0423CITY OF SOUTHLAKE ORDINANCE NO. 423 AN ORDINANCE AFLENDING THE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS, ORDINANCE NO. 334 TO PROVIDE RULES A1FD REGULATIONS FOR THE SUBMISSION OF A SITE PLAN PRIOR TO THE ISSUANCE OF A BUILDING PERMIT IN OFFICE, RETAIL AND INDUSTRIAL ZONING DISTRICTS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, after public notices were given in compliance with State law and public hearings were conducted, the Planning and Zoning Commission recommended certain amendments and changes to the City's Zoning Ordinance, Ordinance No. 334, regarding site plan regulations for Office, Retail and Industrial zoning districts; and WHEREAS, after due deliberation and consideration of the recommendations of the Planning and Zoning Commission and all of the information submitted during the public hearings, the City Council has concluded that it is the public's best interest and in support of the health, safety, morals and general welfare of the City that Ordinance No. 334 be amended accordingly; and WHEREAS, the City Council finds and concludes that Ordinance No. 310 passed on May 7, 1985, Ordinance No. 310-A passed on June 4, 1985 and Ordinance No. 310-B passed on June 2, 1987, all relating to site plan regulations, should be repealed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Section 5 of the Zoning Ordinance of the City of Southlake, Texas, Ordinance No. 334, relating to District Regulations is hereby amended as follows: amended by which shall Subsection 5.8 relating to Office One is hereby adding a new subsection 5.8-4 entitled "Site Plans" read as follows: "5.8-4 SITE PLANS- No building permit shall be issued for any development under Office One until a site plan is approved in accordance with the provisions of Section 7, Subsection 7.21 of this Ordinances" B. Subsection 5.9 relating to Office Two is hereby amended to read as follows: "5.9 OFFICE - 2- The regulations set forth in this section, or as set forth elsewhere in this ordinance when referred to in this section, are the regulations of the "02 - Office Two District." The regulations for this district are identical to those for O1, including the site plan regulations but, excepting for building height. As shown in the Schedule of District Regulations, 01 permits only a two story building whereas 02 permits a six story building." C. Subsection 5.10 relating to amended by adding a new subsection 5~10-4 which shall read as follows: Retail One is hereby entitled "Site Plans" "5.10-4 SITE PLANS- No building permit shall be issued for any development under Retail One until a site plan is approved in accordance with the provisions of Section 7, Subsection 7.21 of this Ordinance." D. Subsection 5.11 relating to Retail Two is hereby amended by amending subsection 5.11-1 to read as follows: "5.11-1 PURPOSE AND INTENT- This district is intended for a unified grouping, in one or more buildings, of several, typically five or more retail and service shops or stores that provide for the regular needs and are for the convenience of local residents. It is intended that the development within a district or tract be developed as a unit, with adequate off-street parking for customers and employees, with coordinated architecture, and with appropriate landscaping and screening to insure compatibility with adjacent land uses. The regulations for this district are identical to the regulations for the RI District, including the site plan regulations but, excepting that the maximum building size permitted in R1 is 40,000 square feet whereas the maximum building permitted in the R2 District is 100,000 square feet. Retail facilities comprising an aggregate -2- floor space in excess of 100,000 square feet must be permitted under the Planned Unit Development regulations contained in this ordinance." E. Subsection 5.12 relating to Industrial One is hereby amended by adding a new subsection 5.12-7 entitled "Site Plans" which shall read as follows: "5.12-7 SITE PLANS- No building permit shall be issued for any development under Industrial One until a site plan is approved in accordance with the provisions of Section 7, Subsection 7.21 of this Ordinance." F. Subsection 5.13 relating to Industrial Two is hereby amended by adding a new subsection 5.13-7 entitled "Site Plans" which shall read as follows: "5.13-7 SITE PLANS- No building permit shall be issued for any development under Industrial Two until a site plan is approved in accord- ance with the provisions of Section 7, Subsection 7.21 of this Ordinance." Section 2. That Section 7 of the Zoning Ordinance of the City of Southlake, Texas, relating to Supplementary District Regulations is hereby amended by adding a new subsection to be numbered 7.21 and entitled "Site Plan Regulations: Office, Retail and Industrial Districts" which subsection 7.21 shall read as follows: "7.21 SITE PLAN REGULATIONS: OFFICE, RETAIL AND INDUSTRIAL DISTRICTS- These site plan regulations are intended to permit the orderly development of such districts and construction of improvements within such districts better serve the needs of the public, reduce the demands on community facilities and provide a harmony of growth within the City of Southlake and within the various zoning districts. Site Plan Requirement. A site plan approved by the City Manager, or his designee, shall be a prerequisite to the issuance of building permits and certificates of occupancy for any property located in zoning districts designated as: Office One, Office Two, Retail One, Retail Two, Industrial One and Industrial Two. A site plan approval request may be submitted concurrently with or subsequent to a zoning change request, but shall not be reviewed or considered until after the zoning change request has been approved by the City Council. -3- Site Plan Approval. A request for a site plan approval shall be processed in accordance with the procedures stated in this subsection 7.21. Modification of Site Plan. The City Manager, or his designee, may require such modification of a site plan as will promote the health, safety, morals and general welfare of the City. Amendments. Ail site plans approved hereunder may be amended pursuant to the same procedure and subject to the same limitations and requirements as any other site plan would require for original approval. Site Plan Information. Every application for approval of a site plan for real property located in Office One, Office Two, Retail One, Retail Two, Industrial One and Industrial Two zoning districts shall contain sufficient information delineating the characteristics of the site, changes in those characteristics as may be proposed by the development, and how the development will relate to public services and facilities. The site plan shall show at least the following items of information: (~) The land area included with the site, the land area of all abutting sites and the zoning classification thereof, all public and private rights-of-way and easements bounding and intersecting the site and the abutting sites which are proposed to be continued, created, relocated and/or abandoned. (2> The proposed finished grade of the site, shown to contour intervals of not to exceed two (2.0) feet. (3) A description of the proposed site and the boundaries thereof. (4) The location of each existing and each proposed structure on the site, the general category of use or uses to be contained therein, the number of stories, gross floor area, and the location of entrances and exits to buildings, and provide a general description of existing vegetation and trees with respect to proposed structures. -4- 5) The location of all on-site facilities for liquid and solid waste temporary storage pending disposal. 6) The location and width of all curb cuts and driving lanes. 7) The dimensions and capacities of parking areas and loading areas, and the character and location of illumination facilities for same. (8) Ail pedestrian walks, malls and open areas for use by tenants or the public. (9) The location and height of all walls, fences and screen planting, and landscaping as established in Appendix One: Bufferyards. (10) The location, size, height, and orientation of all signs other than signs flat on building facades. (11) The types of surfacing, such as paving, turfing or gravel, to be used at the various locations. (12) The location of fire hydrants. (13) Drainage plans and information as may be available to show that the development will not be adversely affected by flooding action. (14) Conceptual sketch of front building elevation. f. Issuance of Permits and Certificates. On approval of the site plan, all necessary permits or certificates authorized thereby may be issued. Subsequent to such approval, any changes must be authorized by the City Manager or his designee. Requirement For Zoninq. No application for zoning change for which a request for zoning to Office One, Office Two, Retail One, Retail Two, Industrial One or Industrial Two is made shall be accepted or filed by the City Secretary unless a site sketch is filed concurrent therewith. The site sketch shall be a scaled drawing showing the dimensioned boundaries of the property, the location and width of streets and highways adjacent to and on the property, all public -5- and private rights- of-way and easements bounding and intersecting the property and the zoning classifications of all abutting property. Filinq Fee. A fee of the greater of $150.00 or $50.00 per acre encompassed by the site plan shall be paid to the City at the time of filing of each site plan which fee shall be for the purpose of reimbursing the City for Administrative and Engineering time expended in reviewing such site plan. Such fee shall be non-refundable regardless of the disposition of the Application for zoning and the site plan." Section 3. Penalty Clause- Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. Severability Clause. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Repealer. This ordinance hereby repeals Ordinance No. 310 passed on May 7, 1985, Ordinance No. 310-A passed on June 4, 1985 and Ordinance No. 310-B passed on June 2, 1987, in their entirety but shall not repeal any other existing ordinance, rule or resolution of the City of Southlake, Texas, in effect on the date of its passage, unless there exists a conflict between any such other ordinance, rule or resolution and this ordinance in which event the terms and provisions contained herein shall control. Section 6. Effective Date.
