J. Freshour Survey, Abstract No. 521, Southlake, Tarrant County, Texas and located at 800 Lodestar Dr., Southlake, Texas. Current Zoning: "AG" Agricultural District. SPIN Neighborhood # 11. REQUEST DETAILS: The applicant is requesting approval of a Specific Use Permit (SUP) for equestrian riding stables to allow an approximately 96’ x 200’ arena at 800 Lodestar Dr. The proposed maximum number of riders in the arena at one time is six (6) and the proposed maximum number of cars on the property at one time is eight (8). Ten (10) parking stalls are provided. The original application included a request to allow the installation of three (3) arena lights and the proposed hours of operation were 8:00 a.m. – 8:00 p.m. Sunday through Thursday and 8:00 a.m. – 10:00 p.m. Friday and Saturday. The applicant has withdrawn the request for the lights and the proposed hours are now dawn to dusk. The SUP is requested to run through the end of 2023. The Planning and Zoning Commission recommended approval of the item (6-0) at their January 7, 2016 meeting specifically noting that the Specific Use Permit is for a period of three years only. The surrounding property owners in opposition comprise more than 20% of the land area within 200 feet of the subject property. A supermajority vote will be required to approve this item unless the property owners immediately to the west rescind their opposition. ACTION NEEDED: 1. Conduct a public hearing 2. Freshour Survey, Abstract No. 521 LAND USE CATEGORY: Low Density Residential CURRENT ZONING: “AG” – Agricultural District HISTORY: - The property was annexed into the City in 1988 and given the “AG” Agricultural District zoning designation. - “AG” Zoning was approved by City Council on September 19, 1989 with the adoption of Ord. No. 480 and the official zoning map. - The existing home on the property was constructed in 1971 (Source: TAD). Our riders participate in the Dallas Hunter Jumper Scholarship Circuit (DHJSC). The maximum number of boarders at any time would be eight. We do not intend to add signage to the property. Current hours of operation are from dawn to dusk. Riding lessons are provided by Melissa Maitland. Lessons are provided three days a week and the riders are able to ride at their leisure on non-lesson days. The maximum number of riders in the arena at one time would be six. The divider between arena and pasture is 4’ wood stockade. The maximum number of cars at the site at one time would be eight. As shown on the attached plot plan, there are 10 parking stalls. The materials used for parking stalls are a combination of concrete, asphalt and flex base. Traffic would typically come and go after school during the school year and randomly during hours of operation in the summer. The Specific Use Permit is requested through 2023, after the current riders graduate from Carroll High School. WHEREAS, a Specific Use Permit for a temporary construction and/or sales facility has been requested by a person or corporation having a proprietary interest in the property zoned as “AG” Agricultural District; and, WHEREAS, in accordance with the requirements of Section 45.1(17) of the City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. A Specific Use Permit is hereby granted to allow equestrian riding stables on property within the City Of Southlake, Texas, located at 800 Lodestar Road, the location being described as Tracts 3B1 and 3C1, J. J. Freshour Survey, Abstract No. 521, City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
