PUBLIC HEARING Richard Schell, Principal Planner presented Item No. 5, ZA15-097. Skip Blake with Blake Architects, 1202 S White Chapel Blvd. came forward along with Cary Clark, 517 Harmony Lane in Colleyville. Mr. Blake and Mr. Harmony explained the reason for the request. Commissioner Greer asked about the detention pond and what type of agitation mechanism will be put in. Mr. Harmony stated that nothing is planned at this time and has always worked well. Commissioner Greer asked about the roof material and asked if they would be open to galvalume or slate roofing. Mr. Harmony stated that it will be asphalt shingle. Galvalume and slate would not fit the character of the building. Commissioner Greer asked if Mr. Harmony would be willing to put in an agitation system for the pond. Mr. Harmony stated no. He plans to sell the offices to individual owners. Commissioner Smith asked in that scenario, who would be responsible for the pond? Mr. Blake stated that an agreement would be put in place with the owners to maintain the pond. Dennis Killough stated that this application is a zoning change and concept plan which changes up the zoning and permitted uses, which requires site plan approval of each site as they come in. Planning and Zoning Commission Meeting Minutes—November 5, 2015 Page 3 of 12 Commissioner Greer clarified that even with tonight's approval, each site plan must come in for approval including roof material and elevations. Commissioner Smith clarified that now is the time to put items for the concept plan in place such as a water feature for the detention pond. Dennis Killough agreed. Mr. Harmony asked if this was a requirement of S-P-2 zoning. Dennis Killough stated it could be. Mr. Blake clarified that specifics can be made part of the motion. Dennis Killough stated yes. Chairman Parrish stated that this allows the Commission to have some insurance that when this comes back before the Commission as a site plan, the Commission has some ideas of how the site plan is supposed to look like. Mr. Harmony agreed. Commissioner Springer stated that there needs to be some documentation that the detention pond will be able to handle the run off. Commissioner Smith added that the documentation needed was one of the comments from engineering. Mr. Blake agreed. Dennis Killough added that engineering is asking the applicant to re-verify that the detention pond can handle the run off. Chairman Parrish gave Mr. Blake some options including to table this item in order to bring back what the Commission is asking for. Chairman Parrish opened and closed the public hearing. PUBLIC HEARING Richard Schell, Principal Planner presented Item No. 6, CP15-002 and Item No. 7, ZA15-105 together. Alex Ayala, Civil Engineer explained the existing drainage condition for the site. Chairman Parrish asked about how many lots will be affected. Alex Ayala stated a few lots and pointed out specific lots. Commissioner Smith stated concern that this information is important before the Commission can approve this. Alex Ayala continued to talk about traffic and traffic counts. Tracy Shannon Kilmer, 5225 Village Creek Drive in Plano came forward with a presentation showing lot size and open space and the development concept plan. Tim Martin, 5225 Village Creek Drive in Plano came forward to present drainage. Rob Paul with Toll Brothers, 2557 SW Grapevine Pkwy, Grapevine, came forward to talk about Toll Brothers product. Chairman Parrish opened the public hearing and read aloud the comment cards. Comment cards: 1) Ernest Brashhear, 1410 Stone Lakes Drive. Does not wish to speak but is in both support and opposition of this development. Additional comment on his card reads; concerns regarding water run-off and impact to the lake in Stone Lakes Subdivision. Excessive silt and debris into lake; 2) Becky Stiefel, 310 Blanco Circle; 3) Anne & Jack Miritello, 310 Blanco Circle; 4) Kyle Norman, 320 Blanco Circle; 5) Cindy Roosma, 314 Blanco Circle; 6) Jean & Larry Flynn, 304 Sterling Court. Merrill Stacy, 320 N Shady Oaks Drive. Does not wish to speak but is in support. Saiyed Zia, 305 Sterling Court. Does not wish to speak and is currently undecided. James Keonghan, 501 Stratford Drive came forward. Mr. Keonghan expressed concern about the drainage into the catch basin and erosion concerns with the watershed. Ms. Lord is concerned about the builder and would prefer to see a more custom builder development the property. Erthel Mincey, 1412 Stone Lakes Drive came forward. Mr. Mincey likes the builder, Toll Brothers, however Mr. Mincey is concerned about the creek to the southwest. Another concern is the traffic along Southlake Boulevard. Randy Stacy, 300 Shady Oaks Drive came forward. Mr. Stacy expressed his support for the development. Frances Scharle, 302 Timberlake Drive came forward. Ms. Scharle is concerned about traffic and drainage. High density is a concern as well. Donna Stengle, 318 Blanco Circle came forward. The density is too high and house size is too large which triggers the traffic and drainage concerns. Lynda West, 306 Sterling Court came forward. Ms. West has some of the same concerns as her neighbors. Rhonda Highberger, 310 Shady Oaks Drive came forward. Ms. Highberger expressed her support for the project. Rick Stacy, 1000 Southlake Boulevard came forward. Mr. Stacy expressed his support for the project. Eric Stengle, 318 Blanco Circle came forward. Mr. Stengle doesn't like the density and believes it will impact the drainage and traffic. Chairman Parrish closed the public hearing. Mr. Paul and Tracy Shannon Kilmer the applicant came forward to address some of the concerns. Commissioner Greer asked about the entrance and exit on Southlake Boulevard. Ms. Kilmer stated that two points of access are needed for emergencies and traffic flow. However, we have looked at aligning with The Marq, but would need a minimum distance required between those driveway spacing's as well as emergency access so that responders can get there. Commissioner Greer asked if that was viable. Ms. Kilmer stated that it has been looked at but another concern that comes into play is double frontage lots. Commissioner Greer stated that the entrance and exit onto Southlake Blvd. is a large concern for the neighbors. Ms. Kilmer stated that the traffic study doesn't believe a light is necessary there and TxDot approval would require appropriate spacing requirements between the Planning and Zoning Commission Meeting Minutes—November 5, 2015 Page 6 of 12 intersection of Southlake Blvd. and Shady Oaks Drive but also further to the west with the existing lights along Southlake Blvd. Commissioner Greer asked about using a custom home builder. Ms. Kilmer believes Toll Brothers is the best fit for the development. Chairman Parrish has reservations regarding having a tract home builder for this development. It is not uncommon to have a design guideline. Mr. Paul stated that Toll Brothers could duplicate the Shady Oaks subdivision. Commissioner Greer agreed with Chairman Parrish. Commissioner Smith stated that she would like to see a full drainage study before this moves forward. Also, there are lots that are possibly unbuildable. This Commission is being asked to make a decision based on probability. Commissioner Smith continued to state that she would like to see something more concrete and exact. Chairman Parrish agrees with Commissioner Smith and stated that this affects the density of the development. Commission Springer stated that the drive does not need to be on Southlake Blvd., however, if it is, it needs to be right only exit. Commissioner Smith asked that a new traffic study be done to reflect longer hours because traffic on Southlake Blvd. is continuously busy. Alex Ayala explained the current study but agreed to increase the hours to give a broader volume. Tom Peterson with DeShazo, 400 S Houston Street, Dallas came forward to explain the traffic study. Commissioner Smith expressed concern about the traffic due to the median u-turns and that a right only will be needed. Chairman Parrish asked the applicant to come forward and asked Mr. Paul to decrease the lot coverage. Mr. Paul stated yes. Chairman Parrish gave a list of items that need to be improved on and suggested that the applicant table. The Commission collectively commented on the items listed. Mr. Paul asked to be tabled. Mr. Saracay asked if there was an ordinance in place regarding the installation of solar panels. Dennis Killough stated yes both residential and commercial. Commissioner Springer expressed that he didn't like the panels on the front. Mr. Saracay explained that the panels will be hidden by the trees and in his opinion, not an eyesore. Commissioner Springer expressed concern that this would open the door for more approvals. Chairman Parrish opened the public hearing. Dove Rd., Southlake, Texas. Current Zoning: "SF-1A" Single Family Residential District. SPIN Neighborhood # 4. PUBLIC HEARING Richard Schell, Principal Planner presented Item No. 10, ZA15-116. Rich DeOtte, 112 Keystone, Southlake came forward. Mr. DeOtte gave a separate presentation. Commissioner Greer stated he would feel more comfortable knowing what the gate would look like. Mr. DeOtte asked about permitting. Dennis Killough stated that a permit would be required and what those requirements were. Mr. DeOtte stated that he would have a rendering for Council. Chairman Parrish asked if Mr. DeOtte is willing to not have a gate. Commissioner Greer asked Mr. DeOtte to explain why he is requesting a gate. Mr. DeOtte stated that it gives a more custom fit to the neighborhood. Commissioner Smith stated that normally she doesn't like a gate but on Dove Road she believes it is a safety issue, specifically traffic. Commissioner Greer believes that the high end custom feeling can still be achieved without a gate. Chairman Parrish opened the public hearing. Paul Wagner, 1480 N Kimball Avenue, Southlake came forward. Mr. Wagner asked about the fence along the property line and the drainage. Chairman Parrish closed the public hearing. Mr. DeOtte explained the drainage for the property and how it will run. In regards to Planning and Zoning Commission Meeting Minutes—November 5, 2015 Page 10 of 12 fencing, Mr. DeOtte stated he hadn't really thought about it or planned for anything special. However, he is willing to put in what the City requires that meets City standards. Chairman Parrish asked if Mr. DeOtte is willing to give up the gate. Mr. DeOtte stated that he didn't want to give up the gate. Commissioner Smith asked Mr. DeOtte to work with Mr. Wagner about the fencing along the property line. Commissioner Greer asked what discretion the Commission has when approving the fence and the gate without seeing the material and/or elevations. Dennis Killough explained that the developer and builder will have to meet City and building standards. Motion to approve ZA15-116, subject to the staff report dated October 30, 2015 and Plat Review Summary No. 2, dated October 30, 2015, specifically approving the variance to Section 5.02 to allow a 40' right of way and a variance to Section 5.03, increasing the allowable deviation of a street intersecting with an arterial from 10 degrees to 25 degrees and the variance to Section 5.04 permitting the proposed street to be a private street, subject to the applicant bringing a full design of the gate and entryway to City Council and also recognizing the applicant's willingness to work with the neighbors to the east regarding a fence received a tie vote (2-2).
