Item 6H and 6I Items 6H and 6I June 7, 2016 Madame Mayor and members of the City Council. This is Human Resources Director Stacey Black and I will be presenting Items 6xx and 6xx on the June 7, 2016 City Council meeting. 1 Purpose Item 6H: Ordinance No. 1156, 2nd Reading, Appointing the Judge of the Municipal Court of Record and authorizing the Mayor to execute an agreement with the Municipal Judge. Item 6I: Approve Professional Services Agreement with Municipal Court Judge Carol Montgomery Both items 6H and 6I on your agenda relate to the appointment of the Municipal Court Judge. The purpose of item 6xx is to request City Council approval of the second reading of Ordinance No. 1156, Appointing the Judge of the Municipal Court of Record and authorizing the Mayor to execute an agreement with the Municipal Judge. Judge Montgomery was originally appointed on July 17, 2001 for a two year term and she has been reappointed by City Council every two years for the last 15 years. Her current term expires July 6, 2016, thus creating a need for City Council to appoint a Judge of the Municipal Court. The Judge is primarily responsible for presiding over all municipal court proceedings and performing magistrate duties. Judge Montgomery is seeking reappointment. 4 Charter Requirements Council Appointed Licensed attorney in good standing 2+ years experience Two year term The City of Southlake Charter establishes the appointment requirements for the Municipal Court Judge. Chapter 5 states that “The City Council shall by ordinance appoint one or more judges of the Municipal Court.” The Charter also stipulates a number of requirements including: the individual must be a licensed attorney in the State of Texas and must be in good standing the individual must have two or more years of experience of practicing law in Texas; and the judge shall serve a two-year term The Judge is primarily responsible for presiding over all municipal court proceedings and performing magistrate duties. 5 Ordinance No. 1156 Item 6H Appoints Carol Montgomery as Judge through July 6, 2018 Authorizes Mayor to Execute Agreement Ordinance No. 1156, included in your packet, authorizes the appointment of Carol Montgomery to Municipal Court Judge for the City of Southlake through July 6, 2018. Judge Montgomery currently satisfies all of the qualifications and conditions of the Charter. It also authorizes the Mayor to execute an agreement to establish the compensation, benefits and essential functions of the Municipal Court Judge. The Ordinance passed unanimously on the first reading at the May 17, 2016 City Council Meeting. The agreement to establish compensation, benefits and essential functions is item 6xx on this City Council agenda. 6 Agreement Item 6I Establishes compensation, benefits and essential functions: $68,337 Annual Compensation Limited benefits Should Council approve the 2nd reading of the Ordinance , compensation, benefits and essential functions will need to be established through an agreement. The agreement is Item 6xx on the Agenda. It proposes an annual salary of $68,337, which includes 4% merit and 1.5% cost of living pay adjustment. The agreement also provides limited benefits including: participation in the City’s retirement program (TMRS), dues for professional memberships, and registration costs for training programs. The agreement is for a two years, beginning on July 7, 2016 and expiring on July 6, 2018. 7 Financial Considerations Compensation, benefits and essential functions are included in the Judge’s Agreement. As mentioned previously, the proposed agreement provides for an annual salary of $68,337, which includes a 4% merit and a 1.5% Cost of living pay adjustment. The Judge’s benefit structure remains unchanged from the previous agreement. The financial impact to the FY 2016 budget is $890 and can be absorbed within the existing budget through salary savings due to staff turnover. 8 Staff recommends Council approve the 2nd Reading of Ordinance 1156, Appointing the Judge of the Municipal Court of Record and approve the professional services agreement for Judge Montgomery Staff recommends City Council approve the 2nd reading of Ordinance No. 1094, Appointing the Judge of the Municipal Court of Record and authorizing the Mayor to execute an agreement with the Municipal Judge. Staff also recommends City Council approve the Professional Services Agreement with Municipal Court Judge Carol Montgomery. 9 Questions?
