REQUESTED VARIANCES
1.Tree Preservation Ord. No. 585-D requires a site with 0% -
20% of existing tree cover to preserve a minimum of 70% of
that cover. The applicant is requesting a variance to preserve
approximately 11.4% of existing cover.
2.A 10’ Type ‘D’ bufferyardis required along the southern
property line. A variance will be required if the applicant is not
able to provide the required bufferyardin that location. A
retaining wall is proposed in the area between the property
line and the drive lane.

Criteria for Variance from Ordinance No. 585-D
-A literal enforcement of the regulations herein will create an
unnecessary hardship or practical difficulty on the applicant,
-That the situation causing the unnecessary hardship or practical
difficulty is unique to the affected property and is not self-imposed,
-That the variance will not injure and will be wholly compatible with
the use and permitted development of adjacent properties,
-That the granting of the variance will be in harmony with the spirit
and purpose of this ordinance.
