ZONING BOARD OF ADJUSTMENT MEETING: August 27, 2015

Members Present: Chair Scott Dyche, Vice Chair Mike Smietana, Board members Kourosh
Panahy, Guy Midkiff, Jeff Medici, Ronell Smith and Brett Nickel.
Members Absent: Board members Rob Baker and Bonnie Pannhoff
Staff Present: Dennis Killough, Deputy Director of Planning & Development Services, Richard
Schell, Principal Planner, Holly Blake, Board Secretary.
Agenda Item No. 1 — Call to Order: Chair Dyche called the meeting to order at 6:30 p.m.
Agenda Item No. 2 — Approval of the Minutes: Chair Dyche opened the discussion of the
minutes of the Zoning Board of Adjustment meeting held on August 13, 2015.
A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on
August 13, 2015.

Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner,
announced that the next meeting will be held on September 24, 2015.
Dennis Killough explained Board member participation in deliberations and voting for the new
Board members.
Agenda Item No. 4— : ZBA-694, Special Exception Use Permit per Ordinance No. 480, Section
44.12 (2), for the construction of accessory buildings or structures of a size or aggregate size
greater than permitted on property described as Lot 6, Block 1, Meadowmere Addition, an
addition to the City of Southlake, Tarrant County, Texas and located at 1860 N. Kimball Ave.,
Southlake, Texas. Current Zoning: "SF-30" — Single Family Residential District
Planner Schell presented details of the request for the approval of a Special Exception Use
Permit per Ordinance No. 480, Section 44.12 (2), for the construction of accessory buildings or
structures of a size or aggregate size greater than permitted to allow construction of an
approximately 640 square foot covered patio to be added to an existing accessory building
approximately 1,650 square feet in size, which brings the total area for all accessory buildings

requested to approximately 2,290 square feet. The SF-30 zoning district allows a maximum lot
coverage of 750 square feet for the sum total of all accessory structures and buildings on the
lot.
Chair Dyche opened the public hearing and called upon the applicant or the applicant's
representative to make such comments and present evidence as the applicant should desire.
Mike Neustadt, 1860 N. Kimball Ave., Southlake, TX the applicant and owner, once sworn in,
presented his reasons for the request and was available to answer questions of the Board.
Chair Dyche asked if there were those in the audience who wished to speak in support of the
request.
There being no one, Chair Dyche asked if there were those in the audience who wished to
speak in opposition of the request.
There being no one, Chair Dyche closed the public hearing and opened the item for discussion.
After discussion from the board, Chair Dyche stated that he was prepared to entertain a motion
on the request.
A motion was made to approve case ZBA-694.

Agenda Item No. 5 -ZBA-695, Variance to Ordinance No. 480, Section 14.5(d) requiring a rear
yard setback of not less than forty (40) feet on property described as Lot 1, Block 1, Park Place
Addition, an addition to the City of Southlake, Tarrant County, Texas and located at 612
Boardwalk Ave., Southlake, Texas. Current Zoning: "SF-20A" — Single Family Residential
District.
Planner Schell presented details of the request for the approval of a Variance to Ordinance No.
480, Section 14.5(d) requiring a rear yard setback of not less than forty (40) feet, to allow a
garage addition to the principal structure to be located approximately thirty (30) feet from the
rear property line.
Chair Dyche opened the public hearing and called upon the applicant or the applicant's
representative to make such comments and present evidence as the applicant should desire.
Thomas Elam, 612 Boardwalk Ave., Southlake, TX the owner and Philip Kent, 9656 Lanward
Dry, Dallas, TX the applicant, once sworn in, presented their reasons for the request and were
available to answer questions of the Board.
Chair Dyche asked if there were those in the audience who wished to speak in support of the
