Item 6E Ordinance 735-A, 2nd Reading, Amending the Bicycle Helmet Ordinance Item 6E Hello Madam Mayor and Members of the City Council. The City’s current bicycle helmet ordinance was adopted in 1999. In order to increase the safety of any child riding a bicycle, the ordinance will be updated to require any child under the age of 18 to wear a helmet while operating a bicycle. The ordinance also covers children riding in a sidecar, trailer, child carrier, seat, or any other device attached to a bicycle. Within the ordinance, it will be presumed that any parent of a child under 18 that is not wearing a helmet has allowed the child to ride without one. This exists in the current ordinance, and assists with establishing parental responsibility. 3 Ordinance 735-A Penalty changed to coincide with existing City Code The phrase “Director of Public Safety” has been changed to “Chief of Police” A section has been added that references the equipment required on a bicycle by state law The penalty for a violation of the original ordinance was specifically limited to dollar amounts of $25 for the first offense, and $50 for the second offense. The penalty in the revised ordinance will coincide with other City Code, which is a fine up to $500. In the event of a citation, this allows the Municipal Court Judge to exercise discretion in her assessment of the penalty. The phrase “Director of Public Safety” has also been changed in the ordinance revision since that position no longer exists. It will be replaced with the phrase “Chief of Police”. A section has also been added that references the equipment that is required on a bicycle by existing state law. This includes reflectors, and the use of lights after dark. The Southlake Police Department will approach the enforcement of this ordinance through a dedicated communication and education campaign in order to keep our children as safe as possible. 4 Staff Recommendation Approve ordinance no. 735A, 2nd reading, amending the City’s current bicycle helmet ordinance.
