0687ORDINANCE NO. 687 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS~ DESIGNATING EAST HIGHLAND STREET BET~VEEN THE 800-1100 BLOCK OF EAST HIGHLAND AS A TWO-WAY STREET; PROVIDING FOR THE POSTING OF SIGNS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; REPEALING ORDINANCE NO 370; PROVIDING A SEVERAB1LITY CL4USE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Southlake is authorized under Section IA1 of the Charter of the City of Southlake, and under Section 311.001 of the the Texas Transportation Code to adopt local traffic regulations with respect to street and highways under its jurisdiction; and WHEREAS, the City Council hereby finds that the designation of E. Highland between the 800-1100 block as a two-way street is necessary for the promotion of the health, safety, and welfare of the City and its citizens. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, THAT: Section 1. All of the above premises are found to be true and correct and are incorporated into the body of this Ordinance as if copied in their entirety. Section 2. The section of E. Highland between the 800-1100 Block of said street (between S.H. 114 and N. Carroll Ave.) shall be hereby designated a two-way street. Section 3. The Director of Public Works shall be hereby directed to provide the proper markings and to erect the appropriate signs and/or traffic control devices as adopted by the Texas Manual on Traffic Control Devices. Section 4. The City Secretary of the City of Southlake is hereby direct to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or fort'eiture for any violation of any of its provision, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the charter of the City of Southlake. f: \lilesks[ake\ordinanc~h[ghland.st ( Il)- 13 97) Page 1 Section 5. This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. Ordinance No. 370 is hereby repealed. Section 6. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared nnconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council xvithout the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. Section 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Section 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 370 or any other ordinances regulating traffic which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. Section 9. This ordinance shall be in full force and effect from and after its passf~ge and publication as required by law, and it is so ordained. PASSED AND APPROVED , 1997.
