16-021 RESOLUTION NO. 16-021 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A TEMPORARY SALES FACILITY ON PROPERTY DESCRIBED AS LOT 1, BLOCK 1, HARBORCHASE OF SOUTHLAKE, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT 700 EAST STATE HIGHWAY 114, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT"A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for a temporary sales facility has been requested by a person or corporation having a proprietary interest in the property zoned as "S-P-1" Detailed Site Plan District; and, WHEREAS, in accordance with the requirements of Sections 45.1(46) and 45.18 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow a temporary sales facility on property within the City of Southlake, Texas, located at 700 East State Highway 114, being described as Lot 1, Block 1, HarborChase of Southlake, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit"B"and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: City Council motion for approval: Resolution No. 16-021 Page 1 Approved subject to the Staff Report dated May 10, 2016 noting the approval of the signage on the awnings as presented (See Exhibit B); and noting with respect to the timing of the SUP, once issuance is granted, the SUP will expire the lesser of either one year or 30 days after the inspection of the facilities by the Texas Department of Aging and Disability Services. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 17th DAY OF May, 2016. The com m u n ity has an anticipated Certificated O c cu pan cy scheduled for fou rth 'quarter of 2016. As part of the pre-marketing/pre-leasing process Harbor Retirement Communities, the Operations Management Company for the community',opens a temporary marketing center for prospective residents and corn mu ri ity outreach. The temporary structurewill be located in the parking area adjacent to the building,visible from East Highland Drive and SH 114. The purpose of the center is to inform prospective residents about the building amenities,the interior finishes of the residential units, the services offered to them as residents,and allows preelection of preferred unit locations in thecommunity. The marketing center will be in place for approximately six to seven months prior to Certificate Occu pane,Ju ne 2016 th rough December 2016.
