0515 CITY OF SOUTHLAKE, TEXAS REPEALED ORDINANCE NO.~X~/.]~'~ ' AN ORDINANCE ESTABLISHING A PARK BOARD FOR THE CITY OF SOUTHLAKE; ESTABLISHING THE NUMBER OF BOARD MEMBERS AND THEIR TERMS; PROVIDING FOR BOARD MEETINGS AND BY-LAWS; PROVIDING FOR DUTIES AND RESPONSIBILITIES OF THE PARK BOARD; PROHIBITING THE CONSUMPTION OF ALCOHOLIC BEVERAGES IN PARKS; PROHIBITING HORSES AND OFF-ROAD VEHICLES IN THE PARK; ESTABLISHING OPENING AND CLOSING TIMES FOR PARKS; PROHIBITING LITTERING IN PARKS; PROVIDING FOR SIGNS IN PARKS; PROVIDING FOR PENALTIES; PROVIDING AN EFFECTIVE DATE; CONTAINING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council for the City of Southlake, Texas, deems it advisable and necessary to establish a Park and Recreation Board for the City of Southlake, to act as an advisory board to the City Council relating to all nature of park improvements and recreation programs; and WHEREAS, the City Council deems it advisable and necessary to prohibit the consumption of alcoholic beverages within city parks and to prohibit the use of any off-road vehicle or any horse within city parks; and WHEREAS, the City Council deems it ~dvisable and necessary to prohibit littering within city parks; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. Creation of Park and Recreation Board. There is hereby established the Park and Recreation Board for the City of Southlake, Texas, hereinafter referred to as the "Board." Section 2. Number of Board Members, Qualifications and Terms. The Board shall consist of nine (9) citizens of the City of Southlake, Texas, and who shall be appointed by the City Council for three (3) year terms. Members shall serve until their successors are appointed, without compensation. Places on the Board shall be numbered one {1) through nine (9). The City Council in making the appointments to the Board, shall give due consideration to the recommendations of the Chamber of Commerce, Planning and Zoning Commission, and the Park. and Recreation Board. The City Council if it deems it desirable, may appoint ex officio members to the Board. Such ex officio members shall be appointed on an annual basis and the term of office of such ex officio members shall begin on January 1st. of each year and end on December 31st. of that year. Such ex officio members shall have no voting authority for park and recreation matters. Vacancies on the Board are to be filled by appointment by the City Council for the length of the unexpired term. Section 3. Board Meetings and By-Laws. The Board, shall meet in the first regular session of each year and shall select from the members a chairman, vice-chairman, and secretary for one year terms and until their successors are elected. The Board shall adopt by-laws to govern the holding of its meetings which, at a minimum, shall encompass the following: a. Regular meetings shall be held on the first Monday of each month. b. Manner of holding and calling of special meetings. c. Majority of members shall constitute a quorum. d. Members not planning to attend a regular meeting or special meeting shall notify the City Secretary or the Chairman of the Board by 12:00 o'clock noon of the meeting day. e. Any member with unexcused absences from three (3) consecutive regular meetings or not exhibiting interest in the work of the Board shall be reported to the City Council which may, at its discretion, remove the Board member and appoint a replacement. f. Minutes of each Board meeting shall be filed with the City Secretary. Section 4. Board Duties and Responsibilities. The duties and responsibilities of the Park and Recreation Board shall be to: a. Act in an advisory capacity to the City Council in all matters pertaining to parks and recreation including development of long range capital improvements programs. b. Cooperate with other City boards and commissions, other governmental agencies, civic groups, and all citizens of the city in the advancement of sound park and recreation recreation services and park development, recreation areas, improved recreation services. of standards for recreational planning and programming. c. Recommend policies on improvements. d. Recommend programs of facilities, programs and e. Recommend the adoption areas, facilities, programs and their financial support. f. Prepare an annual review of existing park and recreation programs and services. g. Review the annual budget of the park and recreation programs prior to submission to the City Council and submit a recommendation on the budget. Section 5. Alcoholic Beverages in Parks. a. Definitions. Alcoholic Beverage shall be defined to include any alcohol and any beverage containing more than one-half (1/2) of one percent of alcohol by volume which is capable of use for beverage, either alone or when diluted. -2- 2. Public Parks shall be defined to be all parks, playgrounds, recreational areas owned, leased, operated or under the control of the City of Southlake, Texas. This definition shall include all athletic fields, swimming pools, gymnasiums, tennis courts, and other similar facilities owned, leased or operated by the City of Southlake. Alcoholic Beverages Prohibited. It shall be unlawful for any person to possess or consume any alcoholic beverage in any public park of the City of Southlake, Texas. Section 6. Riding or Driving Horses in City Parks. It shall be unlawful for any person to drive or ride a horse or horses within the limits of any park owned or leased by the City of Southlake, Texas. Section 7. Riding or Driving Off-Road Vehicles in City Parks. It shall be unlawful for any person to drive or ride an off-road vehicle within the limits of any park owned or leased by the City of Southlake, Texas. For the purposes of this section, an off-road vehicle is a vehicle designed and equipped for use off of any paved roadway with such definition to specifically include off-road motor bikes, go-carts, and dune-buggies. Section 8. Vehicular and Certain Areas; Posting of Signs. Bicycle Traffic Prohibited in so It shall be unlawful for any motor vehicle traffic to stand, stop, park or cross onto or into any portion of any park, playground or recreational area owned, leased, operated, or under control of the City of Southlake, Texas, other than upon a roadway or parking as so designated for such purposes by the City of Southlake. Signs shall be posted giving notice that all vehicular and bicycle traffic is prohibited within any public park wherein such sign is posted except in specifically posted areas that are provided as parking areas or upon roadways provided within such park. Section 9. Time Limitations on Public Authorizing Placement of Signs and Gates. Use of Parks; a. It shall be unlawful for any person to use, enter into or be within a public park within the City of Southlake, Texas during the hours of midnight and sunrise, except when City sponsored. b. Signs shall be placed at appropriate locations in any city park in the City of $outhlake, Texas, to notify all persons of the prohibited hours. Such signs shall state "No Persons Allowed in This Park Between The Hours of Midnight and Sunrise." Section 10. Littering. Littering is hereby prohibited in any public park owned, leased, or operated by the City of Southlake including all trash and other items which may be left by persons picnicking within such park and not placed in appropriate trash receptacles provided in such park by the City of Southlake, Texas. -3- Section 11. Firearms Prohibited. It shall be unlawful for any person to carry on or about himself or to discharge a gun, p~stol, rifle, or other firearm within any park owned, leased, or operated by the City of Southlake, Texas. Section 12. Variances. The Park and Recreation Board may issue special permits or grant variances to the provisions of this ordinance!. Section 13. Penalties and Enforcement. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 14. Repeal of Prior Ordinances and Resolutions. Upon this ordinance becoming effective, all ordinances or resolutions presently existing which are in conflict with any provisions of this ordinance are repealed insofar as the particular provision which conflicts with this ordinance. The provisions of this ordinance relating to the Park and Recreation Board and the particular provisions contained herein are to be controlling. Section 15. Savings Clause. If any section, clause or provision of this ordinance should be declared by a Court of competent jurisdiction to be invalid, or unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part thereof, other than the part so declared to be invalid or unconstitutional. Section 16. Effective Date. This ordinance shall be and become effective upon passage by the City Council of the City of Southlake, Texas, and after publication within the official newspaper of the City of Southlake, Texas, as provided for and required by the statutes of the State of Texas. The Southlake City Council established the South2ak¢ Park and Recreation Board to act as an advisory board to the City Council relating to all nature of park improvements and recreation programs, as set forth in Section Four of Ordinance No. 515, passed and approved on the second reading the 23rd day of Novcraber, 1990. Section 1.2 Powers. In fulfillment of its puxpose, the Southlake Park and Recreation Board shall be governed by Ordinance No. 515 and shall have all the powers set foxth in the ordinance, and other applicable law. ARTICLE BOARD MEMBERS Section 2.1 Powers~ Number and Term of Office. (a) Board. The Board shall meet regularly, at such place or places in the City as ~{he Board may from time to time determine. Section 2.3 Special Meetings. Special meetings of the Board may be called at the request of the Chair or any Board member. The person or persons authorized to call special meetings of the Board may fix any place for holding special meetings for the Board. Section 2.4 Quorum. A majority of the eatlre Board, other that tho ex- officio members, shall constitute a quorum to conduct official business of the Board. The act cfa majority of the Board members present at a meeting at which a quorum is m attendance shall constitute the act of the Board, unless the act cfa greater number is reqmred by law. Section 2.5 Conduct of Business. (a) At the meeting of the Board, matters pertaining to the business of the Board shall be considered in accordance w/th rules of procedure as fi:om time to time prescribes by the Board. (b) At all meetings of the Boarch tho Chair shall preside. ~ the absence of the Chair, the Vice Chak shall preside. (c) The Chair shall be a voting member of the Board. (d) Minutes of each Board meeting shall be filed with the City Secretary. Section 2.6 Vacancies. Any vacancy oecttrring in the Board shall be filled by appointment by the City Council for the length of the unexpired term. Section 2.7 Committees of the Board. The Board may designate two (2) or more directors to constitute an official committee of the Board to exercise such authority, as approved by resolution of the Board. It is provided, however, that all final, official actions of the Board may be exercised only by the Board. Board members shall not receive any salary or compensation for their sexxdees as Board members. However, they shall be reimbursed for their actual expenses incurred in the performance of their official duties as Board members. ARTICLE III OFFICERS Section 3.1 Officers and Terms of Office. (a) The officers of the Board shall be a Chair, Vice-Chair, and secretary. The officers shall serve one year terms and until their successors are elected. (b) Officers shall be selected in the first regular session of each year. (c) All officers shall be subject to removal from office at any time by a vote of a majority of the City Council. (d) A vacancy in the office of any elected officer shall be filled by a vote of a majority of the Board Members. Section 3.2 Powers of the Chair. The Chair shall, in general, preside at all meetings of the Board and perform all duties incident to thc office of Chair and such other duties as may be prescribed by the Board and the City Council. Section 3.3 Vice Chair. In the absence of the Chair or in the event, of his/her inability or refusal to act, the Vice Chair shall perform the duties of the Chair, and when so acting shall have all thc powers of and be subject to all the restrictions upon the Chair. Any Vice Chair shall perform such other duties as from time to time may be assigned to h/m/her by the Chair or the Board. Section 3.4 Secretary. The Secretary shall ensure that minutes of each Board meeting shall be filed with the City Secretary and in general shall porform all duties as from time to lime may be assigned to him/her by the Chair or the Board. Section 3.5 Compensation. Officers who are members of the Board shall not receive any salary or compensation for the services, except that they shall be reimbursed for the actual expensed incurred in the performance ot~their duties as officers.
