CITY OF SOUTHLAKE Department of Planning & Development Services STAFF REPORT November 10, 2015 CASE NO: ZA15-125 PROJECT: Shops of Southlake— Holiday Promotion Event EXECUTIVE SUMMARY: Shops of Southlake is requesting approval of a Specific Use Permit to allow Outdoor Sales or Services at the Shops of Southlake on property described as Lots 1, 3 and 5, Block 1, The Shops of Southlake, an addition to the City of Southlake, Tarrant County, Texas and located at 1201, 1425 and 1451 E. Southlake Boulevard, Southlake, Texas. SPIN Neighborhood # 8. REQUEST DETAILS: Cencor Realty and the Shops of Southlake is requesting approval of a specific use permit to allow outdoor sales or services. The purpose of this request is to gain approval to hold a two-day holiday promotion and charity event. Shops of Southlake proposes to allow shops to promote a relevant charity of their choice by encouraging public shoppers with storefront displays, raffles or contests to purchase items in-store with a percentage of sales ending as donation to charity. All displays would be tied to the holiday season of giving. The details of the event are as follows: • Friday and Saturday, December 111h & 12th, 2015 • 12PM — 7 PM • Eighteen (18) participating stores • Six (6) off-site signs (11" x 17") /two (2) banner type ground signs (3' x 5') The participating shops will be set up directly in front of their store or in the nearest fitting sidewalk location with stand-alone displays or a small table. The main objective is to create a festive and inviting environment for holiday shopping while advertising the holiday spirit of giving in the community. On November 5, 2015, the Planning & Zoning Commission unanimously recommended approval as presented and subject to the staff report. ACTION NEEDED: 1. Conduct a public hearing 2. October 2, 2012; City Council approved a specific use permit for a development wide "Fall Sales Event" for a three-year period, limited to the tenants of the Shops of Southlake only. (ZA12-079) This event ultimately never took place. December 2, 2014; City Council approved a specific use permit for Fans United grand opening tailgate one-day event. (ZA14-137) COMMUNITY INVOLVEMENT: Due to time constraints, the applicant did not request a SPIN meeting. PLANNING & ZONING COMMISSION ACTION: November 5, 2015; Approved (4-0) subject to the staff report dated October 30, 2015. STAFF COMMENTS: Due to the limited scope of this request no plan review summary is provided. The applicant has been advised of the requirements for maintaining handicapped access. The applicant has also been advised that off-site signage cannot be located within the public right of way. There are no street or driveway closures associated with this event. SOUTHLAKE BOULEVARD, SOUTHLAKE, TEXAS, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. A Specific Use Permit is hereby granted to allow outdoor sales or services, on property within the City Of Southlake, Texas, located at 1201, 1425, and 1451 East Southlake Boulevard, location being described as Lots 1, 3 and 5, Block 1, The Shops of Southlake, an addition to the City of Southlake, Tarrant County, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
