SB Item 5 - Another Broken Egg Department of Planning & Development Services S T A F F R E P O R T April 29, 2016 CASE NO: SV16-007 PROJECT: Sign Variance for Another Broken Egg EXECUTIVE SUMMARY: On behalf of Double R Restaurant Group, Chandler Signs is requesting variances to the Master Sign Plan for Bicentennial Retail Plaza (MSP) and Sign Ordinance No. 704-H to allow two (2) attached signs that exceed maximum permitted total sign area as well as letter/logo height and sign width. The location is 410 W. Southlake Boulevard, Suite 160. REQUEST DETAILS: The purpose of this item is to consider approval of a sign variance that would allow Another Broken Egg two (2) attached signs that exceed maximum permitted sign area as well as letter/logo height and sign width. More specifically, the applicant is requesting consideration of three different signage options for both the north and south elevations. The applicant is occupying the previous lease space of Burger Shack which received a variance for their sign area (55 sq. ft. approved) and logo height (33 inches approved) in June of 2012; and previous to Burger Shack was Fat Daddy's Burger House which received a variance for their sign area (48.3 sq. ft. approved) and logo height (33 in. approved) in May of 2010. Southlake Boulevard, Suite 160 HISTORY: September 2006 – sign variance approved for Bicentennial Plaza (SP06-362) which included conditional regulations for maximum letter height; number of signs; and minimum monument setback. City Council granted the three requested variances but noted that other than the variance on the letter heights, the attached signage would meet all other regulations of the existing sign ordinance and requiring the monument signs be brought back to City Council for separate approval. April 2008 – development monument signs approved by Council March 2009 – permanent attached sign permitted for Fat Daddy’s May 2010 – additional attached sign/logo permitted for Fat Daddy’s approved under SV10-007. June 2012 – permanent attached signs permitted for Burger Shack approved under SV12-008. STAFF COMMENTS: The sign criteria and application are attached to this report. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. At the 34 square feet that is allowed by city code the sign would not be visible causing customer to not be able to locate their establishment given that the building sits more than 125’ off of the road. 2.) That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The façade that the sign is going on is one of the larger facades in the shopping center giving our sign the appearance of being smaller. We want to make sure the sign looks proportional in the space that it is going. Also the building sits more than 125’ off of the road. 3.) That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. I believe increasing the size of the sign will help with safety because the sign will be seen from farther away giving a chance for people to signal and turn with enough time to alert the people behind them. Also, The Shack also had to go for a variance and was able to get their signs approved. 4.) That the variance will be in harmony with the spirit and purpose of the sign ordinance.
