PROJECT: Specific Use Permit for Temporary Construction Facilities for TD Ameritrade
EXECUTIVE
SUMMARY:
Adolfson and Peterson, is requesting approval of a Specific Use Permit for
Temporary Construction Facilities for TD Ameritrade on property described as
Lot 1R1R1, Block 1, Sabre Group Campus Addition, an addition to the City of
Southlake, Tarrant County, Texas and located at 1051 W. Kirkwood Blvd.,
Southlake, Texas. Current Zoning: “NR-PUD” Non-Residential Planned Unit
Development District. SPIN Neighborhood # 1.
REQUEST
DETAILS:
Adolfson and Peterson, is requesting approval of a Specific Use Permit for seven
(7) temporary construction trailers on the TD Ameritrade site for a period of two
(2) years. The construction trailers will be located in the southeast area of the
property with an access drive onto W. Kirkwood Boulevard. The construction
trailers will include one (1) office at 2,688 square feet, four (4) offices at 1,444
square feet each and two (2) offices at 722 square feet each for a total of 9,908
square feet of office space. Fourteen (14) concrete paved parking spaces will
provided for the trailers (two parking spaces are required for each construction
trailer). Each trailer (office) will have landscape plantings consisting of one (1)
five-gallon shrub per four (4) linear feet around the required skirting (excluding
entrances). The plan also identifies the approximate area for storage containers.
Additional information for the site provided by the applicant:
1. The construction trailers will be partially screened from W. Kirkwood
Boulevard by several tree preservation areas.
2. A gravel construction entrance and drive will be installed to the trailer parking
lot.
3. The construction fence with fabric screening and gate will be installed along
W. Kirkwood Boulevard at the construction staging area.
4. The applicant has provided a construction traffic plan for the project.

this report.

Heavy Commercial under case ZA82-024 (Ordinance No. 261-35).
November 19, 1985; The northern portion of this site was zoned "H"-
Heavy Commercial with the annexation of this portion of the property
under Ordinance No. 319.
August 4, 1987; Inclusive of the above described areas, approximately
342 acres, bounded by T.W. King Road, W. S.H. 114, W. Dove Road and
N. White Chapel Blvd. was zoned from "H" Heavy Commercial to "PUD"
Planned Unit Development allowing "R-1" and "R-2" Retail, "O-1"
and "O-2" office and "CS" Community Service district development under
case ZA87-015 (Ordinance 334-012).
September 19, 1989; The above described 342 acres was given "PUD"
Planned Unit Development zoning allowing "C-3" General Commercial,
"CS" Community Service development with the adoption of the Zoning
Ordinance No. 480 and the official zoning map.
October 17, 1995; A Zoning Change and Concept Plan for NR-PUD
allowing "C-3" General Commercial, "O-2" Office, "HC" Hotel and "CS"
Community Service development under Case ZA95-074 (Ordinance 480-
180) was approved for an approximately 127 acre portion of the
previously described 342 acres, west of the alignment of the approximate
alignment of Kirkwood Boulevard; "R-PUD" Residential Planned Unit
Development allowing detached single family residential development
was approved under Case ZA95-073 (Ordinance 480-179) for
approximately 199 acre portion of the previously described 342 acres,
east of the approximate alignment of Kirkwood Boulevard.
July 20, 1999; A Zoning Change and Concept Plan for NR-PUD
allowing a variety of non-residential uses and development to include
"High-Tech" uses, "O-2 Office", "Parking Structures", "Hotel",
"Restaurant" was approved for approximately 155 acre under Case ZA99-
056 (Ordinance 480-313). The area included portions of the above
described "NR-PUD" west of the alignment of Kirkwood Boulevard and a
northern portion of the "R-PUD" area east of the alignment of Kirkwood
Boulevard.

STAFF COMMENTS:
Due to the limited scope of this request, there are no staff review
comments.
The City Council shall consider the following in determining whether to
grant a Specific Use Permit for a temporary construction and/or sales
facility according to the Comprehensive Zoning Ordinance No. 480,
Section 45.18, as amended:
1) The City Council may grant a specific use permit to increase the
maximum parameters set forth for temporary construction facilities by
Section 34 of this ordinance and may grant a specific use permit to
allow temporary sales facilities subject to the following standards:
(a) Temporary facilities must be at least two hundred (200) feet from
any occupied residence.
(b) Temporary facilities must be skirted on the front and sides.
(c) Temporary facilities must provide foundation landscape planting
consisting of one (1) five-gallon shrub per four (4) linear feet
around skirting (excluding entrances).
(d) Each temporary facility shall have at least two (2) paved parking
places (two (2) deep, tandem parking is not permitted).
(e) Temporary facilities may also be subject to other requirements as
deemed necessary in order to promote public health, safety,
welfare and aesthetics.
Additionally, in granting or denying an application for a specific use
permit, the City Council shall take into consideration the following factors:
a. Safety of the motoring public and of pedestrians using the facility and
the area immediately surrounding the site.
b. Safety from fire hazard, and measures for fire control.

c. Protection of adjacent property from flood or water damage.
d. Noise producing elements; and glare of vehicular and stationary lights
and effect of such lights on established character of the
neighborhood.
e. Location, lighting and type of signs; and relation of signs to traffic
control and adverse effect on adjacent properties.
f. Street size and adequacy of pavement width for traffic and reasonably
expected to be generated by the proposed use around the site and in
the immediate neighborhood.
g. Adequacy of parking, as determined by requirements of this chapter
for off-street parking facilities for similar uses; location of ingress and
egress points for parking and off-street loading spaces; and protection
of the public health by all-weather surfacing on all parking areas to
control dust.
h. Such other measures as will secure and protect the public health,
safety, morals and general welfare.
i. City Council may grant variances to specific regulations associated
with a specific use set forth in Sections 45. To receive a variance, the
applicant must demonstrate one of the following (As amended by
Ordinance No. 480-MMMM):
(a) A variance will reduce the impact of the project on surrounding
residential properties; or
(b) Compliance with this ordinance would impair the architectural
design or creativity of the project; or
(c) A variance is necessary to assure compatibility with surrounding
developed properties; or
(d) The proposed construction is an addition to an existing project
that does not meet the requirements of this ordinance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
TEMPORARY CONSTRUCTION FACILITIES ON PROPERTY
DESCRIBED LOT 1R1R1, BLOCK 1, SABRE GROUP CAMPUS, CITY
OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT
1051 WEST KIRKWOOD BOULEVARD, SOUTHLAKE, TEXAS, MORE
FULLY AND COMPLETELY DESCRIBED IN EXHIBIT “A”, AND AS
DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT “B” AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS
, a Specific Use Permit for temporary construction and/or sales facilities has been
requested by a person or corporation having a proprietary interest in the property zoned as “NR-PUD”
Non-Residential Planned Unit Development District; and,
WHEREAS
, in accordance with the requirements of Sections 45.1(46) and 45.18 of the City’s
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have

, the City Council does hereby find and determine that the granting of such Specific

SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow seven temporary construction facilities on property
within the City of Southlake, Texas, located at 1051 W. Kirkwood Blvd, location being described as Lot
1R1R1, Block 1, Sabre Group Campus, an addition to the City of Southlake, Tarrant County, Texas,
more fully and completely described in Exhibit “A”, and as depicted on the approved plan attached hereto
and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions
contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following
specific requirements and special conditions shall be applicable to the granting of this Specific Use
