Easter No. 474 Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 2801 E. Southlake Boulevard, Southlake, Texas. SPIN Neighborhood # 8. REQUEST DETAILS: Casual Living Ltd. is requesting approval of a specific use permit to allow outdoor sales or services. The purpose of this request is to gain approval to hold two (2) two-day parking lot clearance sales. The events will be held April 2-3, 2016 and September 17-18, 2016, respectively. The applicant has indicated that the sale events would allow clearance of seasonal sale stock and boost income to get through the slower winter season. Furniture will be set up in the designated area in the parking lot (shown on Attachment C, page 2). Demonstration of the Big Green Egg or Primo grills will take place during the events. Balloons and hot dogs will be available for kids. The April event will serve as the Grand Opening for the store. A letter outlining the applicant's Specific Use Permit request is located in Attachment C, page 3. Additionally, the applicant is requesting two temporary 3 ft. by 12 ft. banners, one for each event, to be staked near the front of the property for the events. The April event banner would read "Grand Opening" and the September event banner would read "Clearance Sale". The banner location is shown on the site plan (shown on Attachment C, page 2). On January 21, 2016 the Planning & Zoning Commission unanimously recommended approval as presented and subject to the staff report. ACTION NEEDED: 1. Conduct a public hearing 2. Southlake Boulevard LEGAL DESCRIPTION: 5R2, T. Easter No. 474 Addition LAND USE CATEGORY: Retail Commercial and Industrial CURRENT ZONING: S-P-2 — Generalized Site Plan District HISTORY: The following includes history for all three (3) lots — 5R1, 5R2 and 4, T. Easter No. 474 Addition: • March 19, 1996, the property was rezoned from "AG" Agricultural District to "S-P-2" Generalized Site Plan District with "B-1" Business Service Park District uses and limited "I-1" Light Industrial uses. A Concept Plan was also included with the approval. (ZA95-116) • March 5, 1996, an SUP was approved for Outside Storage. (ZA95-117) • June 3, 1997, a zoning change and concept plan was approved from "S-P-2" Generalized Site Plan District with "B-1" Business Service Park District uses and limited "I-1" Light Industrial uses to "S-P-2" Generalized Site Plan District with "C-2" Local Retail Commercial District uses and "I-1" Light Industrial District uses. (ZA99-011) • September 19, 2000, a site plan was approved for Cornerstone Plaza One. (ZA00-079) • March 20, 2001, a specific use permit for the sale of alcoholic beverages at Snookies was approved. (ZA01-014) • September 16, 2014; a zoning change and site plan was approved specific to Lot 5R2 and Casual Living. (ZA14-029) SPIN: A SPIN Forum meeting was not held for this case. P&Z Action: January 21, 2016; Approved (5-0) as presented and subject to Staff Report dated January 15, 2016. STAFF COMMENTS: Additional details are located in Attachment C, pages1-3 of this report. The City Council shall consider the following in determining whether to grant a Specific Use Permit for outdoor sales or services according to the Comprehensive Zoning Ordinance No. 480, Section 45.12, as amended: a. Approval of a specific use permit for outdoor sales or services shall be based upon an analysis of the location, the site layout and design Case No. Attachment A ZA15-146 Page 1 features, the assurance that the adjoining streets can handle higher volumes of traffic during peak hours of traffic loading without a requirement to divert traffic onto traditional residential streets and the compatibility of the proposed use with adjacent land uses. b. A fixed time period (specific dates) for the outdoor sale or service activity to commence shall be established in the specific use permit. The permit for the sale or service activity shall be established and unless otherwise stated in the permit, shall be valid one year from the date of approval by the City Council. c. Regulations for any structure used to conduct the outdoor sale or services activity including but not limited to, size, color, location of equipment, lighting and signage shall be established in the specific use permit. d. The location of outdoor sale or service activity shall not reduce the parking requirements or effectiveness of landscaped or buffer areas and the areas for the display of merchandise shall not adversely impact the ability of pedestrians or vehicles to move about the lot. e. The site must provide adequate ingress and egress. f. Provisions for waste collection, recycling and/or disposal may be established in the specific use permit. g. Each sidewalk or pedestrian way on the approved site plan shall be a minimum of forty-four inches (44") in width. Additional width may be required and pedestrian ways shall be subject to the Americans with Disability Act Accessibility Guidelines for Building and Facilities. The proposed event will take up approximately twelve (12) of the existing 81 parking spaces on the property. Staff has conducted a parking analysis based on the use of the property and determined the event will not have a negative impact on the number of parking spaces needed to serve the development. Every year at our other three Iomitions we hold a clearance sale in our parking lots for one weekend in the spring encs ono weekgnd in the foal.Since we are in the business of selling patio furniture,and our income is thereby seasonel,we rely pn these two sales to clear out old stock and to boast income to get us through the winter. Furniture is set up in our parking lot and sales staff is on hand to assist customers. We will usually have one of the 1319 Green Egg or Primo grills betngdemonstrated, and we have balloons and hot dogs for the kids. 7 hese sates generate a good deal of income for our stares, but do not add any traffic or parking burdens_ Where we would narrnally expect to have five customers at a time in our stores,the parking lot sales tend to generate ten to fifteen at a time. EASTER NO. 474 ADDITION, CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; AND LOCATED AT 2801 E. SOUTHLAKE BOULEVARD, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE.
