Item 6B 13 CITY OF S0UTHLA1<,.,,E Department of Planning & Development Services STAFF REPORT June 14, 2016 CASE NO: ZA16-020 PROJECT: Specific Use Permit for a Temporary Sales Facility EXECUTIVE SUMMARY: Hines — GTIS Carillon LLC and Soliel Developers are requesting approval of a Specific Use Permit for a Temporary Sales Facility on property described as Lot 1R, Block 20, Carillon Phase 1A, City of Southlake, Tarrant County, Texas and located at 1845 Riviera Lane, Southlake, Texas. Current Zoning: "ECZ" Employment Center Zoning District. SPIN Neighborhood # 3. REQUEST DETAILS: Hines — GTIS Carillon LLC and Soliel Developers are requesting approval of a specific use permit in order to keep an existing temporary sales facility on Lot 1 R, Block 20, Carillon Phase 1A in the Carillon development. The existing facility was permitted by right in December 2011 prior to the adoption of Ordinance 480-1111 which required a specific use permit approval by City Council. The approved specific use permit currently in place is due to expire June 30, 2016. The applicant is requesting an additional 2-year approval period which will result in an expiration date of June 30, 2018. Under Zoning Ordinance 480, as amended, Section 45.18, the following regulations were adopted under Ordinance 480-1111: 1) The City Council may grant a specific use permit to increase the maximum parameters set forth for temporary construction facilities by Section 34 of this ordinance and may grant a specific use permit to allow temporary sales facilities subject to the following standards: (a) Temporary facilities must be at least two hundred (200) feet from any occupied residence. (b) Temporary facilities must be skirted on the front and sides. (c) Temporary facilities must provide foundation landscape planting consisting of one (1) five-gallon shrub per four (4) linear feet around skirting (excluding entrances). (d) Each temporary facility shall have at least two (2) paved parking places (two (2) deep, tandem parking is not permitted). Case No. ZA16-020 (e) Temporary facilities may also be subject to other requirements as deemed necessary in order to promote public health, safety, welfare and aesthetics. VARIANCE REQUESTS: • The existing temporary sales facility is approximately 90 feet from the first occupied residence to the south and does not meet the distance criteria; a minimum of 200 feet is required. • The existing facility does not have the required landscaping (one (1) five- gallon shrub per four (4) linear feet) on the south side. There is an existing model home which is approximately 10 feet from that side of the facility. There is also a masonry wall and open space area on the north side which blocks view from any required landscaping to the north side of the facility. Please refer to photos provided in slide presentation. On April 7, 2016, the Planning & Zoning Commission unanimously recommended approval subject to the staff report and specifically noting approval of the requested variances and granting a 2-year approval period. On May 5, 2009 the City Council approved a Preliminary Plat for Carillon Residential under Planning Case ZA09-010. A final plat for Carillon Phase 2A-2 was approved by the Planning and Zoning Commission on May 3, 2012 under Planning Case ZA12-032. On September 4, 2012 the City Council approved a revised Zoning Change and Development Plan for Carillon under Planning Case ZA12-066. On June 18, 2013 the City Council approved a Specific Use Permit for a temporary sales trailer located at 1601 Riviera Lane. The permit expires June 21, 2015. Planning Case ZA13-059. Building permits were issued by right in December 2011 for the sales facility that currently exists and is being considered for approval under this application. On November 5, 2013 the City Council approved a Specific Use Permit for the existing temporary sales facility located at 1845 Riviera Lane, granting the requested variances and setting an expiration date of June 30, 2016. PLANNING & ZONING COMMISSION: April 7, 2016; Approved (5-0) subject to the Staff Report dated April 1, 2016 and specifically noting approval of the requested variances; granting a 2- year approval period.
