The new jobs would benefit our community. The opportunity to have a good rehab facility locally would be a wonderful addition as well. I've heard that the primary obstacle to this project is an area of trees on the 5.7 acre piece of land. I've also heard that the plan for the rehab facility includes planting more trees than presently grow there. Obviously, the developer is concerned about the esthetics of the new facility and landscape. I understand the feelings of homeowners adjacent to this land. Right now they have a view of trees and field without the cost of owning the land. However, that land has, for more than 12 years, been zoned commercial. Secondly I would like to express my confusion on how a project that was voted down 7 to 0 by this council was allowed to so quickly resubmit a proposal, bypassing the P&Z process all together. This is especially confusing after the Mainstreet representatives were told directly by Ms. Mayor that if a vote occurred and it was voted down, which it did, that they would have to start the process from the very beginning. Apparently this is not the case. Additionally I have learned that the 2030 land use plan and zoning ordinances, which the city is supposed to hold all developments to as a standard, suddenly are null and void as it pertains to this property. My understanding is that this property was platted in 2003 and despite the current ordinances those can be bypassed and the rules and regulations of 2003 are now in play. Lastly I would like to express my view that this facility will be a logistical and safety concern for all parties involved. Compared to all other building/businesses in this area, this will be a 24/7 type building which is contrary to all other buildings located along this feeder. Since completing the DFW/Grapevine corridor project, traffic on this portion 114 feeder has greatly increased along with their speed of travel. Placing this facility at this location not only creates a safety concern for 114 travelers, but also the future employees, patient visitors, deliveries, ambulances and carry out vehicles that this type of facility demands. Mr. Alexander of Mainstreet said that the West wing held 30 beds and Mr. Fawks did the math to arrive at 70 beds total. Our understanding was that by removing the footprint of the West wing, more trees would be preserved and the driveway stacking variance would disappear. The"Compromise" model as we learned at the meeting with Dr. Bonola on 1/27/16, was that 16 feet was shaved off both the East and West wings and there are now 86 beds, as well as using the old, more onerous 585B tree ordinance. Please realize that the"Compromise" model destroys even more trees than the previous model as well as adds a very unsafe driveway.. The reduction of beds to 86, a number between 70 and 102, is irrelevant to the ordinances and the intent of Council to preserve more trees. We were told that the revised application would only have one shared driveway with Dr. Bonola's dental office. In the previous applications,the City Staff Report stated in Public Works Review, General Comments item 5,Sight distances shall comply with AASHTO guidelines. These guidelines are duplicated by TXDOT guidelines for driveways. I expected that someone in city staff would review the shared driveway for compliance with TXDOT requirements. Now in the new staff report, I find that the requirement no longer exists because there is no new driveway. In my opinion, the existing driveway does not meet the Sight Distance guidelines as required by TXDOT. I am asking you,The City of Southlake,to verify that the existing driveway meets the TXDOT requirements, before taking a vote on the ZA15-072 application. I think the driveway is out of compliance, by having less than(one half)of the required sight distance. A quick check by staff could verify this. An alternative would be to delay a vote till verification is complete. I have brought this, information and concern,to Dennis Killough and the City's Public Works division today. TXDOT requirements In "Driveway Design Principles" General Guidelines "The following guidelines apply to all driveways to a state highway". #1 "The driveway placement should be such that drivers approaching from the main roadway will have sufficient sight distance to ascertain the driveway's location in order to safely decelerate and complete the entry maneuver.Also,the driveway placement should be such that an exiting driver will have sufficient sight distance to judge a safe gap in oncoming traffic." "Decision Sight Distance is the distance required for a driver to detect an unexpected or otherwise difficult-to-perceive information source, recognize the source,select an appropriate speed and path, to initiate and complete the required maneuver safely and efficiently. Because decision sight distance gives drivers additional margin for error and affords them sufficient length to maneuver their vehicles at the same or reduced speed rather than to just stop, its values are substantially greater than stopping sight distances. Table 2-2 shows recommended decision sight distance values for various avoidance maneuvers." Stopping distance after sighting obstacle is 359.8 feet from 45mph. The measured sight distance on SH114 from the applicant's driveway at 3.5 foot elevation to 3.5 foot elevation looking East is 325 feet. Best as I can measure without getting run over. Conclusion If a driver departs the driveway westbound just as another driver gains a visual clue heading west,the 45mph car would not have enough room to do an emergency stop let alone do any maneuvering. Cars doing 45mph would not have time to turn into the driveway safely and departing driveway traffic could not pick a gap as the second car in the gap would be unseen till cresting the hill. This is 4 seconds,from visual clue till passing driveway. Ambulances leaving the facility with a critical patient with flashing lights will be unseen till after they commit to departing the driveway and risk being overtaken by high speed traffic. This is the same driveway that will be "accessed to and departed from"with service and oxygen trucks. These trucks, out of necessity will accelerate at a slower speed. Additional speed and inattention,for whatever reason,will make the matter worse. Departing traffic trying, unlawfully,to get on the SH114 on ramp will have three chances to get run over. When first made, this driveway extended South to the original SH114 and may not have had to contend with the hill when approved. The access road has evolved over the years from nonexistent to a high speed 3 lane highway. A two lane off ramp,an on ramp, increased speed limits, all traffic from Austin Oaks, and great numbers of Northwest Grapevine residents using SH114 have all made dynamic changes that affect the pre-existing but now unsafe driveway. I have submitted a 1 minute, digital video to council and staff through the City Secretary showing the traffic, as viewed from applicant's driveway. Its time 4:45pm,the time of a shift change as given by Chris Alexander,the applicant. This clip will be shown at council meeting February 2, 2016, if allowed. I implore you to investigate this claim before a vote. Some of you take the time,this weekend to sit in your car at the applicant's driveway and SH114 and look east. Look for the Gap. Don't go before 9am as you won't be able to see any traffic because of the Sun. Be as careful as you can when leaving the location. The healthcare landscape is rapidly changing,with an intense focus on efficiency,lower cost and better outcomes for consumers.The Transitional Care to be provided at this location will be short-stay therapy for its guest who will rehabilitate until they are ready to transition to their homes.A typical guest will stay for an average of thirty(30)days.After hospital interventions and surgeries such as cardiac events,strokes,or hip/knee replacements,our property offers a transitional platform for these patients with an array of physical rehabilitation needs.As healthcare expenditures rise there is an increasing focus by patients,providers and policymakers on restraining unnecessary resource utilization such as that incurred by preventable re-hospitalization.Transitional Care Centers are an important component in significantly reducing readmits. Since our previous submittal,Mainstreet has gone to great lengths to design a site that will meet all of the City's codes and requirements with regard to landscape,tree preservation,building size and access.Below is an explanation of the changes made not only to the site,but to the building in addition,to our attempt to address the concerns as expressed by City Council. Building changes: Mainstreet understands the City Council's stated concern about the size of the building in relation to the size of the property. To address this concern,Mainstreet is committing to shrink the building footprint by reducing the length of the building by slightly over 30'and by committing to a bed count reduction from 102 beds to 88 beds. The total square footage of the building has been reduced from the original 69,511 sf to 66,333 sf. The first floor footprint of the building is now 42, 808 sf. Site plan changes: The Mainstreet team has made further adjustments to the site plan by removing the western drive and dropping its request for a variance from the the required 75 ft stacking requirement.All access to the site will now be at the east end of the site via the shared drive with Next Century Dental,located at 2680 E.State Highway 114.One_access point that leads across the front of the building to the main entrance sits almost 98'from the Right of Way.The other is at the northeast corner of the site,just over 326'from the Right of Way line that leads to the service areas and staff parking at the back of the building.On-site parking has been reduced from 98 spaces to 70 spaces total.Cross access with Next Century Dental will allow for use of their east drive as a second point of ingress/egress to allow any traffic wanting to access the Hwy 114 west bound on ramp. MS-Southlake TX Project Narrative(Rev.3 2015.1-18) Tree Preservation/Mitigation: Since January 5,2016 City Council meeting it was discovered that;since the site was platted in 2004 and prior to adoption of the current tree preservation ordinance 585-D,the site should be reviewed under Ordinance 585-B.It is our understanding that this ordinance allows for the removal of the trees necessary for building pad,driveways,and associated parking.We also understand that any trees to be removed will be evaluated by the City's Landscape Administrator and a determination made in regard to the mitigation required. Mainstreet has made a good faith effort to preserve valuable trees on a site that contains many undergrowth trees and brush that should not be considered for preservation.Some of the changes made in an attempt to limit the number of trees that will need to be removed are;reduced the length of the building by 30'which has allowed us to reduce the paved area of the site as well,and thus reducing the original number of planned parking spaces.The site has been shifted 10'to the west in effort to save some of the older growth trees at the east end of the building,and remove some of the smaller undergrowth trees in the center of the site. By removing the westem drive we are able to redesign the grading along the southern of the site.This will allow us to save additional trees along the site frontage. At the urging of the City's Landscape Administrator there has been the addition of a retaining wall along the north drive that has alleviated the slope along the north property line and therefore enabled additional tree preservation. The current design preserves a total of 1,322 caliper inches and 111 inches being mitigated on site for non-exempt trees being removed. Grading and Drainage: By changing the building footprint,we are able to grade the site in a manner that reduces the disturbance on the west end of the site leaving more of the natural area.We have removed the berm along the west curb line and decreased the surface area of the pond.We intend to increase the depth of the pond in an effort to maintain a"wet pond"during dryer seasons.This will also allow more area on the site for tree mitigation around the retention pond. We respectfully request review and approval of the Site Plan submittal for the proposed development by Mainstreet.The development will enhance the corridor and add an exceptional and needed service to the City of Southlake.
