Item No. 4 - Overview of City Council approved Resolution No. 15-007, a resolution of the City of Southlake, Texas which approved the agreement, terms and conditions of a 380 agreement with SRH Hospitality Southlake Investment, LLC (Westin Hotel) to promote economic development and stimulate business and commercial activity in the City. Larry Gallant, 2364 Mockingbird Lane, Grapevine came forward to answer any questions. Chairman Parrish opened the public hearing. Christy Byler, 1829 Our Lane, came forward and asked if the applicant was going to tap into the existing 8” water line that had been previously been paid for by the current residence. Chairman Parrish closed the public hearing. Mr. Gallant came forward and stated that he will not be tapping into the existing water line. There is an existing water line and meter installed for the residence. Commissioner Springer stated that this case is contingent upon the applicant getting approval from ZBA for the reduced lot size for the septic. Motion to approve ZA15-131, subject to the staff report dated January 28, 2016 and Concept Plan Review Summary No. 3 dated January 28, 2016 and including the variance requested. Requested Zoning: “S-P-1" Detailed Site Plan District. 9. PUBLIC HEARING David Jones presented Item No. 10, ZA15-139 and Item No. 11, ZA15-140 together. Chad Durham, 1250 E Copeland Rd, Suite 500, Arlington, Ascension Group Architects came forward. Commissioner Kubiak asked the applicant to clarify the permitted uses. Mr. Durham explained the list. Commissioner Kubiak asked staff about allowing memory care or skilled nursing Planning and Zoning Commission Meeting Minutes –February 4, 2016 Page 4 of 12 residential facility. Dennis Killough stated that memory care and skilled nursing services would be allowed. Mr. Durham stated that is not a needed use and can be removed from the list. The Commission discussed the uses followed by the materials. Commissioner Springer asked that the covered parking needs to be specific and noted on the site plan. Chairman Parrish agrees and would like it added that the columns be masonry. Mr. Durham stated that the columns will be masonry. Chairman Parrish asked staff about parking ratios. David Jones stated the regulations. Commissioner Forman asked about the accessory use structures on the floor area. Mr. Durham stated that the parking canopy is less than 2,000 square feet and would look better than individual canopies. Dennis Killough added that the roof of the parking canopy has area but does not have floor area. Commissioner Springer asked about the tower. Mr. Durham stated it was a budget decision. Commissioner Springer asked about what will be housed in the glassed space. Mr. Durham stated that the area will be lobby space. Chairman Parrish opened and closed the public hearing. Chairman Parrish asked staff if the elevations meet the articulations vertical and horizontal. David Jones stated yes. Matthew St. Marie, 144 Old Town Blvd, Argyle came forward. Commissioner Springer asked about the tree preservation. Matthew explained the tree preservation. PUBLIC HEARING Richard Schell presented Item No. 13, CP15-004, Item No. 14, ZA15-152, and Item No. 15, ZA15-153 together. Paul Spain, Terra Land Management, 2200 Estes Park Drive, Southlake came forward. Mr. Spain gave a separate presentation. Commissioner Forman asked if the flood plain on the southeast corner area is removed, what will that do to the density. Commissioner Forman is concerned about the density and the size of the lots. Mr. Spain stated that the development is currently at 25% open space. That part of the open space is 4 or 5 acres. Planning and Zoning Commission Meeting Minutes –February 4, 2016 Page 7 of 12 Curtis Young, Sage Group, came forward and addressed the flood plain lot, Lot 23. The total open space is 9 acres, 3 acres is in the flood plain. The density would go from 1.8 to 1.9. Commissioner Kubiak asked if the medium density residential land use change is not granted, how that will affect the development. Mr. Spain stated that it doesn’t affect the development, but it does make it consistent with the property next door. Commissioner Kubiak asked if the surrounding residents will have access to the trails and park. Mr. Spain stated yes. Commissioner Kubiak asked about moving the open spaces within the development versus surrounding the development. Mr. Spain disagrees. This allows less of a disturbance to the property and the trees. Commissioner Springer asked why the stub out onto Sienna isn’t being used. Commissioner Smith stated that the Sienna neighborhood is concerned about traffic moving through. Commissioner Springer agreed. Chairman Parrish opened the public hearing and read aloud the comment cards. Leroy McCall, 320 Brock Drive came forward in opposition. Mr. McCall is concerned about the quality of life changing and is concerned about the wildlife that exists. Michael Quinones, 105 Brock Drive came forward in opposition. Mr. Quinones gave a presentation. Perry Vargas, 209 Brock Drive came forward in opposition. Mr. Vargas is concerned about the drainage. Wiesman, E I (Sandra Bagwell) gave a notification response form in favor. Chairman Parrish closed the public hearing and asked Mr. Spain to come forward. Mr. Spain came forward to address the concerns. Commissioner Smith asked about the drainage and expressed concern about the drainage moving onto Brock Drive. Mr. Spain explained the drainage plan and the discussions he has had with Public Planning and Zoning Commission Meeting Minutes –February 4, 2016 Page 8 of 12 Works. Commissioner Springer asked about the Sienna Drive access. Commissioner Springer is concerned about Southlake Blvd. access. Mr. Spain stated that the residents on Sienna Drive didn’t want access. Commissioner Springer asked about the open access to the open space and trail systems. Mr. Spain would like to leave it open due the neighbors on Brock Drive likes the open space and likes to walk. Commissioner Kubiak is concerned about the Brock Lot and that the open space is all towards the back of the development. Commissioner Kubiak is also concerned about the density and agrees with Commissioner Springer. Commissioner Kubiak asked Debra Edmondson, 1730 Tuscan Ridge Circle came forward on behalf of William Lafavers and John Kuelbs in opposition. Ms. Edmondson expressed their concern about the value of their properties going down and making them undevelopable. Everyone that came forward all shared the same concerns that were expressed by Ms. Edmondson. Dan Emmer, 345 W Bob Jones Rd. came forward in opposition. Brad Duerst, 1360 Sunshine Lane came forward in opposition. Robert Kay, 1450 Sunshine Lane came forward in opposition. Dennis Spickles, 926 Turnberry Lane and Susan Duert, 1360 Sunshine Lane both are in opposition but do not wish to speak. John Milani, 500 W Bob Jones Rd. came forward in opposition. Ron Varance, 1749 E Highland Street came forward in opposition. Chairman Parrish closed the public hearing. Commissioner Smith is concerned about forcing property owners to rezone this property. Commissioner Kubiak shares in that concern. Commissioner Springer believes this a good thing. Motion to deny CP16-001.
