0420CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 420 AN ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS AMENDING ORDINANCE NO. 334, THE CITY'S COMPREHENSIVE ZONING ORDINANCE, BY AMENDING SUBSECTION 5.3, PROVIDING FOR THE ADDITION OF SINGLE-FAMILY ZONING DISTRICTS WITH MINIMITM LOT SIZES OF 40,000, 30,000 AND 20,000 SQUARE FEET AND PROVIDING FOR MINIMUM HOUSE SIZES WITHIN EACH SINGLE-FAMILY DISTRICT; AMENDING SECTION 6.1 - SCHEDULE OF DISTRICT REGULATIONS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; AND ENACTING OTHER PROVISIONS RELATED TO THE PURPOSES OF THIS ORDINANCE. WHEREAS, the City Council finds that all legal requirements relative to public notice and public hearings have been complied with and that the Planning and Zoning Commission has recommended the City Council consider and approve an amendment to Ordinance No. 334 as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That Section 5.3 of Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended in its entirety to read as follows: "5.3 SF-1 SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-1 - Single Family Residential District. 5.3-1 PURPOSE AND INTENT -The purpose and intent of the SF-1 - Single Family Residential District is to provide for compatible land, building, and structure uses primarily oriented to low density residential purposes, select agricultural uses, open space uses, and select community facility uses. The SF-1 district further serves as a transitional element between limited residential development and intense agricultural activities with that of higher density urbanized areas of the City. Low density detached single family residential dwellings and development, along with the aforedescribed uses, comprise the principal elements of the district. 5.3-2 USE REGULATIONS - Land, buildings and structures may be used only for the purposes allowed in this subsection. 5.3-3 PERMITTED PRINCIPAL USES Agricultural Uses - Agricultural uses whose products are grown primarily for home consumption such as domestic gardening, berry or bush crops, tree crops, flower gardening, orchards, and aviaries. Residential Uses - Single family detached dwellings. Community Facility Uses - Public, semi-public and private parks, recreation and open space uses including: playgrounds, parkways, greenbelts, ponds and lakes, botanical gardens, pedestrian paths, bicycle paths, equestrian bridle trails, nature centers, bird and wildlife sanctuaries, private boat docks, swimming pools and game courts, and other uses of a similar nature and character. 5.3-4 MINIMUM LOT SIZE AND RESIDENCE SIZE REQUIREMENTS - Lots for any permitted use in an SF-1 district shall have a minimum area of one (1) acre. Residences in an SF-1 district shall have not less than 2,500 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations relating to the SF-1 district." Section 2. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.23, entitled "SF-40.0 Single Family Residential District," and containing the following provisions: "5.23 SF-40.0 SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-40.0 - Single Family Residential District. 5.23-1 PURPOSE AND INTENT -The purpose and intent of the SF-40.0 - Single Family Residential District is to provide for compatible land, building, and -2- structure uses primarily oriented to moderately low density residential purposes, open space uses, and select community facility uses. Moderately low density detached single family residential dwellings and development, along with the aforede$cribed uses, comprise the principal elements of the district. 5.23-2 USE REGULATIONS - Land, buildings and structures may be used only for the purposes allowed in this subsection. 5.23-3 PERMITTED PRINCIPAL USES Agricultural Uses - Agricultural uses whose products are grown primarily for home consumption such as domestic gardening, berry or bush crops, tree crops, flower gardening, orchards, and aviaries. Residential Uses - Single family detached dwellings. Community Facility Uses - Public, semi-public and private parks, recreation and open space including: playgrounds, parkways, greenbelts, ponds and lakes, botanical gardens, pedestrian paths, bicycle paths, equestrian bridle trails, nature centers, bird and wildlife sanctuaries. 5.23-4 MINIMUM LOT SIZE AND RESIDENCE SIZE REQUIREMENTS - Lots for any permitted use in an SF-40.0 district shall have a minimum area of forty thousand (40,000) square feet. Residences in an SF-40.0 district shall have not less than 2,500 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-40.0 district." Section 3. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.24, entitled "SF-30.0A Single Family Residential District," and containing the following provisions: "5.24 SF-30.0A SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-30.0A - Single Family Residential District. -3- 02138/20 5.24-1 5.24-2 5.24-3 5.24-4 5.24-5 5.24-6 PURPOSE AND INTENT -The purpose and intent of the SF-30.0A - Single Family Residential District is to provide for compatible land, building, and structure uses primarily oriented to moderately low density residential purposes, open space uses, and select community facility uses. MINIMUM LOT SIZE AND RESIDENCE SIZE REQUIREMENTS - Lots for any permitted use in an SF-30.0A district shall have a minimum area of thirty thousand (30,000) square feet. Residences in an SF-30.0A district shall have not less than 2,500 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-30.0A distric%. CONCEPT PLAN REQUIREMENT- A Concept Plan meeting the requirements of Section 5.29 of this Ordinance is required to be submitted with a request for zoning to an SF-30.0A - Single Family Residential District. SITE PLAN APPROVAL REQUIREMENT - An approved site plan shall be a prerequisite to the issuance of a building permit or certificate of occupancy for -4- any property in an SF-30.0A - Single Family Residential District. Information required to be submitted, approval of the site plan and any administrative action shall be in accordance with Sections 5.6-3, 5.6-4 and 5.6-5 of this Ordinance, to the extent such requirements are applicable to a residential district." Section 4. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.25, entitled "SF-30.0B Single Family Residential District," and containing the following provisions: "5.25 SF-30.0B SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-30.0B - Single Family Residential District. The purpose and intent, use regulations, permitted principal uses, lot size requirements, Concept Plan requirements and site plan approval requirements for the SF-30.0B district are identical to the SF-30.0A district, as set forth in subsection 5.24 hereof. Residences in an SF-30.0B district shall have not less than 2,000 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-30.0B district." Section 5. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.26, entitled "SF-20.0A Single Family Residential District," and containing the following provisions: "5.26 SF-20.0A SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-20.0A - Single Family Residential District. 5.26-1 PURPOSE AND INTENT -The purpose and intent of the SF-20.0A - Single Family Residential District is to provide for compatible land, building, and structure uses primarily oriented to moderately 10W density residential purposes, open space uses, and select community facility uses. Moderately low density detached single family residential dwellings and development, along with the aforedescribed uses, comprise the principal elements of the district. -5- 5.26-2 USE REGULATIONS - Land, buildings may be used only for the purposes section. and structures allowed in this 5.26-3 PERMITTED PRINCIPAL USES Aqricultural Uses - Agricultural uses whose products are grown primarily for home consumption such as domestic gardening, berry or bush crops, tree crops, flower gardening, orchards, and aviaries. Community Facility Uses - Public, semi-public and private parks, recreation and open space including: playgrounds, parkways, greenbelts, ponds and lakes, botanical gardens, pedestrian paths, bicycle paths, equestrian bridle trails, nature centers, bird and wildlife sanctuaries. 5.26-4 MINIMUM LOT SIZE AND RESIDENCE SIZE REQUIREMENTS - Lots for any permitted use in an SF-20.0A district shall have a minimum area of twenty thousand (20,000) square feet. Residences in an SF-20.0A district shall have not less than 2,500 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-20.0A district. 5.26-5 CONCEPT PLAN REQUIREMENT- A Concept Plan meeting the requirements of Section 5.29 of this Ordinance is required to be submitted with a request for zoning to an SF-20.0A - Single Family Residential District. 5.26-6 SITE PLAN APPROVAL REQUIREMENT - An approved site plan shall be a prerequisite to the issuance of a building permit or certificate of occupancy for any property in an SF-20.0A - Single Family Residential District. The purpose and intent, use regulations, permitted principal uses, lot size requirements, Concept Plan requirements and site plan approval requirements for the SF-20.0B district are identical to the SF-20.0A district, as set forth in subsection 5.26 hereof. Residences in an SF-20.0B district shall have not less than 2,000 square feet of floor- area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-20.0B district." Section 7. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.28, entitled "SF-20.0C Single Family Residential District," and containing the following provisions: "5.28 SF-20.0C SINGLE-FAMILY RESIDENTIAL DISTRICT - The regulations set forth in this subsection, or as set forth elsewhere in this ordinance when referred to in this subsection, are the regulations of the SF-20.0C - Single Family Residential District. The purpose and intent, use regulations, permitted principal uses, lot size requirements, Concept Plan requirements and site plan approval requirements for the SF-20.0C district are identical to the SF-20.0A district, as set forth in subsection 5.26 hereof. Residences in an SF-20.0C district shall have not less than 1,500 square feet of floor-area. See Section 6 hereof (Schedule of District Regulations) for other regulations applicable to the SF-20.0C district." Section 8. That Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended by adding a new subsection numbered 5.29, entitled "Concept Plan Requirements, and containing the following provisions: -7- 5.29 5 .29-1 5.29-2 5.29-3 CONCEPT PLAN REQUIREMENTS PURPOSE: The Concept Plan is intended to provide the Planning and Zoning Commission and the City Council with the information and data that is necessary to assess the merits of requests for zoning in the SF-30.0 and SF-20.0 districts. WHEN REQUIRED: Approval of a Concept Plan shall be required in connection with a request for zoning of any specific parcel of land when requesting zoning to any SF-30.0 or SF-20.0 zoning district. CONTENT OF CONCEPT PLAN: A Concept Plan shall include all of the following information in graphic representation or written documents as appropriate, and shall be prepared by a registered architect, registered engineer or registered surveyor· Legal description and a survey or plat certified by a registered land surveyor, showing date, scale, north point, property boundary lines, dimensions and easements. 2 Applicant's name and address and their legal interest in the subject property. 3 Owner's name and address, if different from applicant, with owner's signed consent to the filing of the application. Present zoning classification and present use of subject property. Land use designation as contained in the Comprehensive Master Plan. Conceptual representation of proposed use· Conceptual representation of points connection to the public right of way. of Computation of proposed number of dwelling units and the total acreage. Conceptual landscaping for common areas. 10. Street address (or common description) of the property. -8- 11 A graphic rendering of the existing site conditions, which depicts all significant natural, topographical and physical features of the subject property including contours; location and extent of tree cover; location and extent of water courses, marshes and flood plains on the subject property; and, existing drainage patterns. 12 Vicinity map indicating the area in which the property is located. 13 Other information the applicant owner might wish to include. and/or 14. Such other information as may reasonably be required by the Planning and Zoning Commission or the City Council. Each applicant shall file one (1) mylar and two (2) blueline copies of all conceptual or graphical representations required herein, in a size sufficient to clearly show all information required, and a copy reduced to 8 1/2 X 11, and two (2) copies of written documents. 5.29--4 EFFECT OF CONCEPT PLAN. Ail subsequent site plans shall substantially conform to the Concept Plan approved with the zoning application. Section 9. That Section 7.18 of Ordinance No. 334, the ~it¥'s basic Comprehensive Zoning Ordinance is hereby amended in its entirety to read as follows: "7.18. HEALTH REGULATIONS: SEWAGE DISPOSAL - Ail property developed within the City shall be connected to the City's sewer system or shall be served by a septic tank in accordance with the provisions of Ordinance No. 440 of the City." Section 10. That the Schedule of District Regulations set forth at Section 6.1 of Ordinance No. 334, the City's basic Comprehensive Zoning Ordinance, is hereby amended to read as set forth in Exhibit "A" hereto. Section 11. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the -9- remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 12. Ail ordinances or parts of ordinances inconsistent or in conflict with the provisions of this Ordinance are hereby expressly repealed to the extent of the inconsistency or conflict. Section 13. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense; and a separate offense shall be deemed committed upon each day during or on which a violation occurs.
