AN ORDINANCE OF THE CITY OF SOUTHLARE, TEXAS TO EXERCISE
ITS OPTION TO TAX THAT PROPERTY EXEMPTED UNDER SECTION
11.251, TEXAS PROPERTY TAX CODE AND ARTICLE VIII, SECTION
1-J, TEXAS CONSTITUTION; PROVIDING THAT TIIS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFE4TIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule city
acting under its charter adopted by the elect.rate pursuant to
Article XI, Section 5 of the Texas Constitution and Chapter 9 of
the Local Government Code; and
WHEREAS, Article VIII, Section 1-j , Subse tion (a) of the
Texas Constitution and Section 11.251 of the T-xas Property Tax
Code exempts from taxation certain tangible •ersonal property
referred to as "freeport goods" unless the gove ning body of the
taxing authority elects to tax said property; an.
WHEREAS, the exemption of said "freeport go.ds" from taxation
by the City of Southlake would result in the loss of needed
revenues to the City and an unfair shift of the ax burden to the
homeowner and local businessman; and
WHEREAS, Article VIII, Section 1-j , Subse• tion (b) of the
Texas Constitution authorizes the City Council of the City of
Southlake to exercise its option to tax said "fre port goods;" and
WHEREAS, the City Council of the City of outhlake, Texas,
finds that the taxation of freeport goods i in the public
interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY C•UNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1
That the City of Southlake elects to tax/ that tangible
personal property described in Article VIII Section 1-j ,
Subsection (a) , Texas Constitution and Sectio 11.251, Texas
Property Tax Code, which would otherwise be exemp .
SECTION 2
This ordinance shall be cumulative of all provisions of
ordinances of the City of Southlake, Texas, =xcept where the
provisions of this ordinance are in direct c.nflict with the
provisions of such ordinances, in which event the conflicting
provisions of such ordinances are hereby repealer .
SECTION 3
It is hereby declared to be the intention of the City Council
that the phrases, clauses, sentences, paragraphs and sections of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance sh-11 be declared
unconstitutional by the valid judgment or decre= of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentence- , paragraphs and
sections of this ordinance, since the same would ave been enacted
by the City Council without the incorporation in his ordinance of
any such unconstitutional phrase, clause, sente ce, paragraph or
section.

SECTION 4
This ordinance shall be in full force and effect from and
after its passage and publication as required by aw, and it is so
ordained.
