properties; or (b) Compliance with this ordinance would impair the architectural design or creativity of the project;or (c) A variance is necessary to assure compatibility with surrounding developed properties; or (d) The proposed construction is an addition to an existing project that does not meet the requirements of this ordinance.
