That the air quality in this neighborhood will be lessened by exhaust of more cars, more heating/cooling,etc.This is especially harmful to children and older adults. 2. That Southlake Planning and Zoning has already(more than once)asked for a less dense and better planned community like the others in Southlake which were made by Terra. One member said,"This is not what you do. You can do better." 4. That the animals which live in this area and which go to the creek for water each day(bobcats, coyotes,opossum, raccoon,etc.)are not removed from their homes without consideration to the ecology of the area. Mr.Spain said to our concerns for the animals,"They will migrate." 5. The ecologies of streams are affected by urbanization. It has been proven that open areas add to ones wellbeing in mind and body. Making money should never trump the responsibilities to environment,wildlife,and ecology. I am writing, today, about the Stone Trail Estates addition that you are considering at your meeting next week. As I've stated in my previous e-mails to you, I am thankful to live in a city with such a pro-active, caring City Council. I tell other Southlake residents often that our council truly listens to and considers what the citizens want. It is very different, in a good way, from when we lived in the Keller area. Just as I stated when you were considering the Glenmore Addition, the Stone Trail Estates addition does not fit in with the vision of the community of Southlake. Smaller lot sizes and higher- density housing doesn't fit with the aesthetics of Southlake and also runs the great risk of reducing both the charm of our town and the property values. I know you all know this, but we don't need additional housing. People want to live here and we are a desired community -we are not begging for people to move here. It is unnecessary to approve developments that do not benefit the city. Houses that are extremely close together, with little-to-no yards are not what Southlake is about. We are a beautiful, thriving community of large houses with lots that accommodate those houses. Our outdoor space is part of what makes this community sought-after and keeps people here once they move. Another thing that makes us sought-after and keeps people around is the schools. As I mentioned in February with the Glenmore Addition, allowing high-density housing will do nothing but bring down the value of our education. I realize Stone Trail Estates is in Keller ISO, but the fact that people who are in Southlake city limits can apply for open enrollment leads to the risk of more crowding in our schools and bringing the excellence of the schools down. I truly love this community and hope to be able to serve it, as you do, once my kids are a little older. I care, just as you do, about what happens in Southlake. Stone Trail Estates is the product of a builder trying to make money -not the product of someone who cares about this community. And the homes located on the opposite side of the creek that reside in a lower elevation. Question—What research or improvements have been made to the creek to prevent flooding caused by the additional water? Question—In the event of future flooding(under conditions less than or equal to current rainfall records) who will be held responsible for damage? We've lived in our home for 37 years with no flooding problems whatsoever. Is the developer willing to stand behind his work and give us a personal guarantee flooding will not occur! Lot 3R • It's to our understanding that lot 3R is part of the Brock addition and is a completely separate lot from the Weisman's larger plat of land. Question—If this is true, why is it being included as part of the new development? Question—Does this mean the remaining residents of the Brock addition would have to agree to release lot 3R as we are being forced to do with the Haney property? Question— Does this also mean the development facts/figures are incorrect and as a result are even more dense than what's being presented, which has been a major concern for many? This Stipulation has left the Plaintiff and her son (Attorney representing Plaintiff) no option but to attempt in disqualifying Defendants vote to allow the 40 year old restriction to be lifted. See Exhibit 3 The Developer knows that residents of 105, 109, and 209 Brock(Defendants) will not agree to remove the restriction until his design is approved by city council (which has been denied twice,council 2030 meeting and recent rezoning meeting ZA15-152 and ZA15-153)and all his guarantees to Brock Addition community are put in writing. As the defendants have told the Plaintiff and Developer before, our entire community will agree to the release the restriction once he puts all his guarantees to the Brock Addition Community in writing and the council approves his design. He has not agreed to, nor have his plans been approved. Lawsuit remains pending. -Restriction does not allow more than one family home to be built on each lot of the Brock Addition neighborhood Additional notes: Brock Addition Restriction Release-Majority of the neighbors whom initially signed the release to remove the 40 year old restriction are no longer in favor of the build as Terra and Mr. Spain have changed the design multiple times and are now retracting many of his initial verbal guarantees. Brock Drive entry not an option for Mr.Spain-Mr. Spain does not wish to incorporate a "Brock drive entry" into his design because it was a guarantee in writing, in order to receive signature agreement by more than half of the Brock Addition community. This Guarantee states that Stone Trail Development will not utilize Brock drive as a neighborhood access. See Item 1 and Appendix for entire document"Partial Release" -Majority of the Brock community is now opposed of lifting the Terra restriction and have voiced their opinions, "that if they had to sign again they would oppose the design and not agree to lifting the restriction." Incorporating Brock into the design will require Mr. Spain to have new agreements signed by all Brock Addition Residents agreeing to lift the restriction. Top Brock Addition Community request/concerns: False statements by Mr.Spain to Brock Community-Residence initially asked if Mr. Spain did include Brock into his design (although not in favor)as an access point that he put in writing, to develop the Brock drive and incorporate sidewalks as the majority of the neighborhood walks up and down the street for exercise because of no sidewalks being available. This request was denied by Mr.Spain as he mentioned the city of Southlake would not approve a sidewalk design and street improvements if he requested it. Terra intends to rezone and replat the Haney Property and develop as part of a subdivision of single family residential homes. As part of the development, the Haney Property will no longer be a part of the Brock Addition, and access will no longer be provided by Brock Drive, and the new subdivision will fence off from the remaining lots within Brock Addition. It is declared as follows: 1. At the closing of Terra's purchase of the Haney Property, this instrument will be recorded in the Official Records of Tarrant County, Texas along with the Deed from Haney to Terra.
