Members Absent: Boardmembers Jeff Medici, Rob Baker, Brett Nickel, and Ronell Smith. Staff Present: Dennis Killough, Deputy Director of Planning & Development Services; Richard Schell, Principal Planner, and Karen Heistand, Board Secretary. Agenda Item No. 1 — Call to Order: Chair Dyche called the meeting to order at 6:30 p.m. Agenda Item No. 2 — Approval of the Minutes: Chair Dyche opened the discussion of the minutes of the Zoning Board of Adjustment meeting held on September 24, 2015. A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on September 24, 2015. Motion: Smietana Second: Panahy Ayes: Pannhoff, Midkiff, Panahy, Smietana, Dyche Nays: None Abstain: None Vote: 5-0-0 Motion: Carried Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner, announced the next regularly scheduled ZBA meeting is January 28, 2016, but that there were no submittals for that meeting. Agenda Item No. 4— Consider: ZBA-698, Variance to Ordinance No. 480, Section 34.2(f) requiring that no accessory building be located forward of the principal building on the lot on property described as Lot 12, T.M. Hood No. 706 Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 1435 N. Peytonville Ave., Southlake, Texas. Current Zoning: "SF-1A" —Single Family Residential District.. Planner Schell presented details of the case to the Board, explaining the request for approval of a Variance to Ordinance No. 480, Section 34.2(f) requiring that no accessory building be located forward of the principal building on the lot to allow an approximately 336 square foot pergola to be located forward of the principal building. As an informational note, Zoning Ordinance No. 480, Section 34.1.g allows gazebos, arbors, pergolas and trellises that are less than 120 square feet to be located in the side, rear or front yard. The proposed area of the pergola exceeds the 120 square foot criteria in that section, so approval of a variance to either Section 34.2(f) or Section 34.1(g) is required to allow the pergola as proposed. Once Planner Schell answered the Board's questions, the staff presentation was complete. Chair Dyche opened thepublic hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Vice Chair Smietana recused himself from this case. Michael and Nancy Carnahan, 1435 N. Peytonville Ave., Southlake, TX, the applicants and owners of the property, once sworn in, presented testimony and were available to answer questions of the Board. Once the applicant completed his presentation, Chair Dyche asked if there were those in the audience who wished to speak in favor of the request. There being none, Chair Dyche asked if there were those in the audience who wished to speak in opposition of the request. Ester Spickberry, 926 Turnberry Ln, Southlake, TX spoke and gave her reasons for opposition. Chair Dyche closed the public hearing and opened the item for discussion. A motion was made to deny case ZBA-698. Motion: Panahy Second: Midkiff Ayes: Panahy, Midkiff, Pannhoff, and Dyche Nays: None Abstain: None Vote: 4-0-0 Motion: Carried Agenda Item No. 5—: ZBA-699, Variance to Ordinance No. 480, Section 9.5(e) requiring all buildings or structures to have a maximum lot coverage not exceeding ten (10) percent of the lot area on property described as Tracts 1A4 and 1G, William Winn Survey, Abstract No. 1660, City of Southlake, Tarrant County, Texas and located at 1580 Randol Mill Ave., Southlake, Texas. Current Zoning: "AG"—Agricultural District Planner Schell presented details of the case to the Board, explaining the request for approval of a Variance to Ordinance No. 480, Section 9.5(e) requiring all buildings or structures to have a maximum lot coverage not exceeding 10% of the lot area, which in this case is approximately 5,187 square feet, to allow construction of an approximately 862 square foot garage addition to the principal residence, bringing the total lot coverage to approximately 6,027 square feet, or approximately 11.6% of the lot area. Steve Kettering, 1580 Randol Mill Ave, Suthlake, TX, the applicant and owner of the property, once sworn in, presented testimony and was available to answer questions of the Board. Once the applicant completed his presentation, Chair Dyche asked if there were those in the audience who wished to speak in favor of the request. There being no one, Chair Dyche asked if there were those in the audience who wished to speak in opposition of the request. There being no one, Chair Dyche closed the public hearing and opened the item for discussion. A motion was made to approve case ZBA-699. Motion: Panahy Second: Smietana Ayes: Pannhoff, Midkiff, Panahy, Smietana, Dyche Nays: None Abstain: None Vote: 5-0-0 Motion: Carried Agenda Item No. 6—: ZBA-700, Variance to Ordinance No. 480, Section 11.5(c) requiring a side yard setback of no less than twenty (20)feet on property described as Lot 7, Block A, Quail Creek Estates, an addition to the City of Southlake, Tarrant County, Texas and located at 2703 N. Quail Run Ct., Southlake, Texas. Current Zoning: "SF-1A"— Single Family Residential District. Planner Schell presented details of the case to the Board, explaining the request for approval of a Variance to Ordinance No. 480, Section 11.5(c) requiring a minimum side yard setback of twenty (20) feet to allow construction of an approximately 754 square foot garage attached to the principal structure to be located approximately ten (10) feet from the side property line. The applicant received approval of an approximately 980 square foot garage addition with a 10' setback on April 25, 2013, but a permit was not issued for the addition within one year from the date of approval and it has expired. Once Planner Schell answered the Board's questions, the staff presentation was complete. Chair Dyche opened the public hearing and called upon the applicant or the applicant's representative to make such comments and present evidence as the applicant should desire. Ron Brooks, 2703 N.
