CITY OF SOUTHLAI<,-E Department of Planning & Development Services STAFF REPORT November 10, 2015 CASE NO: ZA15-109 PROJECT: Specific Use Permit for the Eden Residence Residential Solar Energy System EXECUTIVE SUMMARY: Alejandro Saracay of Solar City, on behalf of the owner, Bill Eden, is requesting approval of a Specific Use Permit for a Residential Solar Energy System located at 402 Southridge Lakes Parkway on approximately .50 acres. SPIN #6 DETAILS: The owner, Bill Eden, is requesting approval for a Solar Energy System consisting of 35 solar energy panels totaling 612.5 square feet and located on three (3) roof areas primarily oriented south. The rear roof consists of 6 solar energy panels (approximately 105 square feet), the upper side south roof consists of 8 panels (approximately 140 square feet) and the lower side south roof consists of 21 solar energy panels (approximately 367.5 square feet). The overall depth of the solar panel unit is approximately 5.57-inches and meets the 6-inch maximum depth requirement. Each solar panel will have an output of.255 watts of power(4 panels will produce 1 KW of production) with a system size of 8.925 KW for the total 35 panels. The monthly energy produced by the system is 968 KWh (kilowatt hour). The annual energy produces is 11, 619 KWh. With climate conditions and climate coverage,the 35/4 panels will produce an estimated 8.75 KW. SOUTHLAKE 2030 PLAN In the Sustainability Master Plan, adopted by City Council on February 17, 2015, identifies that Energy Resources should encompass energy efficiency, energy conservation and alternative energy resources. In Priority Tier 1 - ER1, the recommendation/policy promotes energy provider efficiency programs to the residents and businesses. In Priority Tier 2 - ER3, the recommendation/policy identifies policies that encourage private investment in the alternative energy technologies within the City and to consider modifications to existing policies if needed, and /or adopted new policies. TRANSPORTATION ASSESSMENT: This request does not affect traffic on or around the property. TREE PRESERVATION: The proposed solar panels are to be installed on the roof of the existing home; no trees will be affected by the request. PLANNING AND ZONING COMMISSION: November 5, 2015; Approved (3-1) subject to the Staff Report dated October 30, 2015. STAFF COMMENTS: Due to the limited nature and scope of the request, no review has been provided. Note: A specific use permit shall automatically expire if a building permit is not issued and construction begun within six (6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months. Key points: 1. Since when does the City of Southlake trip over themselves listening to a sales pitch from a company like Solar City and then subsequently approve the first solar implementation in our subdivision? 2. The applicant lied when they stated the HOA had approved their plan.The applicant filed a fraudulent and misleading plan to the HOA and that came to light when we did a contrast and compare of what the submitted to the city versus what the HOA has on file.As of today, I was told by our HOA President that the homeowners approval is formally being rescinded since it did not show a panel covering the south side rood of the applicants home.Our guidelines would require that panel to be installed on the rear of the home or in the yard (ground implementation)and where this homeowner has a plenty of yard available for the subject third panel. 3. Our covenants do not allow satellite dishes to be mounted on roofs in view from the street. Thus,solar panels are treated the same. 4. Solar City conducted a classic bait and switch on behalf of the homeowner with false presentation of facts,our HOA covenants and their application to the HOA. 4. It would appear Solar City is actually the owner of the system being installed based on the business arrangement they have with the homeowner and I would believe that sets a very terrible precedent for our subdivision and Southlake as a whole. 5.
