0678 OFFICIAL RECORD ORDINANCE NO. <7,:Y ~ % AN ORDINANCE OF TIlE CITY OF SOUTIlLAKE, TEXAS~ ANNEX'ING THE HEREINAFTER MORE PARTICULARLY DESCRIBED TERRITORY GENERALLY DESCRIBED AS AN AREA COMPRISING APPROXIMATELY 479.15 ACRES ABUTTING STATE HIGHWAY 1147 IGNO~VN AS "SOLANA", TO THE CITY OF SOUTHLAKE, TEXAS~ AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID TERRITORY WITHIN SAID CITY LIMITS AND GRANTING TO ALL OWNERS OF PROPERTY ALL OF TIlE RIGHTS AND PRMLEGES OF OTHER CITIZENS AND BINDING SAID OWNERS AND OTHER PERSONS WITHIN TltE ANNEXED AREA BY ALL TItE ACTS~ ORDINANCES AND REGULATIONS OF SAID CITY; APPROVING A SERVICE PLAN FOR SUCH TERRITORY; PROVIDING A SEVERAB1LITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursunnt to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WIIEREAS, the City of Southlake desires to annex the hereinafter described territory (the "Territory"); and WIIEREAS, the City of Southlake has received a petition signed by all owners of the Territory requesting that the city annex the Territory; and WItEREAS, public hearings on the proposed annexation were held before the Southlake City Council on May 26, 1997 and May 27, 1997, not more than forty (40) days nor less than twenty (20) days before the adoption of this ordinance on first reading; and WItEREAS, notice of the public hearings were published in a newspaper having general circulation in the City of Southlake and in the Territory on May 14, 1997, which date is not more than twenty (20) nor less than ten (10) days prior to the date of the public hearings; and WHEREAS, the City of Southlake, Texas, has prepared a service plan, setting forth municipal services and a schedule for extending services to the property herein annexed; and WHEREAS, the newly annexed Territory lies within the exclusive extraterritorial jurisdiction of the City of Southlake, Texas. NOW~ THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That the Territory generally described as two tracts together comprising an area ct' approximately 479.15 acres, more or less, known as "Solana" and more particularly described in Exhibit "A", attached hereto and incorporated herein lk~r all purposes, and depicted in Exhibit "B", attached hereto and incorporated hereto for all purposes, be, and the same is hereby, annexed to the City of Southlake, Texas, and the boundary limits of the City of Southlake be, and the same are hereby, extended to include the so described Territory within the City limits, and the same hereafter shall be included within the territorial limits of said City, and the owners and other persons within the Territory. thereof hereafter shall be entitled to all rights and privileges of other citizens of the City and shall be bound by all the acts, ordinances and regulations of said City. SECTION 2. That the approved Service Plan is hereby approved by the city council and adopted, and is attached hereto as Exhibit "C" and is made a part hereof for all purposes. SECTION 3. The official map and boundaries of the city, heretofore adopted, are hereby amended so as to include the aforementioned Territory as a part of the City of Southlake, Texas. O02 (07-15-97) Page 2 city manager is hereby directed and authorized to perform or cause to be performed all acts necessary to correct the official map of the city to add the Territory hereby annexed as required by law. SECTION 4. The city secretary is hereby directed to file a certified copy of this ordinance in the office of the county clerks of Denton and Tarrant Counties, Texas. SECTION S. This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, ordinances are hereby repealed. in which event the conflicting provisions of such SECTION 6. If any section, subsection, sentence, phrase or word of this ordinance be found to be illegal, invalid or unconstitutional, or if any portion of said property is incapable of being annexed by the city, for any reason whatsoever, the adjudication shall not affect any other section, sentence, phrase, word, paragraph or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph, or provision of any other ordinance of the city. Maintenance nf Water and Waste Water Facilities Any and all water or waste facilities owned or maintained by the City of Southlake, Texas, at the time of the annexation shall continue to be maintained by the City of Southlake, Texas. Maintenance nf any Publicly Owned Facility, Building or Municipal Service The City Council of the City of Southlake, Texas, is not aware of the existence of any publicly owned facility, building or other municipal service now located in the area proposed for annexation. In the event any such publicly owned facility, building or municipal service does exist and is a public facility, the City of Southlake, Texas, will maintain such area to the same extent and degree that it maintain publicly owned facilities, buildings or municipal services of the City now incorporated in the City of Southlake, Texas. 2. Prngram fi)r constructinn or acquisition of any capital imprnvements necessary for providing municipal services for the area: A. In General 1. The City will initiate the construction or acquisition of any capital improvements required by this service plan within two years after the effective date of the annexation and will substantially complete the work within 44/2 years. 2. The City policy [or extending water and waste water service is to extend service on an as required basis when development applications or subdivision plats are submitted to the City in accordance with the City's subdivision and development ordinances. 3. Landowners may be required to fund capital improvements necessary to provide service in a manner consistent with Chapter 395, Texas Local Government Code. f:\files\slake\annexati\service. O la Page 2 Nothing in this service plan shall be interpreted to reqaire a landowner within the newly annexed area to fund capital improvements necessary to provide municipal services in a manner inconsistent with Chapter 395 of the Local Government Code, unless otherwise agreed to by the landowner. 4. This Service Plan shall have no effect on the Trophy Club Municipal Utility District No. 1. B. Police Protection, Fire Protection & Solid Waste Collection The City Council of the City of Soathlake, Texas, finds and determines it to be unnecessary to acquire or construct any capital improvements for the purposes of providing police protection, fire protection or solid waste collection. The City Council finds and determines that it has at the present time adequate facilities to provide the same type, kind and level of protection and service which is presently being administered to other areas already incorporated in the City tit' Southlake, Texas, with the same or similar topography, land use and population density. C. Water anti Waste Water Facilities The City of Southlake, Texas, believes that given the current state of development in the area to be annexed, adeqaate City water mains exist for points of connection for serviceable extensions to provide water service pursaant to the City's standard water extension policies now in existence or as may be amended by the City Council. If further development and construction of subdivisions commence within this property, water mains and waste water fimilities of the City will be extended by the property owner or developer in accordance with provisions of the Subdivision Ordinance and other applicable policies, ordinances, and regulations. City participation in the costs of these extensions shall be in accordance with applicable City policies, ordinances, and regulations. Such extensions will commence within two years from the effective date of the annexation ordinance, and/or upon development, whichever occurs later. D. Roads and Streets The City of Southlake, Texas, with a cooperative effort of the City's designated utility company, will undertake to provide the same degree of road and street lighting as is provided in areas of similar topography, land use and population density within the present corporate limits of the City of Southlake, Texas. Maintenance of properly dedicated roads and streets will be consistent with the maintenance provided by the City to other roads and streets in areas of similar topography, land use and subdevelopment of the annexed property. Developers will be required pursuant to the ordinances of the City of Southlake, Texas, to provide internal and peripheral streets and to construct those streets in accordance with the specifications required by the City of Southlake, Texas, for a properly dedicated f:\files\slake\annexati\ser*ice.O la Page 3 street. E. Maintenance of Parks, Playgrounds, and Swimming Pools, and the Maintenance nf any Other Publicly Owned Facility, Building or Service To the extent that it becomes necessary because of development demands, population growth, and a bona fide need, the City Council of the City of Southlake, Texas, will undertake to provide any such facility which it deems necessary to adequately provide for the health and safety of the citizens of the newly incorporated area based upon the standard considerations of topography, land use and population density. SPECIFIC FINDINGS The City Council of the City of Southlake, Texas finds and determines that this proposed Service Plan will not provide any fewer services, and it will not provide a lower level of service in the area proposed to be annexed than were in existence in the proposed area at the time immediately preceding the annexation process. Because of the differing characteristics of topography, land utilization and population density, the service levels which may ultimately be provided in the newly annexed area may differ somewhat from services provided other areas of the City of Southlake, Texas. These differences are specifically dictated because of differing churacteristics of the property and the City of Southlake, Texas, will undertake to perform consistent with this contract so as to provide this newly annexed area ~vith the same type, kind and quality of service presently enjoyed by the citizens of the City of Southlake, Texas, xvho reside in areas of similar topography, land utilization and population.
