Planning and Zoning Commission Meeting Minutes — August 20, 2015 Page 1 of 11 Dennis Killough announced the up and coming Town Hall Forum regarding development. The purpose of this meeting is to engage the community in a discussion regarding the development process of Southlake and the engagement of the economic development of Southlake. The forum is schedule for September 29, 2015. Current Zoning: "I-1" Light Industrial District. SPIN Neighborhood #8. PUBLIC HEARING Planner I, Patty Moos presented Item No. 5, ZA15-034. Kathy Zilbilich, 8150 N Central Expressway #1475, Dallas gave a separate presentation. Chairman Parrish asked where the existing towers were. Ms. Zilbilich was not able to answer. Commissioner Forman asked about the other 8 antennas. Ms. Zilbilich stated those antennas were cancelled. Umar Siddiqui, 14121 Nottinghill Drive, Little Elm, TX came forward to explain the cancellation of the antennas. Commissioner Forman asked what governmental agency decides antenna and tower activity. Why would the agency cancel one and then approve another. Mr. Siddiqui was unable to answer. Chairman Parrish asked about data or information regarding dropped calls and coverage. Mr. Siddiqui explained the graph and map given to the Commission. Commissioner Forman asked the distance of the exiting tower and the proposed tower. Mr. Siddiqui stated 0.4 mile. Commissioner Greer asked about other possible locations. Mr. Siddiqui stated that this was the best site for the tower based on the charts shown. Commissioner Forman asked about optimal coverage versus reliable coverage and continued to ask about data coverage. Mr. Siddiqui explained that this would give reliable coverage with data coverage. Commissioner Forman asked how many platforms will be on this tower. Ms. Zilbilich stated two. Commissioner Forman asked about the difference in height from the original submittal. Ms. Zilbilich stated that the location allows.for a lower height. Commissioner Greer asked about the choice made in regards to a 9 -story mono -pine tower versus a stealth tower. Ms. Zilbilich stated that they would be happy to build either tower that the Commissioner prefers. Commissioner Kubiak asked about the variances and whether or not the applicant was willing to meet the buffer yard portion of the variances. Doug Henderson, 3602 Lake Champlain, Arlington, TX came forward. Mr. Henderson stated that the existing landscape would be more aesthetic than a large masonry wall. That is why the variance is being requested. Commissioner Forman asked Mr. Henderson about the cancellations for the towers and where they are located. Mr. Henderson stated that he did not of their location. Commissioner Forman asked about why the coverage map being presented doesn't match the coverage map that is on the website. Mr. Henderson and Ms. Zilbilich were not able to answer. Chairman Parrish opened the public hearing and read aloud the comment cards. In opposition but does not wish to speak: Brenton Evans, 1137 Tealwood Court; Matt Wilsman, 1604 Ponderosa Way; Patricia R Yeager, 1402 Vino Rosso Court. Stacey Bott, 1604 Ponderosa Way came forward to speak in opposition. Ms. Bott stated that the data and the maps do not match. Planning and Zoning Commission Meeting Minutes August 20, 2015 Page 3 of 11 Ronnie Valdez, 1108 Tealwood Court came forward to speak in opposition. Mr. Valdez believes that all information being provided by the applicant is conflicting and keeps changing. Christopher Ducey, 1128 Tealwood Court came forward to speak in opposition. Mr. Ducey has issues regarding the requested variances. David Wilhite, Engineer hired by the neighborhood to explain the charts. Eric Tang, 1105 Tealwood Court came forward to speak in opposition. The marketing data and the data presented do not match. Mr. Tang continued to state that the variances would set precedence for future towers. Andrew Yeager, 1402 Vino Rosso Court came forward to speak in opposition. Mr. Yeager believes that having these towers so close to one another would decrease the value of his home and his neighbor's homes. Joe Wright, 1640 S Brumlow came forward to speak in opposition. This tower would create a future variance request on his behalf to develop the property. Ms. Zilbilich came forward and stated that this is the best location for the tower and defended their position. Chairman Parrish closed the public hearing. Commissioner Forman expressed that the applicant has not provided sufficient information and data to support this SUP. Commissioner Kubiak agrees with Commissioner Forman and Commissioner Kubiak believes that the applicant did not fully reach out to the surrounding neighborhood. Over a period of time some issues were addressed but not all, especially the variance requests. Commissioner Springer explained that no one would like a tower in their backyard but everyone does want a good signal. However, Mr. Wright's property is the changing point. This affects his property directly. Motion to deny ZA15-034. PUBLIC HEARING Principal Planner, Richard Schell presented Items 6 and 7, ZA15-074 and ZA15-075 together. Commissioner Springer asked about the barn size and what the maximum was. Dennis Killough stated that the maximum is 5 percent of the lot area. Commissioner Kubiak asked about the proposed concept plan specifically lot 19 and would like to confirm that the proposed set back is 275 -ft. Also, on page 2 of the staff report the proposed concept plan is consistent with the future land use plan Mr. Schell stated yes on both. George Hill, 3208 S Main Street, Fort Worth came forward to answer any questions the Commission may have. Commissioner Forman asked about prior layouts and configurations and how this layout came about. Mr. Hill explained the reasoning and believes this is the best use of the property. Commissioner Kubiak asked for confirmation that all homes will not be on septic, that they will be on city sewer. Mr. Hill explained that all homes will have access to city sewer. Commissioner Kubiak stated that lot 21 has septic but will have access to city sewer, lot 20 will be on city sewer and lot 19 will have access to city sewer. Commissioner Kubiak continued to ask Mr. Hill about the Fire Marshall's comments. Mr. Hill stated that the existing public fire hydrant and public water is on the west side of White Chapel Boulevard and the measurement calculation from the fire hydrant and up the driveway is 970 -ft. to the front door of the house and regulation states that the requirement is 1,000 -ft. Mr. Hill continued stated that a public line will run up the access road to the back house and build it fire code standards. The turn around and the hammer head will also be built to accommodate fire. Commissioner Springer asked where the applicant was going to tie into the sewer. Mr. Hill stated it is the manhole on the northeast corner. Planning and Zoning Commission Meeting Minutes August 20, 2015 Page 5 of 11 Commissioner Springer confirmed the city sewer access. Rob Dean, 859 S White Chapel Blvd., Southlake came forward. Mr. Dean mentioned that he had reached out to his future neighbors in order to address their concerns. Chairman Parrish opened the public hearing and read aloud the comment cards. In opposition but did not wish to speak: Ray and Deb McNamara, 110 Highland Oaks Court; Michelle Ziadie, 260 Silverwood Circle; Nicola J and Michael Meditemaneo, 120 Highland Court; Kathleen Colvin, 310 Silverwood Circle. Chairman Parrish closed the public hearing. Mickey Thomas, engineer for the project came forward to explain drainage for the property. Commissioner Kubiak asked if there was a specific area for the detention pond. Mr. Thomas showed where they plan to put the pond. Commissioner Kubiak asked for specific flow. Mr. Thomas stated that water generally flows to the south. Commissioner Forman confirmed that sewer will be hooked up at the time the house is built and is the applicant is willing to stipulate that when the other new homes are built that they will be hooked up to sewer as well. Mr. Thomas stated yes for lot 19 and lot 20. Mr. Dean is unable to answer for lot 21 due to ownership of that lot. Chairman Parrish asked if a formal drainage study had been done. Mr. Thomas stated no. Chairman Parrish asked if a study can be done before this case goes to City Council. Mr. Thomas stated yes. Civil Engineer, Alex Ayala came forward to address the Commission's concerns. Commissioner Kubiak asked about the topography. Ms. Ayala stated that the study will answer that more clearly. Motion to approve ZA15-074, subject to the staff report dated August 14, 2015 specifically approving the variances requested with regard to the residential panhandle lots, the radial lot lines, specifically making the motion subject to Review Summary No. 2 dated August 14, 2015 also conditioning the motion on Planning and Zoning Commission Meeting Minutes —August 20, 2015 Page 6 of 11 the applicants willingness to connect sewer to the new home to be built on Lot 20 and to a new home to be built on Lot 19 after the existing home is razed, and further noting the applicants willingness to contact the owner of the home on Lot 21 prior to the City Council meeting and inquiring on their willingness to connect to sewer and report to City Council and further noting the applicants willingness to provide drainage study information prior to the City Council meeting. Mr. Blankenship stated the fountain will stay but the circulation is being re-routed. PUBLIC HEARING Principal Planner, Richard Schell presented Item No. 12, Ordinance No. 480-TTTT. Commissioner Greer asked about the chargers and what the time limit is on them and how long it takes to charge. Mr. Killough stated that staff will have to get back with the Commission on that answer. Commissioner Kubiak asked if there were any cases pending coming forward in regards to this. Mr. Killough stated no but is in line with the 2030 Plan. Chairman Parrish opened the public hearing. Rick Bollar, 551 E Dove Rd. came forward. Mr. Bollar supports this update to the ordinance.
