AN ORDINANCE AMENDING ORDINANCE NO. 334 , THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS, AS PREVIOUSLY AMENDED BY ORDINANCE NO. 412; SPECIFICALLY AMENDING SECTIONS 5.18 AND 5.19 RELATING TO SITE PLAN DISTRICT REGULATIONS FOR THE S-P- 1 AND S-P-2 SITE PLAN DISTRICTS IN ORDER TO CLARIFY THE INTENT OF SUCH REGULATIONS WITH RESPECT TO PERMITTED USES WITHIN SUCH DISTRICTS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, having complied with all statutory notices and procedures relative to an amendment to the City's Comprehensive Zoning Ordinance and having received a favorable recommendation of the Planning and Zoning Commission, the City Council, on February 16, 1988 , approved Ordinance No. 412 which amended the basic Comprehensive Zoning Ordinance (Ordinance No. 334) by adding new Sections 5. 18 and 5.19 providing for regulations relating to the S-P-1 (Detailed) and S-P-2 (Generalized) Site Plan Districts; and WHEREAS, the intent of the amendments contained in Ordinance No. 412 was to provide the Planning and Zoning Commission, the City Council and all citizens of the City more flexibility and control in addressing land use needs, including the needs presented by owners of property annexed into the City with existing non-conforming uses; and WHEREAS, the regulations contained in Ordinance No. 412 provide that no land shall be used and no building shall be erected for or converted to any use other than the specific use or uses authorized by an ordinance granting a zoning change to an S-P-1 (Detailed) Site Plan District, or the general use or uses authorized by an ordinance granting a zoning change to S-P-2 (Generalized) Site Plan District, as applicable; and WHEREAS, the intent of Ordinance No. 412 was not to limit or restrict the future use of non-conforming property zoned S-P-1 or S-P-2 for similar uses which are permitted in the zoning ordinance, provided a new site plan is submitted to the Planning and Zoning Commission for recommendation and to the City Council for approval ; and WHEREAS, the City Council deems it necessary and expedient to approve the amendments set forth herein in order to more -1- clearly provide that future similar uses may be permitted on property zoned S-P-1 or S-P-2 subject to approval of a revised site plan and compliance with all requirements of the applicable Site Plan District Regulations, and provided that such uses are determined in the City Council's sole discretion to be uses which are similar to the use or uses authorized by the ordinance originally granting the zoning change to an S-P-1 or S-P-2 Site Plan District, as appropriate; and WHEREAS, the City Council finds that all statutory notices and procedures relative to an amendment to the City's basic Comprehensive Zoning Ordinance have been complied with and that the City's Planning and Zoning Commission has favorably recommended the amendments to the Comprehensive Zoning Ordinance as set forth herein; and WI{EtLEAS, after due deliberation and consideration of all the information submitted at the public hearings, the City Council is of the opinion that the public health, peace, morals and general welfare demand that the Comprehensive Zoning Ordinance be amended as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY TPIE CIndY COLrNCIL OF THE CITY OF SOUTHI2kKE, TEXAS: SECTION 1 That all of the above correct and are incorporated if copied in their entirety. premises are found to be true and into the body of this Ordinance as SECTION 2 That Section 5.18 of Ordinance No. 334, as previously amended by Ordinance No. 412, relating to S-P-! The determination of whether a use is similar shall be in the sole discretion of the City Council." -2- SECTION 3 That Section 5. 19 of Ordinance No. 334 , as previously amended by Ordinance No. 412 , relating to S-P-2 (Generalized) Site Plan District Regulations is hereby amended by adding a new paragraph M. which shall read as follows: "M. The determination of whether a use is similar shall be in the sole discretion of the City Council. " SECTION 4 If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 5 Any person violating any of the provisions of this Ordinance shall be deemed guilty of misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Thousand Dollars ($2 ,000. 00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs. SECTION 6 This Ordinance shall be effective from and after the date of approval hereof and any publication required by the laws of the State of Texas or the Charter of - i 'ty. .
