AN ORDINANCE AMENDING ORDINANCE NO. 572, THE FIRE CODE OF THE CITY;
REQUIRING AUTOMATIC FIRE EXTINGUISHING SYSTEMS IN ALL OCCUPANCIES
EXCEPT GROUP R. DIVISION 3 IN WHICH THE FLOOR AREA EXCEEDS 6,000
SQUARE FEET; PROVIDING A PENALTY; PROVIDING A CUMULATIVE CLAUSE;
PROVIDING A SEVERA. BILITY CLAUSE; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule ciD' acting under its charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local
Government Code; and
WHEREAS, the City has adopted ordinances requiring the installation of automatic fire
extinguishing systems in certain occupancies; and
WHEREAS, the City Council has determined that it is necessao' to amend these requirements;
NOW. IHEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTH LAKE, TEXAS:
Section 1. That Section 10.507 of EXHIBIT "A" of Ordinance No. 572, the Fire Code of the CiD of
Southlake. is amended by deleting Subsections (d) and (e), amending the introductou sentence of Subsection
,.
(b), aod adding Para,apb 5 to Subsection (b) with exception to read as follows:
(b) All Occupancies except Group R, Division 3 and Group U. Except for Group R,
Division 3 and Group U occopancies an automatic fire extinguishing system shall be installed:
5 Throughout all buildings containing over 6,000 square feet of floor area. For the purpose of this
paragraph, area separation walls shall not be considered as forming separate buildings.
EXCEPTION: Open Parking Garages.
Section 2. Penalty.. Any person, firm, or corporation who violates, disobeys, omits, neglects or
relhses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is
permittecl to exist shall constitute a separate offense.
Section 3. Cumulative Clause. This ordinance shall be cumulative of all provisions of ordinances
of the City of Southlake, Texas, except where provisions of this ordinance are in direct conflict with the
provisions of another ordinance, in which event the conflicting provisions of the other ordinance are hereby
repealed.
Section 4. Severability Clause. It is hereby declared to be the intention of the CiW Council that
the phrases, clauses, sentences, paragraphs, and sections are severable~ and if any phrase, clause, sentence.
para,apb, or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases.

Section 5. Publication. The city secreta~ is directed to publish the preamble and penalty clause of
this ordinance at least one time within 10 days after its final passage, in the official newspaper of the cit3 in
accordance with Section 3.13(b) of the Southlake Home Rule Charier.
Section 6. Effective Date. This ordinance shall be in full force and effect from and after its
passage and publication as required by law. and it is so ordained.
