Item 4K CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT June 14, 2016 CASE NO: SV16-009 PROJECT: Sign Variance for Fidelis Realty Partners EXECUTIVE SUMMARY: Fidelis Realty Partners is requesting a variance to the Sign Ordinance No. 704-H regulations for number of signs, sign height and sign area for two (2) temporary land signs advertising property for sale located at 500 W. State Highway 114. REQUEST: Fidelis Realty Partners is requesting a variance to the Sign Ordinance No. 704-H regulations for number of signs, sign height and sign area for two (2) temporary land signs. Specifically, the applicant is requesting approval of two (2) temporary land signs at locations formerly approved for Dove 114 Infinity, LLC and prior to that, The Grove. Although the proposed signs are currently erected in the same locations as the previously approved signs, the sizes have slightly decreased. The first sign (1A) is located at the southeast corner of Dove Street and State Highway 114 frontage road. The second sign (113) is located approximately 1200 feet south of the first sign and faces the S.H. 114 frontage road. The previous temporary land signs for the property were approved by City Council on August 21, 2007; and granted two (2) year extensions in 2010, 2012 and 2014. The current approved sign variance is due to expire June 17, 2016. The applicant is requesting a two-year approval period for the two (2) proposed signs. On June 9, 2016, the Sign Board unanimously recommended approval subject to the staff report. S.H. 114. HISTORY: February 2006 — City Council approved sign variances for Aventerra signs on this site. In 2007, the sign face was changed to The Grove. August 21, 2007 - City Council approved two large temporary signs for The Grove for a period of 1 year (SP07-233A). August 3, 2010 — City Council approved an extension of the previously approved variance for a period of 2 years. August 7, 2012 — City Council approved an extension of the previously approved variance for a period of 2 years. June 17, 2014 — City Council approved an extension of the previously approved variance for a period of 2 years. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant_ Applicant is requesting a time extension for the size and locations of existing temporary signs. We seek permission to raise the maximum sign size threshold to 128 square feet(8'x 16). It is applicant's opinion that smaller signs would be insufficient and ineffective due to the size of the property (54 acres)and its location on Highway 114- 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed_ Elevation disparities(Between the land and adjacent roadway), setbacks and surrounding thick vegetation on the subject property dictate that signs of this size are required for adequate'Visibility and effective communication of the developer's intent. 3. That the variance vii II not injure and vii I I be wholly compatible with the use and permitted development of adjacent properties_ It is important for these signs to be large enough to conve,:,the magnitude of this project and ensure that nearby current and prospective residents will be averted and informed_ 4.
