Planning and Zoning Commission Meeting Minutes—October 22, 2015 Page 2 of 9 Dillion Tarr, Development Director for Mainstreet, 14329 Clay Terrace Blvd., Carmel, IN came forward. Mr. Tarr gave a presentation showing the changes that were requested and gave a brief history of the company. Commissioner Forman asked about the 4.1 Slope and believes that the slope needs to be reevaluated before going to City Council. Mr. Tarr stated that going north the neighbors sit on a hill. Commissioner Forman asked about the stacking depth and if the applicant had received an answer from TxDOT. Mr. Tarr stated that they received approval for the driveway. No turn lanes will be required for the driveway. Commissioner Forman asked if there was another location that would minimize the variance for the stacking depth and if not, why this location. Mr. Tarr stated that there is a window that is 20-ft. east of the east edge and 20-ft. of the west edge that meets TxDOT's spacing requirement for a driveway. Commissioner Kubiak added that is driven by the freeway entrance. Chairman Parrish clarified that whether the driveway is 20-ft. in any direction, the problem would still exist. Mr. Tarr agreed and stated that it has to do with the depth of the lot. Commissioner Kubiak asked about the shrubs and landscaping along the 114 access road and the presentation shows it on the west of the entrance but did not see it on the east entrance. Commissioner Springer is still concerned about the stacking depth. Chairman Parrish opened the public hearing. Helen Clary, 415 Shady Lane and Dan Absher, 410 Shady Lane both are in opposition but do not wish to speak. Jennifer Aufricht, 2810 Rolling Lane, came forward. Ms. Aufricht is concerned about the variances being requested. These ordinances are in place for a reason and the variances being requested impact those ordinances. Landscaping is insufficient for buffering to the neighborhood, traffic will be increased even more, the stacking depth is too much and the development doesn't fit on the lot. David Stanhope, 2530 Greenbough Lane, came forward. Mr. Stanhope echoes Ms. Aufricht concerns. Mr. Stanhope would welcome the development but without any Planning and Zoning Commission Meeting Minutes—October 22, 2015 Page 3 of 9 variances and would like to see more landscaping on the northern boundary. Carol Dowd, 2900 Hillcastle Lane, came forward. Ms. Dowd expressed the same concerns regarding the variances and added that there will be excessive noise, hazardous waste and large trash pick-ups. Kay Absher, 410 Shady Lane, is in opposition but does not wish to speak. Dr. Bonola, 1800 Barrington in Westlake came forward. Mr. Bonola addressed some of the concerns of the neighbors, specifically the stacking depth. In regards to the preservation of the trees; No matter what development goes on this lot, the trees in the middle of the lot will have to be removed. Chairman Parrish closed the public hearing. Chairman Parrish asked for clarification from staff the placement of the driveway. Mr. Tarr came forward to address the concerns. Mr. Tarr stated that the applicant would be willing to delete the center driveway. In regards to the tree canopy, Mr. Tarr stated that the canopy that will be replacing what canopy that is there and will exceed the required 50% canopy that is required to reserve. Commissioner Kubiak discussed and explained the variances that are being requested. Commissioner Kubiak expressed that he liked the plan and believes the applicant put forth a good faith effort to improving the site. Commissioner Ransom expressed his support as well. Commissioner Springer expressed concern about the stacking depth and drive but is in support of the development. Commissioner Forman likes the development but is concerned that it is not a good fit due to the slope. Chairman Parrish stated the approved uses for this zoning. This development is an approved use. Motion to approve, ZA15-072 as presented subject to the Staff Report revised dated October 21, 2015 and subject to the Site Plan Review Summary No. 5 dated October 20, 2015; specifically granting the variances noted in the staff report related to residential adjacency, stacking depth, and tree preservation; however, also noting the Commission's preference that the applicant present a site plan with two alternatives on it, relative to access off SH 114, one version presented tonight in the presentation materials and a separate version that eliminates the westernmost entry point into the site; and specifically noting, if not included in this package tonight and to be shown at Council, a landscape plan that shows a berm along the southern perimeter of the property with evergreen hedges; and noting the applicant's willingness to present a landscape plan showing the Planning and Zoning Commission Meeting Minutes—October 22, 2015 Page 4 of 9 canopy preservation that will take place. Nays: Springer and Forman Abstain: None Approved: 3-2-0 Agenda Item No. 7: ZA15-092, Site Plan for Kimball Highland on property described as Lot 38, Francis Throop No. 1511 Addition, an addition to the City of Southlake, Tarrant County, Texas, located at 1200 N. Kimball Avenue, Southlake, Texas on 3.2 acres. Current Zoning: "B-1" Business Service Park District. SPIN Neighborhood # 4. PUBLIC HEARING Lorrie Fletcher, Planner I, presented Item No. 7, ZA15-092. Commissioner Forman verified that fence variance is on the northeast of the property line and asked how many homes are on the north side. Ms. Fletcher clarified the fence variance location and that there is one home on the north side. Chairman Parrish clarified that the applicant has purchased that lot and asked staff if it was the same zoning. Ms. Fletcher stated that was correct and that the applicant is planning future development on that lot which is zoned residential. John Dancer, 2001 Dancer Drive, Arlington came forward. Mr. Dancer explained his variance requests and believes that the development will help the property flow. Commissioner Forman asked if the parking could be reduced. Mr. Dancer believes that the parking would not flow as well. Chairman Parrish asked what was across Highland. Mr. Dancer stated agricultural. Chairman Parrish asked what happens if the driveway on Highland is removed. Mr. Dancer stated that there would be a hammerhead that dead end. Mr. Dancer continued to state that they reached out to surrounding neighbors. Commissioner Kubiak expressed his concerns about the parking as well and stacking depth. Motion to approve, ZA15-092, subject to the Staff Report dated October 16, 2015 and the Site Plan Review Summary No. 2, dated October 14, 2016 specifically approving the variances requested for driveway on Highland Street, the stacking depth and the fence on the north side; noting the applicant's willingness to evaluate adding parking lot tree islands, to take out a few spaces on the south end that would alleviate the stacking depth issue and evaluating the two parking spaces at the southwest corner that would back into each other. SPIN Neighborhood #8. PUBLIC HEARING Patty Moos, Planner presented Item No. 8, ZA15-093. Skip Blake, 1202 S White Chapel Blvd. came forward. Mr. Blake gave a brief description of the site plan. Commissioner Springer asked what the reason was for the painted brick. Mr. Blake stated it looks cleaner and brighter. Chairman Parrish opened and closed the public hearing. Commissioner Kubiak commented that this site plan compared to other site plans have similar issues such as have a large group of trees in the middle of the lot. PUBLIC HEARING Lorrie Fletcher, Planner I presented Item No. 9, ZA15-104. Jimmy Fector, Adams Engineering, 910 S Kimball Avenue came forward. Commissioner Springer asked about the area in the parking lot and the screening. Mr. Fector stated the reason for this application was due to the items being seen from 1709. Lowe's would like to bring the store up to compliance. Chairman Parrish verified the items that are stored in the area. Commissioner Kubiak added to those items and asked about Home Depot and if there were any specific approvals they have on their site plan. Dennis Killough stated that Home Depot did get specific approval for some items but have had some compliance issues as well. Commissioner Forman asked for clarification that on the south parking lot that will only be intended to be seasonal. Mr. Fector stated that is correct and it will be used for outdoor sales of seasonal products. Commissioner Forman asked how it will be enclosed. Mr. Fector stated it is pretty close on the east side and close to Southlake Blvd., it is completely enclosed with vegetation. Commissioner Forman asked about the actual area that will be used where the parking spaces are. Mr. Fector stated it will not be completely enclosed because Lowe's wants patrons to see the items from the front of the store. Commissioner Forman is concerned about driving into the area. Planning and Zoning Commission Meeting Minutes—October 22, 2015 Page 7 of 9 Commissioner Kubiak clarified that it will remain open and be able to drive into the area specifically for loading. Commissioner Forman clarified that the shopping carts are behind a brick wall and the actual main building. Mr. Fector stated yes. Commissioner Forman asked about what could go under the awning now. Dennis Killough gave a list of items with regulations. Chairman Parrish asked if the area would be for storage or sales items. Mr. Fector stated it would be for sales. Chairman Parrish asked if this was being done elsewhere. Mr. Fector stated in other places yes. Commissioner Forman is concerned about other stores coming in to do the same. Commissioner Kubiak asked about the height of the screening wall. Mr. Fector stated 5-ft. is a good height to screen items but still have some visibility. Commissioner Kubiak is concerned about the aesthetics and that this change goes with the property, not the retailer. Dennis Killough stated that the Commission can put into place a framework indicating material, items and timeframes and dates. It can also be tied to the type of use. Chairman Parrish opened and closed the public hearing. Commissioner Forman is concerned with the changes and is not in favor. Chairman Parrish stated that the applicant should bring in renderings when they move to City Council. Mr. Fector gave a brief description of the rendering with colors. Commissioner Kubiak asked about the items that will be there and what months. Robert Martinez, 4800, Arlington, Lowe's manager, came forward. Mr. Martinez gave a description of items that will be behind the screening wall generally from February to October. Commissioner Forman believes that Lowe's should work within what is already allowed. Motion to approve, ZA15-104 as presented subject to the following: • Staff Report and Site Plan Review Summary No. 2, dated October 16, 2015; • noting the display in the south parking lot will be from February through October only; • a clear definition of the items to be stored will be provided to City Council; • the approval is limited to home improvement retailer on this site; • the applicant will provide a storefront rendering to City Council; • and, the south parking lot seasonal storage items will be limited to landscape items such as mulch, compost, etc. — No swing sets.
