0503CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 503 AN ORDINANCE REGULATING THE LOCATION OF STREET LIGHTS IN THE CITY OF SOUTHLAKE BY CREATING AND ESTABLISHING MINIMUM REQUIREMENTS FOR THE PLACEMENT AND INSTALLATION OF ALL STREET LIGHTS IN SOUTHLAKE; PROVIDING FOR STREET LIGHTING ON STATE FRONTAGE ROADS; PROVIDING FOR ENGINEERING AND INSPECTION OF ALL STREET LIGHTS INSTALLED; PROVIDING FOR AN APPROVED CONTRACTOR OR LOCAL ELECTRIC UTILITY TO INSTALL THE STREET LIGHTS; PROVIDING FOR FINANCIAL RESPONSIBILITY AND ARRANGEMENTS; PROVIDING FOR OWNERSHIP AND MAINTENANCE; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City Council of the City of Southlake has determined that adequate street lighting regulations are necessary for safe traffic movement at night; WHEREAS, the City Council of the City of Southlake finds that these street light regulations in this Ordinance are the minimum requirements for the installation and maintenance of street lights; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: I. GENERAL: (A) The Director of Public Works and utilities providing electric service in the City shall approve equipment and material which will be acceptable for all street lighting projects, including minimum standard design. Ail designs, plans, and specifications for street light installations shall, after review and comment by the electric utility to provide service to the street lights involved, be reviewed and approved by the Director of Public works. Requests for approval of designs other than as required in this Ordinance must be made in writing to the Director of Public Works and approved by the City Council. (c) The developer shall provide street lighting in all new ~ubdivi$i0n$ and developments. -1- II. STREET LIGHTING ON ALL STREETS: (A) Street lighting may be installed on local streets: 1. At all intersections. 2. At the end of all cul-de-sac and dead-end streets longer than 100 feet. 3. At all 90 degree changes in direction of the roadway. 4. At mid-block if the block is longer than 1200 feet. Mid-block lights will be equally spaced within the block. 5. At other locations designated on plans approved by the Director of Public Works. (B) The minimum standard design for local streets shall consist of a mast-arm mounted, 100 watt high pressure sodium or 175 watt mercury vapor luminaire, mounted on a steel pole, using aerial or underground wiring; the mast-arm shall be mounted at a height determined in accordance with I (A) above to achieve maximum lighting efficiency, consistent with safety and achievement of desired lighting. (C) Existing wood utility distribution poles may be used when available at the proper locations. III. STREET LIGETING ON STATE FRONTAGE/SERVICE ROADS: Street light installation on any frontage road, service road, or other roadway adjacent to an Interstate Highway, U.S. Highway, State Highway, or County Road will be determined by the Director of Public Works on an individual basis according to current American National Standards Institute (ANSI) criteria. IV. ENGINEERING AND INSPECTION: (A) Street lighting installations shall be design criteria developed by the National Standards Institute (ANSI) Electrical Safety Code. in accordance with current American and the National (B) The developer shall furnish to the City of Southlake, at his sole expense, an exhibit plat at a standard engineering scale of the proposed street layout design. The exhibit plat furnished to the City, if not prepared for the developer by the electric utility to provide service, shall be accompanied by such utility's approval or comments. The proposed street layout design must be approved by the Director of Public Works before construction of street lights can begin. The developer will furnish the City with an estimate prepared by the utility to supply electric service showing estimated utility charges for street lights in the subdivision for two years. The developer will pay the City the a~ount of the estimate prior to final acceptance of the subdivision- Existing developmentS: In existing developments where lighting has not been the costs to 1. · alled, the city will pay 100% of lnst.. ~ ~nimum standard design if: (a) A majority of the adjacent property owners petition the Department of Public Works for a street light· (b) The property owners agree to provide the necessary utility easements for the electrical service to the light. Property owners will pay the additional costs involved if other than the minimum standard design is requested by the petitioning citizens- installation of street lighting is subject to available of city funds for lighting projectS. -3- VII. FINkNCIAL ARRANGEMENTS: (A) Developer shall pay for the installation of all street lights. (B) The Director of Public Works may require a developer to construct any street lights included in a developer's approved plans at a specified time or at a time different than previously specified or agreed when, in the Director's judgment, the lights are needed for the proper and orderly development of the area. When it is determined that street lights should be so constructed, the Director of Public Works shall notify the developer in writing to make arrangements for construction of the lights. Within fifteen (15) calander days after receiving the notice, the developer shall make arrangements for construction of the street lights, including making any necessary payments for the proper installation of the street lights required or approved in the subdivision prior to the installation of the street lights. VIII.OWNERSHIP AND MAINTENANCE: Ail street lights installed under this policy shall be operated and maintained by the electric utility company providing electrical service to such street lights in accordance with approved tariffs and service regulations. _X.
