ORDINANCE NO. 438
AN ORDINANCE EXTENDING THE BUILDING CODES,
BUILDING PERMIT RULES AND PROCEDURES AND
OTHER REGULATIONS OF THE CITY OF SOUTHLAKE,
TEXAS TO THE EXTRATERRITORIAL JURISDICTION
AREA OF THE CITY; PROVIDING A SEVERABILITY
CLAUSE~ AND PROVIDING FOR AN EFFECTIVE DATE~
WHEREAS, it is essential and necessary for the orderly
and proper development of property within the extraterritorial
jurisdiction of the City to extend the applicability of the
City's Building Code to all construction and development in the
extraterritorial jurisdiction of the City; and
WHEREAS, the City has, by previous ordinances, adopted
building codes and other regulations that are essential and
necessary to promote the public health, welfare, safety, morals
and general welfare in addition to providing for an orderly
development growth in the City; and
WHEREAS, authority to take the action stated herein is
provided by applicable laws of the State of Texas as set out in
the Local Government Code.
NOW, THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS, TARPJ~NT COUNTY, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.

Section 4. If any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereof to any person or circumstances is held
invalid or unconstitutional by a Court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of the ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
Section 5. This ordinance shall take effect
immediately from and after its passage and publication in
accordance with the provisions of the General Laws of the State
of Texas and the Charter of the City, and it is accordingly so
ordained.

Re: Ordinance No. 438 Extending the City ' s Building i
Code into the Extraterritorial Jurisdiction
Dear Mayor Westerholm, Members of the Council and City
Manager Latta:
In the discussion prior to the June 7 Council meeting,
the question was raised as to whether this ordinance would
also extend the City ' s masonry requirements to the extra-
territorial jurisdiction. The ordinance, as originally
written, did not include the masonry ordinance as one of the
ordinances being extended into the ETJ; however , it is our
opinion that the requirements of the masonry ordinance could
also be extended into the ETJ.
Enclosed is a revised version of the captioned
ordinance which has been changed to include the masonry
ordinance . If it is the Council 's desire to include the
masonry ordinance within the provisions of the ordinance
being considered, the motion to approve the ordinance on
second reading should include an amendment to that effect. 1
