16-007 RESOLUTION NO. 16-007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TEMPORARY CONSTRUCTION FACILITIES ON PROPERTY DESCRIBED AS LOT 1, BLOCK 16, LOT 1, BLOCK 17, AND RESERVE STREET, SOUTHLAKE TOWN SQUARE, PHASE IV AND LOT 2, GREENWAY-CARROLL, ADDITIONS TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, AND ALSO BEING TRACT 3A AND A PORTION OF TRACT 3J, RICHARD EADES SURVEY, ABSTRACT NO. 481, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS AND BEING LOCATED AT 1420 DIVISION STREET, 1301 & 1501 E. SH 114 AND245 N. CARROLL AVE., SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for temporary construction and/or sales facilities has been requested by a person or corporation having a proprietary interest in the property zoned as "DT" Downtown District; and, WHEREAS, in accordance with the requirements of Sections 45.1(46) and 45.18 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow two temporary construction facilities on property within the City Of Southlake, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: Resolution No. 16-007 Page 1 • Subject to the Staff Report dated February 23, 2016; • Subject to Site Plan Review Summary No. 1 — Revised, dated February 23, 2016; • The Specific Use Permit approval is for a time period to not extend beyond thirty days following the issuance of a certificate of occupancy for the office building; and • The applicant agreed to provide plantings to screen the skirting around the temporary construction facility in accordance with Section 45.18 using above-ground potted plants rather than landscape plantings. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 1st DAY OF MARCH, 2016.
