PROJECT: Variance to the Sign Ordinance No. 704-H Regulations for Chiloso
EXECUTIVE
SUMMARY: Douglas Jorgensen, on behalf of Chiloso Mexican Bistro is requesting approval
of a variance to the Sign Ordinance No. 704-H to allow an increase in the
allowable sign area for the restaurant located at 2251 E. Southlake Boulevard,
Suite 140, Southlake, Texas.
DETAILS: The applicant proposes to comply with all regulations of the Sign Ordinance
704-H with the exception of the following variances:

Area
The maximum letter size is permitted is 36 inches. The applicant is proposing
the maximum letter height of 22.6 inches and a logo height of 28.3 inches ("i"
with the flame).
The applicant brought forward the sign under case number SV15-012 at the
February 2, 2016 City Council meeting. The applicant was not present for the
City Council meeting and the variance was denied.

BACKGROUND INFORMATION

LEGAL DESCRIPTION: Lot 1, Block 1, of Kimball Oaks, an addition to the City of Southlake,
Tarrant County, Texas
CURRENT ZONING: "S-P-1" Detailed Site Plan District
HISTORY: May 6, 2014; City Council approved (6-0) the applicant's request to
table until the May 20, 2014 City Council meeting. (MSP14-001 Master
Sign Plan for Kimball Oaks)
May 20, 2014; City Council approved (7-0) the Master Sign Plan for
Kimball Oaks only approving the subject signs as discussed in this
motion: With respect to Building 'E': approving the sign package as
presented in the drawings before Council and the scale presented on
the architectural drawings are subject to the staffs review and
concurrence with the scale therein; also only approving Building 'G',
otherwise known as the Bassett sign, with the same stipulated
requirements as Building 'E'; approving the monument sign package
adding the applicant will add eight inch (8") illuminated address numbers
in the range appropriate for the addresses in the development; and also
approving the Corner Sign Feature as presented at S. Kimball Avenue
and E. Southlake Boulevard; and also approving, with respect to
Building 'C', only approving the east and south elevations with the sign
and logo fitting within the existing architectural elements as indicated in
the drawings, specifically within the lighter colored tan area within the
columns; and for staff to review the intent of Council to have the
appropriate band of architectural color around the sign within the

June 17, 2014; City Council approved (5-0) the conditional sign permit
noting the following: no action on Building 'G' tonight and will be going
back to the sign committee for consideration; in consideration of
Building 'C', the north elevation for the maximum logo size of 72 inches
with 20 inch letters for the `PGA' and 36 inch letters for the `Superstore';
and east elevation as presented; and the south elevation to match the
east elevation (for letter and logo sizes; and noting the south elevation

September 16, 2014; City Council denied (7-0). (MSP14-001a
Amendment to the Master Sign Plan for Kimball Oaks for the PGA
Superstore two (2) additional signs for the PGA Tour Superstore

February 2, 2016; City Council approved (6-0) a motion to deny (SV15-
012).

1 Thal a literal enforcement of the slgn regulation will oreabe an unneecessary hardship or practical
difficully on the applicant.
Other businesses in the shopping center are allowed to have larger
signs which gives coropetors an unfair advantage to draw potential
customers away from the business.
2. That the situation causing the unnecessary hardchlp or pracilcai difficulty is unique to the afieoted
property and is not self imposed_
The City has granted part of the shopping center -a Master Sign
Plan. This situar-ion is a unique and is not self imposed.
3. That the variance will not Injure and Wil be Wholly compatible with the use and perm itied
development of aojaoert propertles
This will not injure and will he wholly compatible with development
of adjacent properties. what is beings asked for him is already been
allowed by others in this development,

Yes, This variance will he in harmony with the spirits and purpose
of the sign ordinance. We are asking to be in the Master Sign Plan
for the shopping center. which is allowed in the Siqn Ordinance.
The reason this was stopped is the Genral contractor did not close
aut the sign permits, Signs Manufacturing has worked with the city
of Southlake rn$ny times and will make sure that the permit is
closed out as xequired by the city.
