08212000 hlternational Residential Code ORDINANCE NO. 821 AN ORDINANCE ADOPTING THE 2000 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE FOR ONE- AND TWO-FAMIL Y DWELLINGS, REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR~ MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL ONE- AND TWO-FAMILY DWELLINGS AND MULTIPLE SINGLE-FAMILY DWELLINGS (TO~VNHOUSES) IN THE CITY OF SOUTHLAKE; PROVIDING FOR THE ADOPTION OF LOCAL AMENDMENTS THERETO; PROVIDING FOR RECORDING OF SUCH CODE AS A PUBLIC RECORD PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake is a home rule city acting under its charter adopted by the electorate pnrsuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City of Southlake deems it necessary to adopt this ordinance providing minimum standards to safeguard the health, property, al~d welfare of the citizens of Southlake by regulating and controlling the use, occupancy, maintenance, repair, design, construction and quality of materials for residential buildings and structures within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEX.4S: SECTION 1 That the International Res~dentml Code for On - and Two-Family Dwellings, 2000 I~dition. published by the h~temational Code Council, including the standards referenced therein, including Appendi× Chapters A, B, C, E. G and H are hereby adopted as the Residential Building ('ode of lhe Cihv of Southlake regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all one- and two-fitmily dwellings, multiple single-family dwellings Itox~ nhouses) and their accessoD' structures in the City of Southlake. True and correct copies of these documents are attached as Exhibit SECTION 2 That the 2000 International Residential Code, as adopted herein, is hereby amended as provided in Exhibil 'B" incorporated herein and attached hereto for all purposes of this ordinance. The Cit3 of Southlake, Texas may from time to time determine that additional local modifications to lhe Building Code are necessary and appropriate to meet the unique needs of the City of Southlake, Tcxas. To effectuate these local modifications, the City Council shall enact individual ordinances amending this Ordinance, fully setting forth the change to be made in the Residential Building Code. These amendments shall be consolidated as Exhibit "B" to this Ordinance. SECTION 3 The material contained in Exhibits "A" and "B"_to this ordinance shall not be included in the formal municipal codification of ordinances, but shall be maintained as a public record in the office of the Cily Secretary and will be available for public inspection and copying during regular business hours SECTION 4 This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas. excep! where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 5 It is hereby declared to be the intention of the City council that the phrases, clauses, scntences, paragraphs, and sections of this ordinance are, severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid .i udgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. 2 SECTION 6 Any person, finn or co~-poration who x iolates, disobeys, omits, neglects or refuses to comply with or '~ho resisls the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($ 2,000.00) for all violations involving zoning, fire safety or public health and sanitation, including dumping or refuse, and shall be fined not more lhan five hundred dollars ($500) for all other violations of this ordinance each day that a x iolation is permitted to exist shall constitute a separate offense. SECTION 7 All rights and remedies of the City of Southlake are expressly saved as to any and ail violations of the provisions of any ordinances affecting the regulation and control of the use, occapancy, maintenance, repair, design, construction and quality of materials for buildings and structures within the City which have accrued at the time of the effective date of this ordinance; and. as to such acc~n_~ed violations and all pending litigation, both civil and criminal, whether pending in courl or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until fiual disposition by the courts. SECTION 8 q'he City Secretary,' of the City of Southlake is hereby authorized to publish this ordinance m book or pan~phlet form for general distribution amoug the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. SECTION 9 The City Secretary of the City of Southlake is hereby directed to publish in the official ne,~x spapcr of the City of Southlake, the caption, penalty clause, publication clause and_effective date of'this ordinance one time within ten days after passage of this ordinance, as required by Section 3.13 of the Charier of the City of Southlake. SECTION 10 This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. The codes, when specifically adopted, and standards referenced in this code shall be considered part of the requirements of this code to the prescribed extent of each such reference. Any reference made to NFPA 70 or the ICC Electrical Code shall mean the Electrical Code as adopted. Fuel-fired water heaters shall not be installed in a room used as a storage closet. Water heaters located in a bedroom or bathroom shall be installed in a sealed enclosure so that combustion air will not be taken from the living space. Access to such enclosure may be from the bedroom or bathroom when throuqh a solid door, weather-stripped in accordance with the exterior door air leakaqe requirements of the International Enerqy Conservation Code and equipped with an approved self- closinq device. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches (51 mm) measured on the side of the barrier which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an aboveground pool, the barrier may be at ground level, such as the pool structure, or mounted on top of the pool structure. Where the barrier is mounted on top of the pool structure, the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches (102 mm). Pre-existing fences. The installation of a swimmin~q pool creates the requirement for the barrier fence. A previously existinq fence would not have any status under this section because the addition of the pool creates the hazard on which the code section is based. The one exception to this qeneral rule is when the fence on one side of the new pool is already a pool enclosure L8 for the adiacent property. That fence seqment which is common to another yard with a pool is a leqal nonconforminq pool enclosure and need not be upgraded. Any other existinq fence that is lust now becoming a pool enclosure shall comply with this section. 2. Openings in the barrier shall not allow passage of a 4-inch-diameter (102 mm) sphere. 3. Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints. 4. Where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is less than 45 inches (1143 mm), the horizontal members shall be located on the swimming pool side of the fence. Spacing between vertical members shall not exceed 1.75 inches (44 mm) in width. Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1.75 inches (44 mm) in width. 5. Where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is 45 inches (1143 mm) or more, spacing between vertical members shall not exceed 4 inches(102 mm). Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1.75 inches (44 mm) in width. EXCEPTION: When horizontal members are part of a fence that is at least 6 feet (1830 mm) in heiqht, the horizontal members need not be on the pool side of the barrier and the 45 inch distance between horizontal members does not apply. 6. Where the release mechanism of the self-latching device is located less than 54 inches (1372 mm) from the bottom of the gate, the release mechanism and openings shall comply with the following: 8.1. The release mechanism shall be located on the pool side of the gate at least 3 inches (76 mm) below the top of the gate, and 8.2. The gate and barrier shall have no opening greater than 0.5 inch (12.7 mm) within 18 inches (457 mm) of the release mechanism. Vehicle qates desiqned or intended to be used on a reqular basis may be automatic closinq rather than maintained locked. Automatic gates may be opened by a key or switch (fixed or remote) but the qate shall automatically close within one to two minutes without requirinq any additional action on the par[ of the person who opened it. 9. Where a wall of a dwelling serves as part of the barrier one of the following conditions shall be met: 9.1. The pool shall be equipped with a powered safety cover in compliance with ASTM F1346; or 9.2. All doors with direct access to the pool through that wall shall be equipped with an alarm which produces an audible warning when the door and its screen, if present, are opened. The alarm shall sound continuously for a minimum of 30 seconds immediately after the door is opened and be capable of being heard throughout the house during normal household activities. The alarm shall automatically reset under all conditions. The alarm system shall be equipped with a manual means, such as touchpad or switch, to temporarily deactivate the alarm for a single opening. Such deactivation shall last for not more than 15 seconds. The deactivation switch(es) shall be located at least 54 inches (1372 mm) above the threshold of the door; or 9.3. Other means of protection, such as self-closing doors with self-latching devices, which are approved by the governing body, shall be acceptable so long as the degree of protection afforded is not less than the protection afforded by Item 9.1 or 9.2 described above 10. Where an aboveground pool structure is used as a barrier or where the barrier is mounted on top of the pool structure, and the means of access is a ladder or steps, then: 10.1. The ladder or steps shall be capable of being secured, locked or removed to prevent access, or 10.2. The ladder or steps shall be surrounded by a barrier which meets the requirements of Section AG105.2, Items 1 through 9. When the ladder or steps are secured, locked or removed, any opening created shall not allow the passage of a 4-inch-diameter (102 mm) sphere.
