AN ORDINANCE ~M)OPT1NG THE 2000 EDITION OF THE INTERNATIONAL
BUILDING CODE, REGULATING THE ERECTION, CONSTRUCTION,
ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL,
DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT,
AREA AND MAINTENANCE OF ALL BUILDINGS OR STRUCTURES, EXCEPT
()NE- AND TWO-FAMILY DWELLINGS AND MULTIPLE SINGLE-FAMILY

WHEREAS, the City of Southlake is a home rule city acting under its charter adopted by
the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local
Government Code; and
WHEREAS, the City Council of the City of Southlake deems it necessa~ to adopt this
ordinance providing minimum standards to safeguard the health, property, and welfare of the citizens
of South]ake bv regulating and controlling the use, occupancy, maintenance, repair, design,
construction aod quality of materials for buildings and structures within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1
That the International Building Code, 2000 Edition, published by the International Code
Council. including the standards referenced therein, including Appendix Chapters A, C, F, G, H,
I and J are hcreby adopted as the Building Code of the City of Southlake regulating the erection,
construction, enlargement, alteration, repair, moving, removal, demolition, conversion,
occupancy, equipment, use. height, area and maintenance of all buildings or structures, except
one and lwo-i'amily dwellings and multiple single family dwellings (townhouses), in the City of
Southlake. 7rue and correct copies of these documents are attached as Exhibit "A."
SECTION 2
That the 2000 international Building code, as adopted herein, is hereby amended as provided in
Exhibil "B" incorporated herein and attached hereto for all purposes of this ordinance. The City
of Southlake. Texas may from time to time determine that additional local modifications to the
Building Code are necessary and appropriate to meet the unique needs of the City of Southlake,
Texas. To effectuate these local modifications, the City Council shall enact individual
ordinances amending this Ordinance, fully setting forth the change to be made in the Building
Code. These amendments shall be consolidaled as Exhibit "B" to this Ordinance.
SECTION 3
['he material contained m Exhibits "A" and "B" to this ordinance shall not be included in the
lbrmal nmnicipal codification of ordinances, but shall be maintained as a public record in the
office oflhe City Sccreta~ and will be available for public inspection and copying during
regular business hours.
SECTION 4
This ordinance shall be cumulative of all provisions of ordinances of the City of
Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the
provisions of such ordinances, in which event the conflicting provisions of such ordinances are
hereby repealed.
'['his ordinance is intended to replace the following: 1. Ordinance 693, as amended, the 1997 Uniform Building Code.
2. Ordinance 621, the 1994 Uniform Administrative Code.
This ordinance is not intended to amend or replace the following:
Ordinance 480, the Zoning Ordinance.
2. Ordinance 483, the Subdivision Ordinance.
3. Ordinance 557, Exterior Masonry Construction Requirements
4. Ordinance 568, Contractor's Licensing Ordinance
Ordinance 506-A, as amended, the Sign Ordinance
SECTION 5
I~ is hereby declared to be the intention of the City council that the phrases, clauses,
sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause
scmence, paragraph or section of this ordinance shall be declared unconstitutional by the valid

.I udgment or decree of any courl of competent jurisdiction, sucln unconstitutionality shall not
afl'cci any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,
since thc same would lnave been enacted by tine City Council without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists fine enforcement of any of the provisions of this ordinance shall be
fined no~ more than Two Thousand Dollars ($ 2,000.00) for all violations involving zoning, fire
safety or public healtln and sanitation, including dumping or refuse, and shall be fined not more
tlmn five hundred dollars ($500) for all other violations of this ordinance. Each day that a
violation is pennitled to exisl shall constitute a separate offense.
SECTION 7
All rights and remedies of the City of Southlake are expressly saved as to any and all
x iolations of the provisions of any ordinances affecting the regulation and control of the use,
occupancy, maintenance, repair, design, construction and quality of materials for buildings and
structures x~ itlmn the City whicln have accrued at the time of the effective date of this ordinance;
and. as to sucln accrued violations and all pending litigation, both civil and criminal, whether
pending in court or not, under such ordinances, same shall not be affected by this ordinance bul
may be prosecuted until final disposition by the courts.
SECTION 8
The City Secretau of the City of Southlake is hereby authorized to publish this ordinance
in book or pamphlet form for general distribution among the public, and the operative provisions
of this ordinance as so published shall be admissible in evidence in all courts without further
prooftNm tine produclion thereof.
SECTION 9
Thc Cit5 Secretary of the City of Southlake is hereby directed to publish in the official newspaper
of linc City of Soutlnlake, tine caption, penalty clause, publication clause and effective date of this
ordinm~ce one time within ten days after passage of this ordinance, as required by Section 3.13 of
tine Charter of the City of Southlake.
SECTION 10
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.

this code to lhe prescribed extend of each such reference. Whenever amendments have been
adopted to the referenced codes and standards, each reference to said code and standard shall be
considered to reference the amendnrents as well. Any reference to NFPA 70 or the ICC Electrical
('ode shall mean thc Electrical Code as adopted.

105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair,
move, demolish, or change the occupancy ora building or structure, to excavate or change the grade
of any property, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical,
gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause
an,~ such work to be done, shall first make application to the building official and obtain the
required permit.

shall also show proposed erosion control and tree protection measures in accordance with

authorized to waive or modify the requirement for a site plan when the application for permit is for

SECTION 112 BOARD OF APPEALS
112.1 General. In order to hear and decide appeals of orders, decisions or determinations made bv
thc buildin~ official relative to the application and interpretation of this code. there shall be and is
hcrebx created a board of appeals. The Building Board of Appeals as established bv ordinance 622
as amended shall be the Board of Appeals referenced in this code.
112.2 Limitations on authority. An application for appeal shall be based on a claim that the true
intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, the
provisions of this code do not fully apply, or an equally good or better form of construction is
proposed. The board shall have no authority to waive requirements of this code.
**Section 110.1; change to read as./ollows:
110.1 Use and occupancy. No building or structure shall be used or occupied, and no change in the
existing occupancy classification or occupant, either owner or tenant, of a building or structure or
portion thereof sbatl be made until the building official has issued a certificate of occupancy therefor

Thc provisions of this Chapter are meant to work in coordination with the provisions of Chapter 4 of
the lnlernanonal Plumbin~ Code. Should an,,, conflicts arise between the two chapters, the Code
Official (as defined in the Plumbing Code) shall determine which provision applies.
** Section 2902.1: change to read as follows:
2902.1 Minimum number of fixtures. Plumbing fixtures shall be provided for the t,vpe of
occupancy and iT] the minimum number as follows:
1. Assembly Occupancies: At leasl one drinking fountain shall be provided at each floor level in
an approved location.
Exception: A drinkina fountain need not be provided in a drinking or dining establ shment
2. Groups A, B, F H. i, M and S Occupancies: Buildings or portions thereof where persons are
employed shall be provided with at least one water closet for each sex except as provided for in
Section 2902.2.
3. Group E Occupancies: Shall be provided with fixtures as shown ii] Table 2902.1.
4. Group R Occupancies: Shall be provided with fixtures as shown in Table 2902.1.
I1 is recommended, but not required, thai the minimum number of fixtures provided also comply
with the nmnber shown in Table 2902.1. Types of occupancies not shown in Table 2902.1 shall be
considered individually by the

number of occupams shall be determined by this code. Occupancy classification shall be
delemqined in accordance with Chapter 3.
2902.1.1 Finish material. Finish materials shall comply with Section 1209.
2902.2 Unisex toilet and bath fixtures. Fixtures located within unisex toilet and bathin~ rooms
complying with Chapter 11 are permitted to be included in detenninin~ the minimum required number
of fixtures for assembly and mercantile occupancies.
