Item 4G Variance to extend plat validity Preliminary Plat and Plat Revision Southlake Meadows Item 4G Item 4G is a Variance to extend the validity of the Preliminary Plat and Plat Revision for Southlake Meadows (formerly Savannah Estates) 1 Applicant: G&A Consultants, LLC Request: Approval of a variance to extend the validity of the Preliminary Plat and Plat Revision for Southlake Meadows (formerly Savannah Estates) residential subdivision. Location: The northwest corner of W. Dove Rd. and W. State Hwy. 114 ZA13-037 and ZA13-074 G&A Consultants, LLC is requesting approval of a variance to extend the validity of the Preliminary Plat and Plat Revision for Southlake Meadows currently under construction at the northwest corner of W. Dove Rd. and SH 114. 2 Approved Development Plan The Development Plan that was approved with the zoning change March 5, 2013 includes 96 residential lots and 6 open space lots. 3 Approved Preliminary Plat Here is the preliminary plat that was approved June 4, 2013. Section 4.01(I)(1) states that a Preliminary Plat shall expire two years from the date of approval unless a Final Plat has been filed for a portion of the plat, which extends the expiration date of the preliminary plat for a period of one year from the date of plat filing. A final plat has not been filed on a portion of the plat, so the plat expired June 4, 2015. 4 Plat Revision Phase I The plat revision for the first phase of Southlake Meadows includes 60 residential lots and 6 open space lots. A Plat Revision is required in this case instead of a Final Plat because a portion of the property was previously platted. as the R.P. Estes Subdivision 1947 prior to annexation of the properties by the City. Section 4.01(I)(2) states that a Plat Revision which has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Plat Revision was approved by the Planning & Zoning Commission on December 3, 2014. Plat Revisions for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This ensures that street right-of-ways and easements are correctly shown based on as-built conditions and also ensures that all the new lots of record are properly served by streets and utilities. The Plat Revision for the first phase of this development has not been recorded due to continuing construction of the development and it has thus expired. 5 The request is to extend the validity of the plats for one year from the date of City Council approval. If approved at the January 19, 2016 meeting, the expiration dates for both plats will be January 19, 2017.
