Item No. 4 - Overview of City Council approved Resolution No. 15-007, a resolution of the City of Southlake, Texas which approved the agreement, terms and conditions of a 380 agreement with SRH Hospitality Southlake Investment, LLC (Westin Hotel) to promote economic development and stimulate business and commercial activity in the City. PUBLIC HEARING Richard Schell presented Item No. 8, ZA15-124. Will Thorton, 2504 Hillside Court, Southlake came forward to represent Brenda Kleespies. Mr. Thorton gave a separate presentation. Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 3 of 15 Commissioner Greer clarified that this will not be a business after 2023. Mr. Thorton stated that this will not be a business. This is for the kids. Commissioner Greer asked about runoff. Mr. Thorton explained that significant drainage come through which empties into a pond on Mr. Worsham’s property and then across Lodestar and splits, then into the pond on the Kleespies’ property and then exits to the south. Commissioner Kubiak asked which way the topography runs. Mr. Thorton stated it is relatively flat on the Lodestar property, however the water way travels south and east on the north side of the Lodestar property and enters the Lodestar property and travels south through the Lodestar property to a lake. Then travels to the south and little bit west and joins the HOA lake on the south. Commissioner Forman clarified that this is limited to the six or seven girls and that there is no advertisement or any effort to make this available to the public. Mr. Thorton stated that is correct. Commissioner Kubiak asked how many horses are on the property. Mr.Thorton stated six. Commissioner Kubiak stated that he appreciated that the applicant reached out to the neighbors. Additionally, what were some of the issues that have not been resolved? Mr. Thorton spoke on the different conversations that he had with the neighbors and believes that most issues have been resolved. Commissioner Kubiak asked staff if any complaints have come in over the past couple of years regarding this property. Dennis Killough stated no. Chairman Parrish opened the public hearing. Vahna and Britt Benedict, 1600 Enclave Court came forward in opposition. They stated that they are concerned about the noise that the arena will generate and the runoff flows to their property into the retention pond. Ac Hoffman, 1611 Enclave Court came forward to speak in favor of this item. Heloise Hoffman, 1611 Enclave Court came forward to speak in favor of this item. Carli Repass, 716 Love Henry Court came forward to speak in favor of this item. Mattie Kleespies, 1613 Pheasant Lane came forward to speak in favor of this item. Ms. Kleespies presented a video. Maureen Schmuhl, 109 San Jancinto Court, Southlake came forward in favor for this item. Chairman Parrish closed the public hearing. Commissioner Kubiak asked staff what triggers the need for an SUP. Dennis Killough explained the ordinance regarding Specific Use Permit. It comes down to the use of the property and how the property is zoned. The boarding of horses and the arena triggered the SUP. Commissioner Kubiak expanded on that and asked if the arena and boarding were for personal use only, would it be aloud without an SUP. Mr. Killough stated yes. Commissioner Forman stated that is fits with the property. Brenda and Hank Kleespies, 1613 Pheasant Lane came forward. Commissioner Kubiak asked about the western boundary and providing some kind of buffer. Ms. Kleespies stated that it cannot be done due to the creek. Commissioner Springer stated that it is a good fit. Chairman Parrish is concerned about a seven year approval. Commissioner Kubiak agreed with the Chairman, but added that the applicant should try to find some way to shield the arena. Ms. Kleespies agreed to a three year approval. Josh Wargo, 425 Ridge Road, Grapevine came forward and gave a separate presentation. Chairman Parrish opened and closed the public hearing. Dennis Killough explained that on the thirteen acres there are no disturbances and on the three acres there is a tree cover. The applicant has agreed to conform with the tree conservation once they develop it. Motion to approve ZA15-132, subject to staff report dated December 30, 2015 and Preliminary Plat Review Summary No. 2 dated December 30, 2015 and noting specifically the conditions that the three acre tract will need to conform to the tree conservation requirements and that the thirteen acre tract will be allowed to delay conformant with the tree conservation requirements until development has started on that tract. PUBLIC HEARING Ernest Molinaro, 608 Winding Creek Court, Southlake came forward to request that this item be tabled. Mr. Molinaro believes that there was not enough to prepare. Chairman Parrish explained that notifications were mailed out according to state law. Richard Schell, presented Item 10, ZA15-134 and Item 11, ZA15-133 together. Tom Matthews, 2600 E Southlake Blvd. came forward with a presentation. Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 6 of 15 Commissioner Springer asked about the drive on the southern side. Mr. Matthews stated that a drive on the southern side would interfere with the pond and create a double frontage lot. Steve Dumler, 6708 Ethridge Ct, Colleyville, came forward as the owner of the properly. Mr. Dumler talked about the pond. Commissioner Forman asked when the lots to the north were platted that created the flag lot situations. Dennis Killough stated in 1995 and/or 1996. Mr. Matthews stated that the neighbors to the north had requested the driveway location. Commissioner Kubiak clarified the options. Broken down more, it actually shows three options. Mr. Matthews agreed and Dennis Killough explained further. Mr. Matthews stated that above all, the applicant would like to maintain the integrity of the area. Mr. Dumler stated the concept of the home that he would like to build. Commissioner Greer asked about lining the street with trees. Mr. Dumler stated that he had a landscaper for the property. Chairman Parrish verified that one of the variances is to have relief from the sidewalks. Commissioner Springer stated that an escrow account can be set up for future development regarding sidewalks. Commissioner Kubiak stated that a city street seems for intrusive than a driveway. In regards, can language be added for a greater setback? Mr. Matthews agreed. Steve Anderson stated that the developer would be responsible for the cost of construction of the street and then dedicate that back to the city once accepted for maintenance. Comment cards: Daniel and Anne Garza, 104 Harvard Dr. are in support for Option A; Wallace and Mary Willis, 106 Harvard Dr. are in support for Option A; Dev Govindaswany, 112 Harvard Dr. is in support; Scott Harvey, 108 Harvard Dr. is opposed. Mr. Molinaro is concerned about accessing the lots and maintaining the look of White Chapel. Christy Cox-Sabo, 607 Winding Creek Ct. came forward in opposition. Ms. Cox-Sabo is concerned about the flag shape lot and believes that this goes against the 2030 plan. Diane Smith, 609 Winding Creek Ct. came forward in opposition. Ms. Smith asked if this property is approved, can this property be spit again, adding more homes without written notice. Chairman Parrish and Dennis Killough, stated that the zoning restrict the lot size to minimum 5 acres and width of 300-ft. It could not be sub-divided again. In order to do so, the applicant would have to rezone the property with a concept plan. The current land use plan shows to be low density residential. Douglas Sullivan, 603 Winding Creek Ct. came forward in opposition. Mr. Sullivan stated that he lives directly behind the lot. On the drainage map, it shows the arrows where the water is supposed to flow. That is my backyard and is a current problem for me and the development of the house will only add to it. Mr. Sullivan continued and asked about deed restrictions that are proposed. Do these restrictions go before Council? Dennis Killough stated that the developer or owner of the property will have to speak in regards to the deed restrictions. Mr. Sullivan is concerned that the applicant could come back later and change everything including the zoning. Dennis Killough stated that any property owner can make application to change the zoning of their property. Mr. Sullivan asked if something could be put in the motion regarding the future of this property and about making the deed restrictions public. Tim Sralla, City Attorney stated that this case is for platting only, not rezoning. The property can be rezoned in the future as can any property. If the requirements are met by the applicant for the platting process, with the exception of variances, the Planning and Zoning Commission have to approve the plat. In a zoning case, that is legislative and the Commission has a broader authority to impose conditions. Commissioner Kubiak added that deed restrictions are a private matter and cannot be considered by the Commission. Mr. Sullivan asked what the minimum criteria of all the votes for the affected properties are. Dennis Killough stated that surrounding property owner opposition does not have any impact on a voting requirement for this type of application. Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 8 of 15 Mr. Sullivan stated based on that, one of the criteria is it cannot affect the surrounding property and the drainage is an issue. Commissioner Greer asked where Mr. Sullivan’s property was. Mr. Sullivan pointed out his property. David George, 601 Winding Creek Ct. came forward in opposition and stated that drainage is an issue. Mr. George stated that his house gets flooded regularly. He has had to re-route the water to keep it from happening. Mr. George is also concerned about structures being placed on the property line against his property. Chairman Parrish explained that in this type of zoning there are setback requirements and only a percentage of the property can be built on. Dennis Killough added that the setbacks are 40-ft to the boundary for main structure and for accessory structures it is10-ft. Barry Smith, 609 Winding Creek Ct. came forward in opposition and also stated his concern for drainage. Kathy Pace, 110 Harvard Dr. came forward in opposition. Ms. Pace clarified that currently it is one plat and the applicant would like to divide it into two. Ms. Pace would like to see the property to stay the same without dividing it. Chairman Parrish addressed Ms. Pace’s concerns and explained that the applicant has made application to divide the property. Patrick Donovan, 110 Harvard Dr. came forward in opposition. Mr. Donovan believes that this takes away from the current look and character of White Chapel. Michelle Cline, 114 Harvard Dr. came forward in opposition. Ms. Cline asked for clarification on protocol. Chairman Parrish explained that the applicant is taking notes on all questions and concerns being addressed. Ms. Cline is concerned about the 2030 plan not being held up to standard. So many different applications come forward that are not within the 2030 plan. Chairman Parrish explained that every application is different and currently the last pieces of property being developed are very difficult because of all the surrounding properties that are developed. Every application is considered and weighed upon for the best possible use. Ms. Cline asked about the notification letters, specifically why they were sent to the surrounding ISD’s. Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 9 of 15 Dennis Killough stated that is a state law requirement for a residential designation change is made. The city is required to notify the school district. Ms. Cline continued to ask about why the former owner and the current owner both got notifications and why they both have a vote. Dennis Killough stated that the mailing list is based on the ownership as they are when the city adopts the tax roll and Mr. Sykes is still listed as the owner of the property and Mr. Dumler is the applicant. Ms. Cline asked about the voting requirements. Mr. Killough explained the voting requirements again. Ms. Cline asked if Mr. Dumler will be the builder of both homes and Ms. Cline wants clarification of what Mr. Dumler is going to do with the property. Dennis Killough explained the application. Once approved, the plat will be recorded with the county. Ms. Cline asked about changing the zoning. Chairman Parrish explained that a zoning change is not being considered. Scott Harvey, 108 Harvard Dr. wanted clarification regarding the drainage. The easement is not noted. Chairman Parrish stated that it is a sewer connection. Tim Sralla stated that this application can only affect the property that is being re-platted so it cannot make any changes to the adjacent properties. Christy Cox- Sabo came forward again. The storm water drain is not noted on the plans where there seems to be a lot of drainage problems. A decision is being made without the appropriate information. A lot of information is missing. Ms. Cox-Sabo is concerned about the drainage. Chairman Parrish explained that the information that is being requested has nothing to do with what is before them. Kathy Pace came forward again in opposition. Chairman Parrish closed the public hearing. Mr. Matthews came forward to address comments. Regarding drainage: Mr. Dumler has agreed to put some berms in and channeling the water back into the pond. The drainage will be evaluated when the house plans are being reviewed by Building Inspections. The plan for the lots: Mr. Dumler will have a house built on the rear lot and Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 10 of 15 the front lot will be sold to a builder and/or individual. Commissioner Forman is concerned about option 2 and option 3. Flag lots are a concern. This makes option 1 a concern since flag lots can only be considered with a variance. Commissioner Kubiak agreed with Commissioner Forman. Commissioner Kubiak believes that option 1 is less offensive. However, our current city council has given guidance that is not an option and the gallery has shown that option 2 and 3 are not options either. Commissioner Greer stated that the division of the lots is what is before us. This gives us chance to put some controls on the division of the property. Commissioner Springer stated that he could support option 1 with the sidewalk in escrow. Flag lots are not allowed but this is extenuating circumstances due to the pond and driveway. Commissioner Ransom stated that he would support option 1 as well. Zoning: "C-1" Neighborhood Commercial District. PUBLIC HEARING David Jones presented Item No. 12, ZA15-136 and Item No. 13, ZA15-147 together. Justin Lansdown, 144 Old Town Blvd., Argyle came forward with a presentation. Chairman Parrish asked if the snow cone stand will be able to use the restrooms inside the retail building. Mr. Lansdown stated yes, they will have a similar agreement. Donnie Ward, 2010 E Dove Rd., Southlake came forward. The site plan shows a lobby where the restrooms will be located and assessable to the public. Commissioner Kubiak verified that the public will be able to assess, even on the weekends. Commissioner Kubiak continued to ask about tenants. Mr. Ward stated that he will be the owner of the building and lease out spaces as well as occupy some space. Commissioner Kubiak asked about the dry cleaner and if it was for drop off. Mr. Ward stated drop off only. Chairman Parrish opened the public hearing. Diana Wagner, 1480 N Kimball Ave., came forward in support. Commissioner Springer verified that the drive that will go through will connect to Mrs. Wagner’s property for future use. Commissioner Springer asked if Mrs. Wagner had any plans in regards to future use. PUBLIC HEARING Richard Schell presented Item No. 14, CP15-003, Item No. 15, ZA15-137, Item No. 16, ZA15-138 together. Randi Rivera, 111 Hillside Dr., Lewisville, came forward with a presentation. Commissioner Kubiak asked about freeway noise and landscape buffer. Planning and Zoning Commission Meeting Minutes –January 7, 2016 Page 13 of 15 Ms. Rivera explained the landscape buffer that is being proposed. It is sloped up from the highway. Commissioner Greer asked who the builders were. Ms. Rivera stated Toll Brothers. Commissioner Springer asked Sam School Rd. and whether or not it’s a trail or a sidewalk. Ms. Rivera stated sidewalk. Commissioner Kubiak asked staff regarding the Land Use Amendment to medium density residential. If the request was low density, the plan presented this evening, would require them to lose one lot. Dennis Killough stated yes. Chairman Parrish opened and closed the public hearing. Commissioner Kubiak stated that in the first couple of phases they more than got the density that they could have received on it. The open space is unusable. Commissioner Kubiak likes the site plan and believes it is laid out well, including the trails, buffering and trees. However, Commissioner Kubiak does not support medium density residential. Commissioner Springer stated it is consistent with the other two phases. Chairman Parrish stated that with the development, the city is gaining improvements to Sam School Rd.
