0572AN ORDINANCE ADOPTING THE 1991 EDITION OF THE UNIFORM FIRE CODE FOR THE CITY OF SOUTHI2%KE, TEXAS; REGULATING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE, HAZARDOUS MATERIALS, OR EXPLOSION; MODIFYING THE CODE TO INCORPORATE LOCAL AMENDMENTS; AMENDING THE UNIFORM BUILDING CODE TO REGULATE ROOF CO%;~L~INGS IN CONFORMITY WITH THE UNIFORM FIRE CODE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A SE~a{ABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; REPEALING CONFLICTING ORDINANCES; PROVIDING PENALTIES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the city of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City ("City Council") desires to adopt a nationally recognized fire code containing regulations for the safeguarding, to a reasonable degree, of life and property from fire and explosion; and WHEREAS, the City Council has reviewed the available codes and has determined that the Uniform Fire Code, 1991 Edition, most fully meets the needs of the City; and WHEREAS, the City Council has determined that certain local amendments are in the public interest and therefore deems it advisable to amend the Uniform Fire Code, 1991 Edition, to incorporate these local amendments; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THECITY OF SOUT~U~AKE, TEXA~: SECTION 1. The Uniform Fire Code, 1991 Edition, including all appendixes, and the Uniform Fire Code Standards, 1991 Edition, puolished by the International Conference of Building Officials and the Western Fire Chiefs Association, are hereby adopted as the Fire Code of the City of Southlake. This code and the standards are attached to this ordinance and identified as Exhibit "A" and are fully incorporated by reference as though copied into the ordinance in their entirety. SECTION 2. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by amending Subsections (b) and (c) of Section 10.105 and adding Subsections (e) and (f) to Section 10.105 to read as follows: "(b) Identification. Ail fire protection equipment or hydrants shall be clearly identified in a manner approved by the Chief to prevent parking or other obstruction. All new hydrants that are installed within the corporate city limits of the City of Southlake shall be painted red with a white reflective bonnet. (c) Fire Hydrant Markers. When required by the Chief, hydrant locations shall be identified by the installation of a blue reflective marker placed in the roadway in a manner approved by the Chief. (e) Fire Zones. When the Chief determines that a clear area is necessary to gain immediate access to any fire protection equipment, appliance, or hydrant or to gain access for fire service entry to the building for the purpose of life safety, the area shall be marked or posted as approved by the Chief. (f) Identification of Safety Equipment. Keys, labels and signage necessary for the operation and use of required fire protection equipment and other emergency systems shall be provided as required by the Chief." SECTION 3. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by amending Subsections (a), (b), (c), and (d) of Section 10.204 and adding Subsection (g) to Section 10.204 to read as follows: "(a) Dimensions. Fire aDparatus access roads shall have an unobstructed width of not less than 24 feet or 26 feet when located within 35 feet of any structure in excess of 36 feet in height, and unoDstructed vertical clearance of not less than 13 feet 6 inches. (b) Surface and Construction. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a surface that provides all-weather driving capability. Construction of the all-weather surface shall be: 1. Fire Lane Construction. (A) 5" Concrete with #3 rebar on 18" centers over a modified subgrade, as per the Geotechnical Soils Report. The construction shall be capable of supporting a minimum 65,000 GVW; or (B) 5" Asphalt over a modified subgrade, as per the Geotechnical Soils Report. The construction shall be capable of supporting a minimum 65,000 GVW. 2. Temporaz7 Turnaround Construction. Temporary turnarounds shall be constructed of 2" asphalt over a modified subgrade or 6" of base material. 3. Drive Approach Construction. Drive approaches shall be constructed of six inches of 3000 PSI concrete with #3 rebar on 18" centers both ways on chairs. (c) Turning Radius. The turning radius of a fire apparatus access roadway shall be set and approved by the Chief. Unless otherwise stipulated, each access roadway shall have a twenty five foot (25') inside dimension, and not less than fifty foot (50') outside dimension. (d) Tur~arounds. Any roadway or emergency access easement more than one hundred fifty feet (150') in length shall either be connected to another dedicated public street or fire lane easement, or provided with an all-weather surface turnaround with a turning radius of not less than fifty feet (50'). (g) Speed Bumps. No person, firm or corporation shall place construct, erect or maintain any speed bumps in a marked fire lane, fire zone or emergency access easement without first obtaining approval from the Bureau of Fire Prevention. Speed bumps shall be constructed not to exceed five (5) inches in height and a rise at the ratio of two (2) to one (1)." SECTION 4. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Subsections (d) ana (e) to Section 10.501 to read as follows: "(d) Registration. No person, firm or corporation engaged in the sales, service and/or maintenance of fire extinguishing systems in the corporate limits of the city of Southlake, Texas, shall do so without first obtaining a permit for either or both from the Bureau of Fire Prevention. A permit shall not be issued to any person, firm or corporation who does not have an appropriate current license from the State Fire Marshal. Applicants shall furnish names, addresses and any information necessary to ascertain compliance with these regulations and state law. Exception: The retail sales of new approved fire extinguishers shall be permitted. The performance of maintenance or service of such extinguishers is prohibited, unless the appropriate permit is held. (e) Inspection Certificate. Upon installation of automatic fire extinguishing equipment, the installer shall request an inspection by a representative of the Bureau of Fire Prevention and submit a copy of the state insurance certificate form #370 with a drawing of the system as built. The system must be approved by the Chief. Upon performing an inspection of any fixed fire extinguishing system, a copy of the state insurance form #371 shall be submitted to the Bureau of Fire Prevention within thirty (30) days of the inspection." SECTION 5. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by amending Paragraph 1. of Subsection (c) and Subsections (d), (e), and (h) of Section 10.507 and by adding Subsection (i) to Section 10.507 to read as follows: "(c) Group A Occupancies. 1. Drinking establishments. An automatic sprinkler system shall be installed in rooms used by the occupants for the consumption of alcoholic beverages where the total occupancy area exceeds 5,000 square feet regardless of area separation walls or other uses. (d) Group B, Division 2 Occupancies. An automatic sprinkler system shall be installed in occupancies classified as Group B, Division 2 Occupancies where the floor area exceeds 6,000 square feet on any floor or 12,000 square feet on all floors regardless of area separation walls or other increases allowed by the Uniform Building Code. The area of mezzanines shall be included in determining the areas where sprinklers are required. - 4 - (e) Group E Occupancies 1. An automatic sprinkler system shall be installed in all rooms classified as Group E Occupancies when the square footage exceeds 6000 square feet on any single floor or 12000 square feet on all floors regardless of area separation walls. (h) Group R, Division 1 Occupancies. An automatic sprinkler system shall be installed throughout every multi-family dwelling containing three (3) or more dwelling units, and every hotel containing 20 or more guest rooms. Residential or quick-response standard sprinkler heads shall be used in the dwelling units and guest room portions of the building. (i) Multi-Story Buildings. Approved automatic extinguishing systems shall be installed in all stories of multi-story buildings three (3) or more stories in height, excluding garages used solely as parking garages, without exception. Buildings three (3) stories or more in height shall have a hydraulically designed sprinkler system that meets all the requirements of U.B.C. Section 1807 (c) as amended. Standpipes may be combined with sprinkler systems. SECTION 6. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by amending Section 10.512 to read as follows: "Sec. 10.512. A ventilating hood and duct system shall be provided in accordance with the Mechanical Code and NFPA 96 for commercial-type food heat-processing equipment that produces grease-laden vapors." SECTION 7. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by repealing the Exception to Subsection (b) and by adding SUbsections (g) and (h) to Section 10.513 to read as follows: "(g) Copy of Design. Installer shall provide the Bureau of Fire Prevention with a copy of the design of the automatic fire extinguishing system for review prior to installation. (h) Grease Hood and Duct Systems. Ail commercial kitchen grease hood and duct systems shall comply with NFPA 96, 1991 Edition." - 5 - SECTION 8. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by addin~ Section 11.206 to read as follows: "Sec. 11.206. Portable Grills or Hibachis in Zoning MF-2. All fixed or portable grills or hibachis at apartment house occupancies shall, when in use, be a minimum of 10 feet from the structure and not on or under any portion of the structure." SECTION 9. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Subsection (h) to Section 14.103 to read as follows: "(h) Alarm Reporting. Ail owners, occupants, or monitoring agents of required fire alarm systems must report the activation of any alarms received to the City at the time of activation." SECTION 10. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Section 14.111 to read as follows: "Sec. 14.111. Keys. Ail keys necessary to the proper operation of the fire alarm system shall be kept in a location easily accessible to responding personnel." SECTION 11. The Uniform Fire Code of the City of Exhibit "A" to this ordinance, is amended by amending (d) of Section 79.510 to read as follows: Southlake, Subsection "(d) Storage of Foam. Where foam fire protection is required, foam producing materials shall be stored on the premises and dispensing equipment shall be purchased and maintained as the Chief may require." SECTION 12. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Paragraph 11 to Subsection (a) of Section 79.808 to read as follows: "11. Fire Protection. An approved deluge water foam extinguishing system shall be installed and maintained on all loading facilities." SECTION 13. The Uniform Fire Code of the city of Southlake, Exhibit "A" to this ordinance, is amended by adding Subsection (h) to Section 79.809 to read as follows: "(h) Fire Protection. An approved deluge water foam extinguishing system shall be installed and maintained on all unloading facilities." SECTION 14. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Subsection (r) to Section 87.103 to read as follows: "(r) Storage of Combustible Materials. The storage of combustible materials used for construction shall be located at a distance no greater than 100 feet from a dedicated public street or emergency access easement as outlined in Section 10.201." SECTION 15. The Uniform Fire Code of the City of Southlake, Exhibit "A" to this ordinance, is amended by adding Article 89 to read as follows: "ARTICLE 89 WOOD SHAKE AND SHINGLE ROOF CO~RINGS AND SIDING (a) Commercial Buildings. Commercial buildings must have a Class "A" roof with grade "1" shakes or shingles meeting the requirement of Section 3204 (e) 2. of the 1991 U.B.C. with solid sheathing required. (b) Multi-Family. Any building with two or more dwelling units must have a Class "A" roof with grade "1" shakes or shingles meeting the requirements of Section 3204 (e) 2. of the 1991 U.B.C. with solid sheathing required. (c) Single Family Buildings. Any building with only one dwelling unit must have a Class "C" roof with grade "1" shakes or shingles meeting the requirements of Section 3204 (e)l.A. and B. of the 1991 U.B.C. (d) Treatment. Ail wood shake and shingle roof coverings and siding must be impregnated by the full cell vacuum-pressure - 7 - process with fire retardant chemicals, and qualified by U.B.C. Standard No. 32-7 for use on Class A, B, or C roofs. (e) Replacement. A permit shall be required for replacement of wood shake and shingle roofs and siding." SECTION 16. That Subsection (f) of Section 3204 of the Uniform Building Code, 1991 Edition, adopted by Ordinance No.559, as amended, is amended to read as follows: "(f) Wood Shakes and Shingle Roof Coverings and Siding. 1. Commercial Buildings. Commercial buildings must have a Class "A" roof with grade "1" shakes or shingles meeting the requirement of Section 3204 (e) 2. of the 1991 U.B.C. with solid sheathing required. 2. Multi-Family. Any building with two or more dwelling units must have a Class "A" roof with grade "1" shakes or shingles meeting the requirements of Section 3204 (e) 2. of the 1991 U.B.C. with solid sheathing required. 3. Single Family Buildings. Any building with 0nly one dwelling unit must have a Class "C" roof with grade "1" shakes or shingles meeting the requirements of Section 3204 (e) 1.A. and B. of the 1991 U.B.C. 4. Treatment. Ail wood shake and shingle roof coverings and siding must be impregnated by the full cell vacuum-pressure process with fire retardant chemicals, and qualified by U.B.C. Standard No. 32-7 for use on Class A, B, or C roofs. 5. Replacement. A permit shall be required for replacement of wood shake and shingle roofs and siding." SECTION 17. Cumulative Clause. This ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of another ordinance, in which event the conflicting provisions of the other ordinance are hereby reDealed. SECTION 18. Severability Clause. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paraqraphs and sections are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since they would have been enacted by the City Council without the incorporation in this ordinance of the unconstitutional phrase, clause, sentence, paragraph or section. SECTION 19. Savings Clause. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of the 1988 Uniform Fire Code, as previously adopted by the City of Southlake, as amended, or any other ordinances affecting fire safety which have accrued at the time of the effective date of this ordinance; and, those accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under the previous ordinances, shall not be affected by this ordinance disposition by the courts. SECTION 20. Publication. but may be prosecuted until final The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance Dr0uid~s for th~ imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten days after passage, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 21. Pamphlet Form. The City Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof. SECTION 22. Penalty. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Effective Date.
