0508 ORDINANCE NO. 508 AN ORDIN~NCE 1M4E~DZNG ORDI1/i~CE NO. 3ig~ M ~ED~ ~TING TO INC~ASING ~ SPEED ~IHZT ON CERTAIN ST~ETS ~ RO~W~YS WITHIN T~ CITY OF 8Ouw~ PROVIDING T~T THIS O~IN~CE S]~LL BE C~T~ OF ~L O~I~CES~ PROVIDING ~ SERVILITY C~USE~ P~VIDZNG ~ 8~VINGS C~USE; PROVIDING FOR P~LI~TION IN ~ OFFICIAL ~WSP~PER~ ~ PROVIDING ~ EFFECTI~ D~TE. ~E~S, the City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code~ and ~ERE~S, pursuant to Section 169 of A~icle 6701d, Vernon~s Tex.Rev. Civ. Stat., the City of Southlake, Texas has the authority to establish prima facie maximum reasonable and p~dent sgeeds within its corporate boundaries for vehicles on streets and highways. NOW, THEREFORE, BE IT O~I~D BY THE CITY CO~CIL OF THE CITY OF SOUTHLAKE, TEXAS: That all of the SECTION 1 above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. SECTION 2 That Section 6 of Ordinance No. 349 is hereby amended to read as follows: "SECTION $ The prima facie maximum and prudent speed for travel upon any street or roadway within the corporate city limits of the City of Southlake, Texas, other than those streets and roadways designated in subparagraphs (a) through (b) below which shall be forty (40) miles per \slake\ord.2& -1- hour and other than upon State Highway 114 and Farm to Market Road 1709, shall be thirty (30) miles per hour, except as otherwise established by the Department of Public Safety of the State of Texas; and that such speed limit of thirty (30) miles per hour shall be effective immediately upon any street or roadway not presently posted by appropriate signs otherwise and shall be effective upon any street or roadway otherwise posted with a different speed limit sign being removed and a new speed limit sign reflecting a posted speed of thirty (30) miles per hour being erected. Those streets and roadways within the City of Southlake, Texas, upon which the prima facia maximum and prudent speed for travel shall be forty (40) miles per hour as indicated and except as set forth above are as follows: (a) South White Chapel Boulevard from Bear Creek to F.M. 1709; and (b) North white Chapel Boulevard from F.M. 1709 to Dove Road." all provisions of except where the conflict with the SECTION 3 This ordinance shall be cumulative of ordinances of the City of Southlake, Texas, provisions of this ordinance are in direct provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 4 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and \slake\ord. 24 sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional section. phrase, clause, sentence, paragraph or SECTION Ail rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 349 or any other ordinances affecting prima facie speed limits which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be the courts. prosecuted until final disposition by SECTION 6 The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official city newspaper one time within ten days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. \st ake\ord.24 -3- • 4 SECTION 7 This ordinance shall be in full force and effect from and after its passage and publication as required by aw, and it is so ordained.
