EXECUTIVE
SUMMARY: Barker Rinker Seacat Architecture Inc., on behalf of the City of Southlake is
requesting approval of a Site Plan for The Marq Southlake Champions Club on
property described as Tract 3C and portions of Tracts 3C1 and 3C1A, L.G. Hall
Survey, Abstract No. 686, City of Southlake, Tarrant County, Texas and located
at 315, 275 & 285 Shady Oaks Dr., Southlake, Texas. Current Zoning: "CS"
Community Service District. SPIN Neighborhood #7.
DETAILS: The project is generally located at the southwest corner of Bicentennial Park
adjacent to Shady Oaks Drive. Construction for Phase 1, named Legends Hall,
was completed in December 2015. Phase 2, named Champions Club, is
proposed to be approximately 84,000 square feet and include spaces for
fitness, performance training, gymnasium, indoor jog/walk track, indoor
aquatics, indoor playground, party rooms, child watch and multipurpose
classrooms for programs.

VARIANCES
REQUESTED: The following variances are being requested in relation to the proposed
development:
1) Variance to driveway stacking depth under Driveway Ordinance
No. 634, Section 5.2(d): A minimum stacking depth of 100 feet is
required at this location. The proposed driveway off Shady Oaks drive
onto the property proposes a stacking depth of approximately 27'/2 feet.

2) Variance to lighting type under Lighting Ordinance No. 693-C,
Section 4: Permitted lighting types shall be high pressured sodium
lights or neutral or warm correlated color temperature Light Emitting
Diode LED lights. The applicant is requesting to install metal halide or
LED lights that exceed maximum allowed temperature range.
3) Variance to the intensity of illumination under Lighting Ordinance
No. 693-C, Section 5: The maximum outdoor computed or measured
illumination level on a property shall not exceed 20 foot candles
outdoors at any point. The applicant is exceeding this threshold at the
new sports fields being proposed.

- A Revised Site Plan for shade structures built over spectator seating
was approved by City Council on June 5, 2001 under Planning Case

City Council on September 4, 2001 under Planning Case ZA01-090.
- A Zoning Change and Site Plan to add 13.14 acres to the park
property and to construct a clock tower was approved by City

November 18, 2008 to add approximately 7 acres to the park and

historical Log Cabin was approved by City Council on April 7, 2009
under Planning Case ZA09-002.

SOUTHLAKE 2030 PLAN: Consolidated Future Land Use Plan
The Southlake 2030 Consolidated Future Land Use Plan designates the
subject property as Public Parks/Open Space. The Future Land Use
Plan defines Public Parks/Open Spaces as public areas designated for
active and passive recreation, such as parks and athletic complexes,
and public open space

In the Parks, Recreation & Open Space / Community Facilities Master
Plan a number of recommendations were adopted related to
Bicentennial Park. In relation to this specific request, a community
recreation center facility was recommended to be adopted into the
master plan at Bicentennial Park at the location that is currently being
proposed. The recommendation in the Parks, Recreation & Open
Space/ Community Facilities Master Plan reads as follows:
"6. Provide a Multipurpose -Facility with an amphitheater on the
southwest portion of the park. "

The applicant's proposed site plan request is consistent with the

TRANSPORTATION
ASSESSMENT:
adopted Bicentennial Park Master Plan and also the recommendation
within the Parks, Recreation & Open Space / Community Facilities
Master Plan.
Mobility Master Plan
The Master Thoroughfare Plan within the City's Mobility Master Plan
designates Shady Oaks Drive as a 60-foot (C2U) undivided collector
roadway.
The Master Pathways Plan requires that a minimum 6-foot sidewalk be
provided along both sides of Shady Oaks Drive. Currently, there is an
existing partial sidewalk along Shady Oaks Drive and proposed
sidewalk construction for the remaining piece that will comply with the
master plan.
Area Road Network and Conditions
The proposed project is located on the north side of Southlake Blvd. in
the southwest quadrant of the existing Bicentennial Park complex
between White Chapel Blvd. and Shady Oaks Dr. The site is bordered to
the south by retail development along Southlake Blvd.; to the east by
the north -south pond/water feature within the park; to the west by Shady
Oaks Dr.; and to the north by Unity Way, the east -west spine road
through the park. The roadways will provide direct access to the site via
existing and proposed driveways from Shady Oaks Dr. and Unity Way.
The southern -most driveway into the project from Shady Oaks Dr. is
proposed to be removed and an alternate driveway, as shown on the
proposed site plan, is to be constructed.
Shady Oaks Dr. is described as a two-lane undivided 70 foot collector
roadway.
Traffic Counts
" Based on the (2015) City of Southlake Traffic Count Report
Traffic Impact
A traffic impact analysis dated September 30, 2014 was submitted for
review with The Marq Phase 1 (Legends Hall). The TIA assumed
complete development of all Phases of The Marq. The
recommendations are to adjust the signal timing on the Shady
Oaks/Southlake Boulevard signal and construct a right turn lane at the
primary entrance (northern most entrance on Shady Lane). - Link to TIA

TREE PRESERVATION: Development of public Community Service (CS) zoned properties are
subject to the regulations of the Tree Preservation Ordinance. All
protected trees that must be altered to construct the required and
permitted improvements based on the City Council approved Tree
Conservation Plan are exempted from the tree replacement and
protection requirements of this section. Such improvements may
include building pads, required parking areas, driveways, fire lanes,
streets, and required utility and drainage infrastructure that are required
by City ordinances and have been approved by the appropriate boards
or officers of the City.
The proposed existing tree cover preservation falls slightly short of
complying with the Existing Tree Cover Preservation Regulations of the
Tree Preservation Ordinance. But, if the one (1) proposed "Borderline"
tree is preserved the preservation would comply. The existing tree cover
is 16.1 % and 70% of the existing tree cover is required to be preserved.
If the "Borderline" tree is removed the remaining existing tree cover
would be 68.7%, and if the "Borderline" tree is preserved the existing
tree cover preservation would be 71.8%.
UTILITIES: Utilities exist for this project within the site that were constructed with
The Marq Phase 1 (Legends Hall). Service connections and some
additional fire hydrants are all that will be required with The Marq —
Champions Club.
DRAINAGE: Storm drainage was accounted for with the design of the Marq Phase 1.
An existing detention pond will receive the stormwater runoff and control
the release into the downstream system.

Variance Approval Criteria for Lighting Ordinance No. 693-C:

APPEALS; VARIANCES: MODIFICATIONS
(a) A person may request a modification or variance from the provisions of this
Ordinance. The person shall submit an application for a variance to the building
official on fords prescribed by the building official.
(b) A person who is dissatisfied with the decision of the building official may file an
appeal. The person may file an appeal not more than 10 days after the
determination of the building official. The person shall submit an appeal to the
building official on forms prescribed by the building official.
(c) The city council, after receiving a recommendation from the planning and zoning
corniixission. may grant a modification or variance front the provisions of this
Ordinance in any of the following circumstances:
(1) Upon finding that strict application of the Ordinance would not forward
the purposes of this Ordinance. or that alttmatives proposed by the
applicant would satisfy the purposes of this Ordinance at least to an.
equivalent degree.
(2) Upon finding that an outdoor light. or system of outdoor lights required
for a particular use cannot reasonably comply with the standard and
provide sufficient illumination for safety or security, as determined by
recommended practices adapted by the Illuminating Engineering Society
of North American for the particular use or other evidence submitted by a
professional engineer or other professional organization.
(1) Upon finding where a literal application or enforcement of the regulations
would result in practical difficulty or unnecessary hardship and the relief
granted would not be contrary to the public interest or the intent but do
substantial justice and be in accordance with the spirit of the regulations
and this Ordinance.
(d) The city council may impose such conditions on a modification or variance which
it deems appropriate to further the purposes of this. Ordinance.

8=11 MODIFICATIONS. VARIANCES AND AP>'L ALS
$.1 MODIFICATIONS: Modifications may be granted by the Director for the particular area
of responsibility controlled by such official under- unique circumstances whenever needed
to recognize extenuating circumstances or preserve the health, safety and welfare of the
public, and provided the modifications provide the same degree of protection, and
provided tbat the modifications are in conformity with the intent and purpose of this
ordinance. The Director may defer any request by an applicant to the City Council for
final determination.
8.2 VARIANCES AND APPEALS: Any applicant who desires a variance or elimination of
the requirements herein, or who desires to appeal a decision of the Director regarding
modifications to this ordinance shall file a written appeal to the Director who shall place
the request on the agenda for consideration by the City Council. The City Council shall
have the authority to grant a variance to this ordinance. In granting any variance, the City
Council shall determine that a Iiteral enforcement of the regulations herein will create an
unnecessary hardship or practical difficulty on the applicant, that the situation causing
unnecessary haardsWp or practical difficulty is unique to the affected property and is not
self-imposed, that the variance will not injure and will be wholly compafible with the use
and permitted development of adjacent properties, and that the gramitig of the variance
will be in harmony with the spirit and purpose of this ordinance. The decision of the City
Council shall be final.

of lighting, intensity, glare and spill -over. Variances have been requested.
2. Stacking is measured from the right of way line to the first turning movement. The stacking
depth, as submitted, appears to be approximately 27.4 feet. The Driveway Ordinance requires
a minimum of 100 feet of stacking depth for the proposed driveway onto Shady Oaks Drive for
this location. A variance has been requested.
3. Relocate the trees that are shown at the driveway entrance; they cannot be located within the
sight triangle.
The following are recommendations and observations by staff where your application may

Preserved Tree Cover Including `Borderline' Trees" should be greater than the "Proposed Tree
Cover Not Including `Borderline' Trees."
2. Provide the corresponding tree identification numbers in the tree table on the existing trees.

property has previously received a tree permit related to development, the percentage of
existing tree cover at the time the first such permit was issued shall be used to calculate the
minimum existing tree cover that must be preserved under this section.

public rights -of -way as approved by City Council.
Please be aware that all existing trees shown to be preserved on the City Council approved
Tree Conservation Plan must be preserved and protected during all phases and construction
of the development. Alteration or removal of any of the existing trees shown to be preserved
on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and
the zoning as approved by the Southlake City Council. Please ensure that the layout of all
structures, easements, utilities, structures grading, and any other structure proposed to be
constructed do not conflict with existing trees intended to be preserved.
LANDSCAPE COMMENTS:
Provide the required west bufferyard, and label the bufferyards on the Site Plan and
Landscape Plan. There will be only a west and south bufferyards. The west bufferyard is a 10'

length of the phase of construction.
2. The Seasonal Color calculations are incorrect.
3. Provide the required Canopy Tree and associated parking lot landscaping at the ends of each

freeze.

GENERAL COMMENTS:
The required backflow protection (double check valve) for the sprinkler system can be located
on the riser if the riser is within 100 feet of the water main. If the riser is further than 100 feet
from the main, the double check valve shall be in a pit. Riser rooms shall be a minimum of
5'X5' if the double check is not located on the riser, or a minimum of 6'X6' if it is on the riser.
The Fire Department Connection for the sprinkler system must be within 100 feet of a fire
hydrant. (A remote FDC is acceptable to meet the requirement)
Hydrants are required at a maximum spacing of 500 feet for commercial locations that contain
fully sprinklered buildings. (Due to the FDC regulation listed above, an additional fire hydrant
will be needed on the north side of the building to meet the spacing requirements)

Radius on south side of south entrance is not rounded adequately. Will become a wheel bumper at
pedestrian ramp. Offset intersection at this location with adjacent retail traffic may create confusion
and bottlenecks. Review stacking depth from parking lot intersection and Shady Oaks entrance.
Provide traffic control signage and plan.
Alignment of sewer line should be straightened/adjusted and only another single manhole added at
main line. Alignment runs too close to building pad and piers.

Informational Comments:
No review of proposed signs is intended with this site plan. A separate building permit is
required prior to construction of any signs.
All mechanical equipment must be screened of view right-of-ways and residential properties in
accordance with the Zoning Ordinance No. 480, as amended.
All lighting must comply with the Lighting Ordinance No. 693, as amended.
All development must comply with the Drainage Ordinance No. 605 and the Erosion and
Sediment Control Ordinance No. 946, as amended.
Development must comply with all requirements in Zoning Ordinance No. 480, Section 43,
Overlay Zones.
Masonry materials shall mean and include brick, stucco, plaster, cement, concrete tilt wall,
stone, rock or other masonry material of equal characteristics. Stucco and plaster shall only be
considered a masonry material when applied using a 3-step process over diamond metal lath
mesh to a 7/8th inch thickness or by other processes producing comparable cement stucco
finish with equal or greater strength and durability specifications. Synthetic products (e.g.,
EIFS —exterior insulation and finish systems, hardi plank, or other materials of similar
characteristics) shall not be considered a masonry material.
