Dove Rd ZA16-001 On behalf of Kreq Equities, Ltd., DeOtte Inc. is requesting approval of a Plat Revision for Kingdom Place, which includes 9 residential lots and two open space lots on approximately 11.437 acres located at 2080, 2117 and 2150 E. Dove Rd. 2 The is an aerial view of the 11.437 acre property located south of E. Dove Rd. and west of N. Kimball Ave. The subject property is outlined in red. 3 The future land use designation is low density residential and retail commercial. 4 The current zoning on the property is SF-1A single family residential district. 5 Preliminary Plat A Preliminary Plat for Kingdom Place, consisting of 9 residential lots and two open space lots, was approved by City Council on November 17, 2015. The Plat Revision is consistent with the approved Preliminary Plat. 6 Plat Revision A Plat Revision takes the place of a Final Plat for this development since a portion of the property was previously platted. 7 Tree Preservation Plan The Tree Preservation Plan is consistent with the plan approved with the Preliminary Plat. 60% of the existing canopy is required to be preserved per the Tree Preservation Ordinance and 65% of the canopy is shown to be preserved. 8 Variance to Section 5.02 requiring a 50’ right of way for a local street to allow a 40’ right of way (private road instead of right of way). Variance to Section 5.03 Intersection Angles increasing the allowable deviation of a street intersecting with an arterial from 10 degrees to 25 degrees. Variance to Section 5.04, which does not permit private streets in new subdivisions in which less than 75% of the lots contain homeowner occupied structures, to allow the proposed street to be a private street. Variances Requested (Approved with Preliminary Plat) The variances shown here were approved with the preliminary plat. Subdivision Ordinance No. 483, as amended, Section 5.04, does not permit private streets in new subdivisions in which less than 75% of the lots contain homeowner occupied structures. A variance was granted to allow the street to be a private gated street. A variance was also granted for the intersection angle to increase the allowable deviation of a street intersecting with an arterial from 10 degrees to 25 degrees. The subdivision ordinance requires 50’ of right of way for a local street. Since the street is private, right of way is not dedicated in the development, but rather the street is a private lot.
