EXECUTIVE
SUMMARY:
On behalf of Jeff Wang, Shawn Bartholomae is requesting approval of a
Specific Use Permit for a Commercial school, including trade school for a
proposed martial arts academy to utilize an existing tenant space at Commerce
Business Park on property located at 2820 Market Loop, Suite 100, Southlake,
Texas. The current zoning is “I-1” Light Industrial District. SPIN Neighborhood
#8.
REQUEST
DETAILS:
The applicant is requesting approval of a Specific Use Permit for a
Commercial school, including trade school for a proposed martial arts
academy to occupy an existing tenant space located at 2820 Market Loop,
Suite 100 in Commerce Business Park. The tenant space is approximately
2,400 square feet of useable space / 2,600 square feet of rentable space.
The parking spaces at this site are shared by two approximately 5,900
square foot buildings with multiple tenants.
On June 16, 2015 City Council approved Ordinance No. 480-RRRR which
removed Commercial schools, including trade schools as permitted uses by
right from Section 26 – “I-1” Light Industrial District. Section 45 – Specific
Use Permits of the Zoning Ordinance was thereby amended under 480-
RRRR to add Commercial School, including trade school to both the “I-1”
Light Industrial District and “I-2” Heavy Industrial District, subject to the
requirements outlined in Section 45.19.
45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE
PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL,
THE CITY COUNCIL SHALL CONSIDER THE FOLLOWING:
1) Safe access for the ingress and egress of students, pedestrian,
parking and vehicular traffic, including the identification of student
drop-off areas.
2) Adequate illumination will be provided at night to protect the safety
of those persons entering and exiting the site.

HISTORY:
Commerce Business Park was annexed into the City of Southlake in 1986, with
the Light Industrial Zoning (Ordinance No. 333).
A Final Plat for Commerce Business Park was approved by City Council on
September 2, 1986.
This property was given the “I-1” Light Industrial Zoning with the adoption of the
Zoning Ordinance No. 480 by City Council on September 5, 1989.
According to TAD the building located at 2820 Market Loop was constructed in
1996.

TRANSPORTATION
ASSESSMENT:Parking Analysis
Two approximately 5,900 square foot buildings share the parking spaces at this
site. There are 38 spaces, including 2 handicap spaces and 3 no parking
spaces for the entire building site. The narrative mentions that the parking
spaces at the front doors of each building have been designated “No Parking”
in order to assist handicap van parking, along with drop off and pick up.
The proposed martial arts academy is parked according to the ratio for
Business, Trade or Craft School, which requires 1 space per each 3 students
in attendance at peak time of day. The applicant has indicated that there will be
only 1 class at a time with 5-10 students per class. Based on 10 students at
peak time of day, this tenant requires 4 spaces. Based on the current tenant
mix, the site has enough available parking for 45 students at peak time of day.

1. 45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT FOR COMMERCIAL
SCHOOL, INCLUDING TRADE SCHOOL, THE CITY COUNCIL SHALL CONSIDER THE
FOLLOWING:

2. Regarding parking:
a. Ensure that all parking calculations for all tenant uses within 2820 Market Loop accurately
reflect the required number of off-street parking spaces required per Section 35.6 (Off-
Street Parking Requirements) of the Zoning Ordinance.
b. Please correct the parking analysis by reflecting the parking ratios listed below.Also,
correct the narrative to reflect these parking ratios as well. Remove any reference to a
1:400 parking ratio for the building. As noted, parking calculations for this building as based
on individual uses.
i. Office = 1 space per 300 SF
ii. Industrial (warehouse) = 1 space per 1000 SF
iii. The martial arts academy is parked at 1 space per each 3 students in attendance at
peak time of day. Please revise the parking analysis sheet to reflect this parking
ratio.
iv. Please ensure the number of students in attendance is accurate in the narrative.
The narrative currently states that there is only one class at a time and only 5-10
students per class.
v. The parking analysis references that there is 10,896 useable square feet, and the
narrative (page 3) notes that there is approximately 10,925 square feet. Please
reference the correct useable square feet in all places in the application

GENERAL COMMENTS:
Install emergency egress lighting with battery back-up throughout the occupancy to allow for visibility
during emergency conditions.
Provide illuminated exit lighting with battery back-up above all required exit doors and pathways as
required to easily locate exits.
Post an occupant load for the training areas.
Ensure panic hardware is provided on all designated emergency exit doors, and all other locks and
latches are removed from those doors. (Rear door must be an approved emergency exit due to occupant
load in the training area.)
Portable fire extinguishers are to be a minimum 5 pound, ABC Multipurpose, in sufficient quantities to
meet the 75-foot travel distance rule.
Existing buildings shall have approved suite numbers placed in a position that is plainly legible and visible
from the street, road or fire lane fronting the property. These numbers shall contrast with their
background.
Provide keys for emergency access to the occupancy that will be secured in the Knox Box located on the
building.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS, GRANTING A SPECIFIC USE PERMIT FOR COMMERCIAL
SCHOOL, INCLUDING TRADE SCHOOL ON PROPERTY DESCRIBED AS
LOT 9, BLOCK B, COMMERCE BUSINESS PARK, AN ADDITION TO THE
CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, LOCATED AT 2820
MARKET LOOP, SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT “A”, AND AS DEPICTED ON THE APPROVED
PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT
“B” AND PROVIDING AN EFFECTIVE DATE.
WHEREAS
, a Specific Use Permit for commercial school, including trade school has been requested
by a person or corporation having a proprietary interest in the property zoned as “I-1” Light Industrial District;

WHEREAS
, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted to allow commercial school, including trade school on property within
the City Of Southlake, Texas, more fully and completely described in Exhibit “A”, and as depicted on the
approved plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject
to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The
following specific requirements and special conditions shall be applicable to the granting of this Specific Use
Permit:

SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
