0776 O,*di, anee o. OFFICIAL RECORD AN ORDINANCE VACATING AND ABANDONING CERTAIN PORTIONS OF T. W. KING ROAD IN THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS DECLARING THAT SUCH PROPERTY IS UNNECESSARY FOR USE BY THE PUBLIC; At THORIZING THE MAYOR OF THE CITY OF SOUTHLAKE TO EXECUTE A QUITCLAIM DEED RELEASING PUBLIC OWNERSHIP, INTEREST AND CONTROL OF THIS RIGHT-OF- YVAY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. ~'HEREAS, the City of Soutlnlake is a lnome rule city acting under its charter adopted by the electorate pursuant of Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; WHEREAS, fine Texas Constitution recognizes that development and divcrsificatiou of the economy of the state are public purposes and, in recognition of this constitutional amendment, tine Texas Legislature adopted an enabling act allowing a city to establish and provide for the administration of a program to promote local economic develop~nent and to stimulate business and commercial activity in the municipality; WHEREAS, tine beneficial economic impact, including construction, purchasing, employ~nent and operating functions, of locating the SABRE campus within tine City of Southlake is projected to be $14 billion by the end of 2009 to the Cily of Soutlnlake and the surrounding area; WHEREAS, a fundamental criterion during SABRE's site evaluation and decision to locate its campus in tlne City of Soutblake was the ability to create a closed, secure campus for the safety proprietary technology and information; and protection of its employees and WHEREAS, the City Council of the City of Southlake, after careful study and consideration, has determined that the public welfare will be promoted by placing in private control a certain portion of T. W. King Road in the City of Southlake witlnin the SABRE campus; and WHEREAS, the City council of the City of Southlake has determined that, il' this portion of the road were not closed, the SABRE campus would be bisected by a public street, causing traffic congestion and safety hazards to life and property; and WHEREAS, the City Council of the City of Southlake has determined that closing this portion of thc road does not materially and substantially impair access to any adjoining or nearby landowners' properties, because reasonable alternative routes of travel are available; and WHEREAS, the City Council has determined that the portion of T. W. King Road to be abandoned slnould remain open to the public until future date when the necessity for the closure of the road occurs; and WttEREAS, the franchised utility companies have expressed no objection to tile abandonment of said right-of-way; and WHEREAS, in order to remove any question as to the continued interest or ownership of the public m said right-of-way, the City desires to execute a quitclaim deed releasing all title, ownership and control in said right-of-way to the owners of the abutting property. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION I Effective as provided below, the following right-of-way in the City of Southlake, Tarrant County, Texas is vacated and abandoned as public property: the portion of T. W. King Road, a dedicated public street, more specifically described in Exhibit A and shown on Exhibit B (the "Property"). The vacation of this right- of-way shall be subject to an Emergency Access Easement for the ingress, egress, access, and passage to and across the Property for emergency police, fire, ambulance, and other public safety vehicles and personnel, as further described in Exhibit C. Exhibit A, B, and C are attached hereto and incorporated herein for all purposes. The right-of-way so vacated and abandoned shall revert in fee simple to the owners of the abutting properties. SECTION 2 his ~ght-of-x~a5 vacation shall be effective on December 1 2001. SECTION 3 Upon the vacation becoming effective, as provided in Section 2, the Mayor of' the City of Southlake, Texas. is hereby authorized and directed to execute a quitclaim deed to the abutting property owners in the fomn shown in Exhibit D releasing all claims to tittle, ownership, or control of the right-of-way on the behalf of the (_ity of' Southlake. Texas. other than as excepted in the quitclaim deed. A copy of this quitclaim deed shall be presented for filing with the County Clerk of Tarrant County, Texas by the office of the City Secretary. SECTION 4 I! is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if an? phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, set tence, paragraph or section.
