Item 4D Amend Residential Developer Agreement for Southlake Meadows Addition Item 4D Item 4D, 1 Amend Residential Developer Agreement to reassign developer rights to Toll Dallas TX, LLC for the Southlake Meadows Addition Requested action The requested action for this item to approve an 2 Location map Southlake Meadows will be located at the northeast quadrant of Dove Road and Sam School Road, west of State Hwy 114 3 Development plan PHASE 2 The development consists of 60 lots in Phase 1 and 36 lots in Phase 2 for a total of 96 Lots. The developer is also proposing to construction the Dove road sam school road n peytonville roundabout as part of this development. 4 The total amount of reimbursements from the City that will be reassigned to Toll Dallas TX, LLC upon reaching final acceptance milestones is $1,044,097. This sum includes $174,000 for the Gateway Lakes Park Fees; $710,502 for the Roundabout Construction and $159,695 for the Right of Way Acquisition all of which will be reimbursed upon final acceptance of the public improvements of Southlake Meadows. These reimbursements will be reassigned to Toll Dallas TX, LLC from Maguire Partners as part of the Assignment of Reimbursement Rights Agreement. 5 Financial Consideration Funding Allocated in: General Fund Storm Water Utility Fund (SWUS) Funding for the reimbursements have been allocated in the Sam School Road/Peytonville Avenue roundabout in prior City Council approved CIP budgets. Dove Rd. Peytonville Ave. The existing locations of the intersections of W Dove Rd with Sam school Road and N Peytonville Avenue contribute to the mobility challenges in this sector of the City. Due to the intersection configuration of these two intersections mobility during the peak hours is reduced. The City of Southlake planned for a dual roundabout at this location for Fiscal Year 2015. With the addition of the Southlake Meadows community this planned Capital Improvements Project has been accelerate and the developer offered to construct the roundabout with the development. 11 OVERALL WATER distribution City Participation 12” Water Line Relocation $52,622 Developer Participation Water Line $384,484 The overall water distribution map is shown on this slide. The City will participate in funding $52,622 dollars for the cost of the water line relocation in the roundabout. The Developer will fund $384,484 dollars for the construction of the water distribution system throughout the development.. 12 OVERALL SANITARY SEWER City Participation Sanitary Sewer $42,517 Developer Participation Sanitary Sewer $364,393 The overall sanitary sewer map is shown on this slide. The City will participate in funding $42,517 dollars for the cost of the sewer in the roundabout. The Developer will fund $364,393 dollars for the construction of the sanitary sewer system throughout the development. 13 OVERALL STORM SEWER City Participation Storm Sewer $210,274 Developer Participation Storm Sewer $640,422 The overall Storm sewer shown on this slide. The City will participate in funding $210,274 dollars for the cost of the storm sewer system in the roundabout. The Developer will fund $640,422 dollars for the construction of the storm sewer system throughout the development.. 14 The total cost for the public improvements for this development is 5 million 6 hundred eleven thousand eight hundred and twenty. The Developer is request the City’s participation for the costs of the Roundabout in the amount of seven hundred ten thousand, five hundred and two thousand dollars. The developer’s portion of the public improvements for the development is 4 million, nine hundred and one thousand, three hundred and 18 dollars. The respective percentages of the total cost of public improvements are 18% for the City’s portion and 82% for the developers portion. The chart illustrates the amount being contributed by each party. The cost of the engineering design is only for the roundabout design cost and not the subdivision design costs. 15 Glosser Property Colvin Property Avary Property The developer is requesting that the City participate in the costs associated with the right of way acquisition that was required to be obtained for the construction of the roundabout. There will be three properties impacted by the construction of the roundabout. The Glosser Property, Colvin Property and Avary Property. The developer is requesting that the City participate in 159 thousand 695 dollars. Dove Rd. N. Peytonville Ave. Approx. Limits of ROW Acquisition 0.032 Acres The Avary property will required the acquisition of 0.032 Acres. The total cost to the City for these amenities located within the right of way taking is 62 thousand 700 dollars. The developer will participate in 191 thousand 529 dollars for the other amenities. 17 Glosser right of way acquisition Restore Parking Lot Relocation of Driveway Sanitary Sewer Service Demolition of Septic Tank Slide Gate w/ Electric Opener W. Dove Rd. Approx. Limits of ROW Acquisition 0.163 Acres The Glosser property will required the acquisition of 0.163 Acres. The total cost to the City for these amenities located within the right of way taking is 96 thousand 996 dollars.
