Subject: Authorize City Manager to execute a contract for the
installation of a temporary traffic signal at North White Chapel
Boulevard and Ascot Drive/Dragon Drive with Durable
Specialties, Inc. in an amount not to exceed $250,000.
Action
Requested: Authorize City Manager to execute a contract for the installation of
a temporary traffic signal at North White Chapel Boulevard and
Ascot Drive/Dragon Drive with Durable Specialties, Inc. in an
amount not to exceed $250,000.
Background
Information: The purpose of this item is to expedite the installation of a
temporary traffic signal at North White Chapel Boulevard and Ascot
Drive/Dragon Drive. In an effort to immediately ease peak traffic
congestion at this intersection, a temporary traffic signal is
proposed until a permanent signal can be installed and put into
operation with the North White Chapel Boulevard widening project.
The design engineer's opinion of probable construction cost
(OPCC) is $196,600. Staff is requesting a not to exceed amount of
$250,000 to cover any contingencies. This request is for City
Council approval to authorize the City Manager to execute the
construction contract with Durable Specialties, Inc. for installation of
the temporary signal in the summer of 2016. The goal is to have
this signal installed and operational prior to the fall 2016 school
semester.
The City Attorney's office has reviewed the request to award this
construction contract without going through the competitive bidding
process and has offered an opinion that it is acceptable in this case
as it is "necessary to preserve or protect the public health or safety
of the municipality's residents."
Financial
Considerations: The recommended contract award amount is not to exceed
$250,000. Funds are available in the City Council approved budget
in the North White Chapel widening project.
Strategic Link: The installation of a temporary traffic signal at the intersection of
North White Chapel Boulevard and Ascot Drive/Dragon Drive links
to the City's strategy map relative to focus areas of Infrastructure
and Mobility. The project will serve our customers by achieving the
highest standards of safety and security. The signal will provide
travel convenience within the City and region. The specific
corporate objectives that are met by this construction project are to
invest to provide and maintain high quality public assets. The
critical business outcome is to enhance mobility through aggressive
traffic management initiatives and capital project implementation.

Legal Review: The City Attorney has issued an opinion on the legality of this
contract award.
Alternatives: The Council may authorize the City Manager to execute the
construction contract with Durable Specialties, Inc. or have the
contract brought back before Council and awarded by Council on
the next available agenda.

Re: Change order for traffic signal construction at intersection of White Chapel,
Ascot, and Dragon Drive.
Dear Rob:
You have asked for an opinion as to whether the City can enter into a construction contract
for installation of a traffic light at the above-referenced intersection without competitively bidding
the installation. As I understand it, the amount of the work would normally require competitive
bidding under Texas Local Government Code Chapter 252.
Section 252.022(a) contains the general exemptions from the competitive bidding
requirement. Among these exemptions is exemption(2),which exempts "procurements necessary
to preserve or protect the public health or safety of the municipality's residents." No case authority
or Texas Attorney General opinions specifically address whether the installation of a traffic signal
would fall within this general exemption category. However, the most recent case decided
interpreting this exemption strongly suggests that the construction of a traffic signal would be
sufficiently related to preserving or protecting the public health and safety of the municipality's
residents to be exempt from the requirement for competitive bidding.
Specifically in Wight Realtylnterests, Ltd. v. City ofFriendsivood,2013 WL1341216(Tex.
App.—Hous.,no pet.),decided on April 4,2013,by the First District Court of Appeals in Houston,

the Court determined that services related to the development of youth recreational sports facilities
may constitute a procurement necessary to preserve or protect the public health or.safety of the
municipality's residents, and noted that the city had previously taken the legal position that the
development of the sports facilities was necessary to protect public safety. If the construction of
sports facilities can be sufficiently related to public health and safety to fall within that exemption,
I believe a much stronger argument could be made that a traffic signal,the presence of which has the
potential to avoid collisions and saves lives, would likewise would fall within this general
exemption. Thus, while there is no dispositive authority expressly addressing this precise issue,
based upon existing case law, it is my opinion that a this purchase would likewise fall within the
general exemption,especially if your office determines that the installation of the traffic signal would
promote public health and safety. At the very least,there is no dispositive authority prohibiting the
issuance of a change order under these circumstances. Therefore,if your department determines that
the installation of the traffic signal would promote the public health and safety,I believe it would
be exempt from the competitive bidding requirements under section 252.022(a)(2), and since this
purchase would be exempt from the competitive bidding requirements of Chapter 252, the
installation of a traffic signal could be accomplished through a contract executed without competitive
bidding,much like a contract for professional services.
