PUBLICATION IN THE OFFICIAL NEWSPAPER; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule City acting under its
Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City
has the authority to adopt a comprehensive zoning ordinance and map regulating the
location and use of buildings, other structures and land for business, industrial,
residential and other purposes, and to amend said ordinance and map for the purpose
of promoting the public health, safety, morals and general welfare, all in accordance

with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as "S -P-2"
Generalized Site Plan Zoning District under the City's Comprehensive Zoning
Ordinance; and,
WHEREAS, a change in the zoning classification of said property was requested
by a person or corporation having a proprietary interest in said property; and,
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination
as to whether these changes should be granted or denied: safety of the motoring public
and the pedestrians using the facilities in the area immediately surrounding the sites;
safety from fire hazards and damages; noise producing elements and glare of the
vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting and types of signs and relation of signs to traffic control
and adjacent property; street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate
neighborhood; adequacy of parking as determined by requirements of this ordinance for
off-street parking facilities; location of ingress and egress points for parking and off-
street loading spaces, and protection of public health by surfacing on all parking areas
to control dust; effect on the promotion of health and the general welfare; effect on light
and air; effect on the over -crowding of the land; effect on the concentration of
population, and effect on transportation, water, sewerage, schools, parks and other
public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered

among other things the character of the districts and their peculiar suitability for
particular uses and the view to conserve the value of the buildings, and encourage the
most appropriate use of the land throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there
is a public necessity for the zoning changes, that the public demands them, that the
public interest clearly requires the amendments, and that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference
to the classification which existed at the time their original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the
changes in zoning lessen the congestion in the streets, helps secure safety from fire,
panic, and other dangers, promotes the health and the general welfare, provides
adequate Tight and air, prevents the over -crowding of land, avoids undue concentration
of population, and facilitates the adequate provision of transportation, water, sewerage,
schools, parks and other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that
there is a necessity and need for the changes in zoning and has also found and
determined that there has been a change in the conditions of the property surrounding
and in close proximity to the tract or tracts of land requested for a change since the tract
or tracts of land were originally classified and therefore feels that the respective
changes in zoning classification for the tract or tracts of land are needed, are called for,
and are in the best interest of the public at large, the citizens of the city of Southlake,
Texas, and helps promote the general health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

OF SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of
Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted
and amended, is hereby amended so that the permitted uses in the hereinafter
described areas be altered, changed and amended as shown and described below:
Being described as Lot 4, Block 1, Pecan Creek Addition, Southlake,
Tarrant County, Texas, being approximately 2.25 acres, and more fully
and completely described in Exhibit "A" from "S -P-2" Generalized Site
Plan Zoning District, to "S -P-2" Generalized Site Plan Zoning District as
depicted on the approved Concept Plan attached hereto and incorporated
herein as Exhibit "B," and subject to the following conditions:

Written Narrative
The scope of work for this project proposes (4) individual lots. Lot One is defined as an Open
Space Lot and contains an existing drainage and detention pond. This retention pond will contain
a Scott Aerator DA -20 and North Star 3HP display aerator fountain with floating platform, self
contained pump assembly and wire basket (or equal). Lots 2,3 and 4 of the proposed Lots are
Pad Sites for one-story Office Buildings. The Development works as One Master Plan with over
50% landscape for the entire Development and ten foot bufferyards around all four sides. These
buildings are to be operated during typical office hours. An Open Space Management Plan
would require that all Three Lots with buildings be responsible for maintenance of the Drainage
Areas, Landscaping and shared Parking and Drives. All three buildings can be built at one time
or at three different times with different owners. These buildings shall be built on engineered
concrete foundation, wood framed with a masonry veneer.
S -P-2 Regulations:
All uses and regulations shall be based upon 0-1 Zoning regulations with the following
exceptions:
a. Side Setbacks: 5' on the east side of Lot 2, all other side setbacks shall be 15'.
b. Front Setback: 30'.
c. Rear Setback: 15'.
d. Bufferyards are not required along interior property lines.
e. Front Bufferyard shall be a Type "Q" 15 feet. ( This increases the required
amount of landscaping per 100 feet from 1 to 2 Canopy Trees, from 2 to 3 Accent
Trees, and from 8 shrubs to 10 shrubs.)

f. Impervious coverage will not be met on a single lot basis but will met by the
development of the 4 lots as a whole.
g. Parking is based upon 1 space per 300 square feet of General Office Buildings
and 1 space per 150 square feet of Medical Office Building. (In order for Medical
Office use to occur the Building size would be reduced to meet the parking ratio
available at the 1 parking space allowed to 150 square feet of building.)

Open Space Management Plan / Property Owner's Agreement
(Note: This Agreement must be made a Document signed and Notorized by each
Property Owner as they purchase said Lot or Property so as to legally bind them to
the following Agreement as a condition of their purchase and Title of said Property)
Owner's of Lots 2, 3 and 4 shall each Deposit $350.00 per month to a General
Maintenance Fund that is to be maintained by vote of one of the three Property
Owner's. Such Owner shall inform the City of Southlake Planning Department of
their responsibility as to the maintenance of this four Lot Development.
Funds shall be maintained in a separate Bank Account and shall be used for the
following:
1. Mowing and maintenance of all property on Lotsl, 2, 3 and 4. (Trash pick-
up, etc.)
2. Repair of any "potholes" fading paint striping, broken curbs, etc. in the
entire parking lot that is shared by all.
3. Removal of any sediment, etc. that inhibits the proper function of the
Detention area.
Once said General Fund reaches a maximum gross Bank Account balance of
$15,000.00 collection of monthly payment to the fund shall cease for each Property
Owner until such time as the fund drops below $5,000.00. Each Property Owner
shall be copied a monthly Bank Statement on the account and a record of expenses
incurred and drawn from the account.
Note: In the event that the party responsible for maintenance of the open space and
parking lot and drives fails to maintain all or any portion in reasonable order and
condition, the City of Southlake may enter the premises and take corrective action,
including the provision of extended maintenance. The costs of such maintenance

may be charged to the Owner's that make up the three Lot Ownership and may
include administrative costs and penalties. Such costs shall become a lien on all
three Owner's properties.

Non-inclusion of this Document as a part of Title at Closing to said Property shall
restrict the Property Owner to being unable to apply to the City of Southlake for
any future Development and Approval of such Development by the City of
Southlake.
City Council motion at 1st reading:
December 1, 2015; approved (7-0) subject to the staff report dated
November 23, 2015, and Concept Plan Review Summary No. 3 dated
November 13, 2015, granting the following variance - that lot lines as
shown in the packet materials are approved in order to provide parking on
a lot by lot basis and noting approval of the S -P-2 regulations and building
concepts as presented, also noting the applicant's agreement to fully
complete the main circular drive and the corresponding landscaping
during the initial construction phase, noting that Council expects the
architectural style demonstrated in tonight's photos to be consistent with

following:
• Granting the following variance request: Subdivision Ordinance No. 483,
as amended, Section 8.01(D) requires that all side lot lines be
perpendicular to the right of way lines.
• Subject to the conditions of approval in the 1st reading addressing the
completion of the entire circular drive and corresponding landscaping prior
to the issuance of the first building permit on the initial office building;

• The architectural style for the future building site plans will be consistent
with the photos as part of staff's presentation;
• The property owners or the designated property owner's association is
responsible for pond maintenance;
• All HVAC and electrical equipment will be installed on the south side of the

certificate of occupancy on the initial constructed building.
• Accepting the revised SP -2 regulations as noted in a letter dated January
11, 2015 and located in Staff Report as Attachment C, Page 1, specifically

not in front of the building and the dumpster will be permitted to be located

• Noting any retaining walls on site will consist of a brick or stone masonry
material that matches the building materials.

• Accepting the revised concept plan represented this evening and located
on Attachment C, Page 6 of the Staff Report.
• Finally, noting the acceptance of the landscape plan represented this
evening and located on Attachment C, Page 6 of the Staff Report
specifically noting that all trees and landscaping shown along Rucker
Road (north of the internal drive) including those trees represented on the
open space lot will be installed prior to the issuance of the first building
permit on the initial office building. Landscape indicated to be internal to
the lot (south of the internal drive) can be installed at the time of building
construction.
• Accepting applicant's agreement to replace the two bald cypress in the
bufferyard in front of the building with live oaks.
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the
City of Southlake, Texas, to reflect the herein.changes in zoning.

SECTION 3.
That in all other. respects the use of the tract or tracts of land herein above
described shall be subject to all the applicable regulations contained in said Zoning
Ordinance and all other applicable and pertinent ordinances for the City of Southlake,
Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and
definitions of said Zoning Ordinance are not amended hereby, but remain intact and are
hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made
in accordance with the comprehensive plan for the purpose of promoting the health,
safety, morals and the general welfare of the community. They have been designed,
with respect to both present conditions and the conditions reasonably anticipated to
exist in the foreseeable future; to lessen congestion in the streets; to provide adequate
light and air; to prevent over -crowding of land; to avoid undue concentration of
population; and to facilitate the adequate provision of transportation, water, sewerage,
drainage and surface water, parks and other commercial needs and development of the
community. They have been made after a full and complete hearing with reasonable
consideration among other things of the character of the district and its peculiar
suitability for the particular uses and with a view of conserving the value of buildings and
encouraging the most appropriate use of land throughout the community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of
Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said
Ordinance No. 480-706 Page 10
ordinances except in those instances where provisions of those ordinances are in direct
conflict with the provisions of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable
and that if the validity of the zoning affecting any portion of the tract or tracts of land
described herein shall be declared to be invalid, the same shall not affect the validity of
the zoning of the balance of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses
to comply with or who resists the enforcement of any of the provisions of this ordinance
shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each
day that a violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any
and all violations of the provisions of Ordinance No. 480, as amended, or any other
ordinances affecting zoning which have accrued at the time of the effective date of this
ordinance; and, as to such accrued violations and all pending litigation, both civil and
criminal, whether pending in court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance in its entirety on the City website together with a notice setting out the time and place
for a public hearing thereon at least ten (10) days before the second reading of this ordinance,
and it this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation

of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.

Assembly, Instructions
1. Remove the two stainless steel bolts from the float. Fig. 1
2. Place pump assembly on end. propeller side faarg up. Slip the goat platform, with the Scott Aerator name and phone
number facing up, over the pump assembly, aligning Me two holes on the float platform to the pre -drilled holes on the
pump assembly. Use the pro -drilled holes to fasten the float platform to the pump assembly, using the two stainless-
steel bolts.
3. Turn the pump and float assembly over and place on Its opposite end. Remove and discard the protective packaging
and secure the stainless-steel filter basket by aligning the three filter hetes to the pre -drilled holes on the pump
assembly and securing with the enclosed self -tapping screws. Fig. 3
4. Secure a 318' or thicker nylon anchoring line (not provider!) to each of the two attached eyebolts. Fig. 2 Make sure lines
are long enough to extend outwards, 25 feet apart at a 45' angle to the pond or lake bottom.
5. At this point, your Display Aerator can be floated into position In your pond or lake. Once a suitable location is
determined, simply attach a boat anchor concrete block, or similar weighted item to each of the two nylon lines (refer
to Fig. 5 for minimum anchor weight far your size aerator). Once attached, place the anchors at the bottom of the pond
spaced a minimum of twenty -Ave feet apart.
6. The final step s to supply electric power to your Display Aerator, taking extra caution to ways use a ground fault
circuit Interrupter and a licensed electrical contrector. See Fig. 6 for guidelines on supplying power.

Maintaining your DA -20 Display Aerator
Most of our products require very Thule to any maintenance. Under normal operating conditions, you should enjoy many
years of trouble free service from the unit. As a rule of thumb, the propeller assembly on our aerator fountains should
be changed every five years. This is a simple procedure that can be done tom -Uta. Refer to Fig, 4 ler replacement parts.
Anchonng ropes, depending on type, will deteriorate over time. These loo should be replaced every five years If quality
nylon rope (3/5' or thicker) is utilized. When the unit Is removed from the water for the propeller and rope switch, It would
be a good opportunity to wash the unit down with high peso. water. Once the unit 1s clean, a visual Inspection of the
entire aerator Is recommended to be certain nothing is restricting water low.
