AN ORDINANCE AMENDING ORDINANCE NO. 619 THE BUILDING CODE OF THE
CITY; REQUIRING AUTOMATIC FIRE EXTINGUISHING SYSTEMS IN ALL
OCCUPANCIES EXCEPT GROUP R. DIVISION 3 IN WHICH THE FLOOR AREA
EXCEEDS 6.000 SQUARE FEET; PROVIDING A PENALTY; PROVIDING A
CUMULATIVE CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City. of Southlake, Texas is a home rule city acting under its charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local
Go;ernment Code: and
WHEREAS, lhe Git5 has adopted ordinances requiring the installation of automatic fire
extinguishing s}stcms in certain occupancies: and
WHEREAS, the Cit? Council has determined that it is necessary.' to amend these requirements;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
Section 1. That Section 904.2.2 of the 1994 Uniform Building Code, City of Southlake. is amended
b? amending the introductoD' sentence and adding Subsection 6 with exception to read as follows:
Section 904.2.2 All Occupancies except Group R, Division 3 and Group U. Except for Group R,
Division 3 and Group U occupancies an automatic fire extinguishing system shall be installed:
6 Throughout all buildings containing over 6,000 square feet of floor area. For the purpose of this
paraffaph, area separation walls shall not be considered as forming separate buildings.
EXCEPTION: Open Parking Garages.
Section 2. Penalty. Any person, firm, or corporation who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be
t'med not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
Section 3. Cumulative Clause. This ordinance shall be cumulative of all provisions of ordinances
ol',~he City of Southlake, Texas. except where provisions of this ordinance are in direct conflict with the
provisions of another ordinance, in which event the conflicting provisions of the other ordinance are hereby
repealed.
Section 4. SeverabiliD' Clause. It is hereby declared to be the intention of the City. Council that
tile phrases, clauses, senteoces, para~aphs, and sections are severable, and if any phrase, clause, sentence,
paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs, and sections of this ordinance, since they would have been enacted by the
CiD, Council without the incorporation in this ordinance of the unconstitutional phrase, clause, sentence.

Section 5. Publication. The city. secreta~ is directed to publish the preamble and penalty, clause of
this ordinance at least one time within 10 da.',s after its final passage, in the official newspaper of the ciD' in
accordance with Section 3.13(b) of the Southlake Home Rule Charier.
Section 6. Effective Date. This ordinance shall be in tull force and effect from and after its
