Item 4O Department of Planning & Development Services S T A F F R E P O R T July 27, 2015 CASE NO: ZA14-072 PROJECT: Variance to Plat Expiration for Union Church Estates Final Plat EXECUTIVE SUMMARY: Montage Development is requesting approval of a Variance to Subdivision Ordinance No. 483, Section 4.01(I), as amended, regarding plat expiration, requesting to extend the validity of case ZA14-072, Final Plat for Union Church Estates on property described as Tracts 6B2 and 6B2A, Jesse G. Allen Survey, Abstract No. 18, City of Southlake, Tarrant County, Texas, and located at 2535 and 2565 Union Church Rd., Southlake, Texas. The current zoning is “SF-1A” Single Family Residential District and “SF-2” Single Family Residential District. SPIN Neighborhood #11. REQUEST DETAILS: The applicant is requesting approval of a Variance to the Subdivision Ordinance No. 483, Section 4.01(I) (Plat Expiration), as amended, and is requesting that the validity of Case No. ZA14-072, Final Plat for Union Church Estates, be extended for an additional 60 days to September 17, 2015. Section 4.01(I) states that a Final Plat which has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Final Plat was approved by the Planning & Zoning Commission on July 17, 2014. Final plats for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This ensures that street right-of-ways and easements are correctly shown based on as-built conditions and also ensures that all the new lots of record are properly served by streets and utilities. The Final Plat for this development has not been recorded due to ongoing construction of utilities and streets and has thus expired. The plat will be recorded within the next 60 days. The applicant is requesting an extension of 60 days. If approved, the new expiration date for the Final Plat for Union Church Estates would be September 17, 2015. HISTORY: -The property was annexed into the City in 1988 and given the “AG” Agricultural zoning designation. - The existing home on 2535 Union Church Rd. was built in 1965 (Source:TAD). - A Zoning Change and Concept Plan (ZA13-046) for Union Church Estates from “AG” Agricultural to “SF-1A” Single Family Residential District and “SF-2” Single Family Residential District was approved October 15, 2013. - A Preliminary Plat (ZA13-087) for Lots 1-3, Block 1, Union Church Estates was approved October 15, 2013. - A Final Plat (ZA14-072) for Lots 1-3, Block 1, Union Church Estates was approved July 17, 2014.
