0580 AN ORDINANCE CALLING A SPECIAL ELECTION FOR NOVEMBER
2, 1993 TO DETERMINE WHETHER OR NOT THE VOTERS DESIRE TO
LEVY A SALES AND USE TAX FOR THE BENEFIT OF AN ECONOMIC
DEVELOPMENT CORPORATION; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Southlake is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the Development Corporation Act of 1979, V.A.T.C.S., Art. 5190.6,
pro~sdes that certain eligible cities may create an industrial Development Corporation to
be funded by a sales and use tax for the benefit of the corporation, if the tax is authorized
by a majority of the qualified ~oters; and
WHEREAS, the City of Southlake is an eligible city as defined by Section 4B(a)(1)
of thc Development Corporation Act; and
WHEREAS, the Development Corporation Act provides that an election shall be
held in accordance with Chapter 321 of the Tax Code; and
WHEREAS, Section 321.401 of the Tax Code provides that the governing body of
a murficipality may, by ordinance, call an election by the vote of a majority of its members;
WHEREAS, Section 321.403 of the Tax Code provides that such an election must
be tncld on the first succeediag uniform date for which sufficient time elapses for the
lnolding ot an electi(m: and
WHEREAS, Section 41.001 of the Texas Election Code specifies that the first
Tuesday after thc first Mtmday in November of odd numbered years shall be a uniform
elect~on date available for It}cai special elections; and

WHEREAS, the first Tuesday after the first Monday in November, falls on
Novcmbe! 2, 1993
NOW, TItEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIlE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1
A special election shall be held on November 2, 1993, on the following proposition:
PROPOSITION 1:
FOR
AGAINST
The adoption of a one-half of one percent sales and
use tax for the benefit of an industrial development
corporation created pursuant to V.A.T.C.S. Article
5190.6, Section 4B, for the purpose of developing public
parks or other projects permitted by law.
SECTION 2
This ordinance shall be cumulative of all provisions of ordinances of the City of
Southlake, Texas, except where thc provisions of this ordinance are in direct conflict with
the provisions of such ordinances, in which event the conflicting provisions of such
ordinances are hereby repealed.
SECTION 3
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences paragraphs, ~:nd sections of this ordinance are severable, and if any
phrase, clause, sentence paragraph or section of this ordinance shall be declared
unconstitutioual by the valid judgment or decree of any court of competent jurisdiction,
such uncollstitutkmaliw shall no~ affect any of thc remaining phrases, clauses, sentences,
paragraphs and seclions of this ordinance, since the same would haxe been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phra.~e, clause, sentence, paragraph or section.

SECTION 4
The City Secretary of the City of Southiake is hereby directed to engross and enroll
this ordinance by copying the caption and effective date clause in the minutes of the City
Council and by filing the ordinance in the ordinance records of the City.
SECTION 5
This ordinance shall be in full force and effect from and after its passage, and it is
so ordained.
