Agenda Item No. 1 — Call to Order: Vice Chair Smietana called the meeting to order at 6:30
p.m.
Vice Chair Smietana announced that the Board would be going into Executive Session
—pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Section 551.071, to
seek legal advice from the City Attorney. The Board adjourned to Executive Session at 6:30 —
p.m.
Vice Chair Smietana reconvened the meeting at 6:55 p.m. and asked if there was any action
needed following the Executive Session. No action was necessary on items discussed in
Executive Session.
Agenda Item No. 2 — Approval of the Minutes: Vice Chair Mike Smietana opened the
discussion of the minutes of the Zoning Board of Adjustment meeting held on August 27, 2015.
A motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on
August 27, 2015.

Agenda Item No. 3 — Administrative Comments: Richard Schell, Principal Planner,
announced the next regularly scheduled ZBA meeting will be held on October 15, 2015.

Agenda Item No. 4— ZBA-696, Variance to Ordinance No. 480, Section 11.5(c) requiring a
side yard setback of not less than twenty (20)feet on property described as Lot 12R, Block 3, ,
Harbor Oaks, an addition to the City of Southlake, Tarrant County, Texas and located at 2890
Harbor Refuge, Southlake, Texas. Current Zoning: "SF-1A"—Single Family Residential District.
Planner Schell presented details of the case to the Board, explaining the request for approval of
a Variance to Ordinance No. 480, Section 11.5(c) requiring a side yard setback of not less than
twenty (20) feet to allow a side yard setback of approximately thirteen (13) feet on the north
property line for a carport and a side yard setback of approximately sixteen (16) feet on the
south property line for a barn on existing foundations that were poured in 1985. The zoning on
the property in 1985 when the foundations were poured was "A-3" Single Family Residential
District, which required a side yard setback of 15'. The applicant has also submitted deed
restrictions for the Harbor Oaks subdivision dated June 4, 1980 that require a minimum side
setback of 15'. The dimensions of both fouhdations are roughly 20' x 30'. The applicant has not
prepared elevations of the proposed carport and barn, but he will meet all requirements for
accessory buildings and structures in the "SF-1A" zoning district with the exception of the side
yard setbacks.
Vice Chair Smietana opened the public hearing and called upon the applicant or the applicant's
representative to make such comments and present evidence as the applicant should desire.
WT Capps Jr., 2890 Harbor Refuge, Southlake, TX, the applicant and owner of the property,
once sworn in, presented testimony and was available to answer questions of the Board.
Once the applicant completed his presentation, Vice Chair Smietana asked if there were those
in the audience who wished to speak in favor of the request.
There being no one, Vice Chair Smietana asked if there were those in the audience who wished
to speak in opposition of the request.
There being no one, Vice Chair Smietana closed the public hearing and opened the item for
discussion.

yard setback of not less than fifteen (15)feet on property described as Lot 4R, Block 1,
SUMMERPLACE ADDITION, an addition to the City of Southlake, Tarrant County, Texas and
located at 1045 Summerplace Ln., Southlake, Texas. Current Zoning: "SF-20B" —Single Family
Residential District.

Planner Schell presented details of the case to the Board, explaining the request for a Variance
to Ordinance No. 480, Section 14.5(c) requiring a side yard setback of not less than fifteen (15)
feet to construct a covered patio addition to the principal residence approximately 7.2' from the
side property line. A survey of the existing home shows a setback on the north side of
approximately 7'2" except for a bump out around a window. The applicant is proposing to
extend an approximately 20' x 30' covered patio from the rear of the existing home in line with
the existing 7'2" setback. Once Planner Schell answered the Board's questions, the staff
presentation was complete.

representative to make such comments and present evidence as the applicant should desire.

once sworn in, presented testimony and was available to answer questions of the Board.
